Louisiana's high court had denied release for 63-year-old Fair Wayne Bryant earlier this year for the 1997 burglary that netted him a set of hedge clippers. In dissent, Chief Justice Bernette Johnson said the habitual offender law under which Bryant was sentenced was a “modern manifestation” of Jim Crow era laws aimed at jailing Black people for simple crime. Neil Simon was 91.According to Bill Evans, Simon's longtime friend and the Shubert Organization director of media relations, says the playwright died early Sunday of complications from pneumonia in a Manhattan hospital.Simon was the American theater's most successful and prolific playwright in the second half of the 20th century. He won three regular Tonys, plus one for special achievement, as well as a Pulitzer and the Mark Twain prize for humor.Simon's successes included "The Sunshine Boys," ''Plaza Suite" and "Sweet Charity." And most of all, he really, really loves penguins.But Jacob has Stage 4 high-risk neuroblastoma, and doctors told his family in early October he probably only had a month to live.So they'll celebrate Christmas early this year, and Jacob wants people to celebrate with him by sending him cards, his mother, Michelle Simard told CNN."He got some cards from this Halloween, and he opened up and saw them and it was like getting a gift. He read it to us and had a big smile his face and his nose scrunched," Jacob's father, Roger Guay, told CNN in a phone interview. "He was excited to see what people had to say and it just brightened his day."Fighting a long battleJacob was diagnosed with high-risk neuroblastoma when he was 5. "He's accomplished everything that he needed to do by 9 years old, and a lot of people don't accomplish that, ever."An early ChristmasArtinyan said the family decided to "fast-forward" Christmas to give Jacob one last celebration.And for him, that means a lot of snow, a decked-out tree, and of course, a real-life Santa Claus.But before his improvised Christmas celebration takes place in early November, Jacob asked for cards from anyone around the world who wanted to share his Christmas spirit.And only five days after he announced his wish, he has already received more than 100 cards from people all over the country -- and even beyond."We got over a hundred, and they're from all over the world. NEW PORT RICHEY, Fla. — A New Port Richey, Florida man has been arrested after he allegedly raped a 15-year-old girl at his house while playing Grand Theft Auto, deputies say. The alleged rape was witnessed by another gamer who overheard the incident while playing the game with the suspect over PlayStation 4. Daniel Enrique Fabian, 18, was arrested on Wednesday, November 21 and charged with lewd and lascivious battery in connection to the incident which occurred on June 28, 2018. The 15-year-old girl was at Fabian's home at the time of the incident. Fabian is known to the victim. Fabian was playing Grand Theft Auto with another gamer when he told the other gamer he had a girl over at his house and he was going to "smash" her.Fabian stopped playing the game for 15 minutes and during that time, the other gamer says Fabian's microphone was still on and he could hear the victim moaning and saying "no." The victim told Fabian to stop four times, but he continued to have sexual intercourse with her, according to the arrest affidavit.After 15 minutes, Fabian resumed playing the video game with the other gamer. A Sexual Assault Victim Exam was done on the 15-year-old girl and the results supported the allegation of sexual abuse. Fabian was arrested and booked into the Land O' Lakes Detention Center. 1350
