SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay started his sentencing hearing Wednesday for violating federal immigration laws.Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash. SAN DIEGO (KGTV) - A Minnesota man suspected of possessing child pornography may be in San Diego, according to the San Diego Police Department.Jamison Michael Nelson, 40, was the focus of a news release issued Monday to alert the public.San Diego Police did not release details about the charges, but information from DL-online.com indicated a man named Jamison Michael Nelson was charged with six felony counts of possessing pornographic works on a computer.The National Center for Missing and Exploited Children received an alert from Google indicating that three images which may have been child pornography had been uploaded to a Gmail account, according to the report.DL-online.com reported that a search of Nelson’s residence turned up a hard drive hidden in a coffee pot.San Diego Police did not indicate why they believe Nelson may be in our area.He is white, six-feet tall, 185 pounds, with brown hair and green eyes. 934

SAN DIEGO (KGTV) - A resident inside an Encanto home opened fire on an intruder Wednesday, San Diego Police said.The victim first vandalized a car in the 6800 block of Charlene Ave. in the Broadway Heights section of Encanto, according to police.Police believe the victim then used a rock to break into a home where people were inside. One person was armed and fired a shot at the intruder.The victim was taken to the hospital. He may be related to the people in the home, and may have been under the influence of alcohol or drugs, police said.Officers did not release the victim’s identity or condition. 612

SAN DIEGO (KGTV) - A man who was attempting to paint graffiti on a downtown building fell to his death Friday morning in East Village. The incident was reported about 8:30 a.m. on 15th Street near Broadway, across from San Diego Police Headquarters.
