SAN DIEGO (KGTV) — County officials closed a portion of La Jolla's coastline after a sewage spill Friday morning.The closure was issued for the area of Playa Del Norte in Windansea, near the 7000 block of Neptune Pl., after a sewage spilled before 9:30 a.m.Seven year La Jolla resident Marc Hirschfield said he was walking his dogs Saturday morning when he noticed the yellow warning signs dotting the beach and asked lifeguards what happened. He said they told him "there was a manhole cover that overflowed and raw sewage spilled into the ocean."Lifeguards told 10News it was a storm drain to blame in the same area.The spill has been contained, according to the County Department of Environmental Health, but there still may be impacts to water quality after 130 gallons of sewage entered the beach area.Warning signs have been placed in the area until samples of the ocean water indicate the water is safe for recreational use. It's not clear how long the area will remain closed.Some beach-goers ignored the signs, others, like surfer Cole Reiner just didn't see them. "Well I went out into the water. I mean contaminated doesn’t sound great, but I was out there and it says may cause illness so that’s not great," he said. Lifeguards couldn't say when the beach would reopen. As of 4:30p.m. the county said the beach was still closed."City life guards recommend 72 hours so for me it’ll probably be 48," HIrschfield said. 1435

SAN DIEGO (KGTV) -- Consumer prices rose by nearly four percent in San Diego over the last year largely due to an increase in the cost of gasoline, according to a new report by the U.S. Department of Labor. According to the report, prices in the San Diego area rose 3.8 percent over the last 12 months and 1 percent over the last two months. The largest increases stem from household furnishings and operations and housing, which rose by 9.3 and 5.2 percent over the last year. The report points out that an increase in prices for food and energy over the last two months was fueled by higher gas prices. The energy index jumped 11.4 percent over the last two months mainly due to higher gas prices, according to the report. Over the last year, food from home increased by more than 2 percent while food away from home actually decreased by 0.4 percent. California's gas tax will jump by another 5.6 cents per gallon on July 1, 2019. Although the report may seem discouraging, the cost increases were at least partially offset by a 1.1 percent price decline in education and communication. The report shows that items like cereal and baked goods were up by nearly 2 percent from May of 2018 to March of 2019. Apparel was up by more than 6 percent from May of 2018 to March of 2019. Milk and dairy products also rose by 2 percent in the same time period. Consumer prices increased in a similar way in neighboring Los Angeles. Over the last year, prices in Los Angeles rose by more than three percent, but May only saw prices rise by 0.2 percent. The report shows that the cost of household goods and operations rose by nearly 6 percent while housing jumped 4.4 percent. In the west as a whole, consumer prices rose by nearly 3 percent while increasing by 0.5 percent in May. According to the agency, although prices for household goods also rose by more than a percent, the increased cost was partially offset by lower prices for apparel and recreation. 1961

They echoed Palomar Health's policy in that the COVID-19 vaccine will not be mandated but workers who decline to get it must wear PPE.San Diego employment attorney and legal analyst Dan Eaton told ABC10 News on Monday that hospitals can impose a mandate but so far that hasn't happened. “Employers generally have the legal right to mandate vaccination in the private workplace, subject to accommodations for medical conditions and religious objections, but there is a broader ethical question about whether they ought to mandate vaccination,” he said. He explained that the concern becomes whether mandating a resistant population creates a morale problem. “[The question is] whether, at the end of the day, you're acting in a nurturing fashion toward your employees if you mandate a vaccination that they don't want or they don't trust.”Eaton said it may be that at some point the state or federal legislature steps in in some form or fashion with respect to mandatory vaccination, but that's not the current case. 1718

Clients' temperatures are taken. Their hands are sanitized. Their personal effects are placed in a bag. In another bag is everything needed for their appointment, from combs to scissors."So they can feel comfortable that when they sit down, everything has been sanitized for them," said Gila Rut President Keri Davis-Duffy.Inside the salon: masks, social distancing, and capes disposed of after each appointment. The owners are intent on protecting clients, staff and also, the business. A day head of an appointment, clients are emailed a waiver."They have to sign a waiver releasing Gila Rut of any liability should anybody contract COVID-19," said David-Duffy.Davis-Duffy is hardly alone. At the Point Loma Sports Club, set to open Friday, a liability waiver is also required before you can enter. Across the county and country, at salons, gyms, offices and even the New York Stock Exchange, waivers are quietly becoming the new normal. It's unclear how much they're really needed. Attorneys tell us it would be hard to prove a business caused an illness. and the waivers don't protect a business against 'gross neglience.'"If someone signs a waiver, that means they agree not to hold someone else responsible for any damages. What we're seeing here are businesses trying to avoid liability when a patron is exposed to covid-19 at their place of business. Waivers are not, however, ironclad. For a business to be protected, the business must show that such a waiver was signed and that it covers the potential claim. Even if a business shows that, a waiver is invalid if the business was grossly negligent or reckless. Also, a person could challenge a waiver by claiming it was signed under duress or that it was unconscionable," said attorney Evan Walker.For Davis-Duffy, the waiver is simply another precaution."We're in a vulnerable business ... We just want to make sure we're protecting are business and create some sense of sustainability," said David-Duffy.Davis-Duffy says all but a handful of clients have agreed to sign the waiver. 2279

  

SAN DIEGO (KGTV) — California Highway Patrol investigators are correcting their initial findings of a fatal wrong-way crash on Interstate 5 in February.In March, CHP said 35-year-old Justin Callahan was at fault for the fatal collision on the northbound I-5 transition ramp to westbound I-8 on Feb. 26 just before 2 a.m.Investigators had believed Callahan, driving in a Volkswagen Jetta, was traveling eastbound in the westbound I-8 lanes when he collided with a Toyota Camry on the transition ramp — a finding Callahan's family had contested.RELATED: Family disputes CHP's details of I-5 wrong-way crashCallahan died at the scene while two female occupants inside the Toyota suffered major injuries.Friday, CHP said they've now concluded the Toyota was traveling in the wrong direction when it collided with Callahan's vehicle on the ramp.Investigators also said the driver of the Toyota, 22-year-old Lauren Freeman, was found to be under the influence at the time of the crash.Freeman turned herself into San Diego Superior Court Friday. She faces charges including murder, vehicular manslaughter while intoxicated, and felony DUI causing injury or death.RELATED: Driver killed in wrong-way crash on I-5 in Midway areaCallahan's family said following the crash he should have been heading to Ocean Beach from Chula Vista after work at the time of the crash, not away from it."It doesn't make any sense," his brother, Tommy Villafranca, told 10News in March.  "Why would he get back on the freeway and get back the opposite direction?"It takes 21 minutes just to get from his work to Sunset Cliffs Boulevard. He’s still got to turn around go back, and that would take even more time, so the timeline is not working at all."Callahan's parents, Lowell and America Callahan, sent 10News the following statement:"We are grateful for the many hours spent by the CHP investigators and especially officer Cliinkscales, who kept us informed over the last several months, concerning the investigation. Initially, Justin had been reported by CHP as the wrong way driver on I-5 north on the transition ramp to I-8 in San Diego. This took place early Monday morning at approximately 1:55 a.m. on February 26, 2018. We are pleased that his name is finally cleared in this horrible collision that took his life instantly. 2366
