DETROIT — "They strictly thought their so-called white privilege was gonna work this time and it didn't," said Marc Peeples who was acquitted in a directed verdict in a case where three women, who are white, accused Peeples, who is black, of stalking them.The women repeatedly called Detroit Police on Peeples, an urban farmer, who said he wanted to grow a garden in his old neighborhood in the area of 8 Mile and John R on the city's east side. In the beginning, Peeples said one of the women donated soil to his project, but then he and his attorney say it became about power, race and false allegations."These women were clearly lying," said Peeples who was shocked when Detroit Police arrested him after prosecutors charged him with three misdemeanor counts of stalking.This was a case of "gardening while black" said defense attorney Robert Burton-Harris, who represented Peeples at trial.Harris said this is similar to other cases around the country where "you have people calling the police on, mostly,?African-Americans for doing very mundane things.""I wasn't doing anything but planting a seed to help my community grow," said Peeples. 36th District Court Judge E. (AP) — The wife of a man who was struck and killed by a Metrolink train in Southern California says investigators told her he pushed her out of the way.The Orange County Register reports Saturday that Jacqueline Gibson, of Lake Elsinore, said she was vacationing with her 71-year-old husband Ernest Gibson Monday when they crossed the tracks to return to their Dana Point campground.She says he suddenly told her to run. She found herself on the other side moments later as the train came through.Once it passed, she found her husband's body.She says investigators told her video from the train showed her husband pushing her out of the way.Metrolink officials say the area was restricted. For Anna Malic, December 17th is one of them.“It’s our 12 year anniversary,” Malic said.Tragically, this year will be different.“(The kids) realize that daddy’s not here anymore,” Malic said. “They really miss their dad.”For the children, it’s been a huge adjustment. To them, their dad was nothing short of heroic."He was very great,” said 11-year-old Ace. “He was selfless to everybody, even strangers. (KGTV/AP) -- A notorious 86-year-old jewel thief convicted of a theft in Mission Valley is now charged with shoplifting.Doris Payne was arrested July 17 near Atlanta and charged with misdemeanor shoplifting after a Walmart employee said she tried to leave the Chamblee store with items she hadn't paid for.Payne was on probation at the time after pleading guilty in March to a felony shoplifting charge for trying to steal a ,000 necklace from a department store in December.
