SAN DIEGO (KGTV) -- An exonerated marine colonel was denied release from the Camp Pendleton brig. Colonel Dan Wilson's release was denied three months after he was exonerated for sexually assaulting a 6-year-old girl. In July, an appellate court overturned his conviction. Since then, his family has been awaiting his release. His wife spoke to 10News over the phone just moments after his release was denied. "I was shocked and I burst into tears. This man has been in for two years and 10 months," said Susan Wilson. "If they cant believe their own court of appeals then there's a problem there."His family maintains the system has been unjust from the beginning. "I just feel as though he’s getting a really bad rap by the USMC after 38 years of service and 11 deployments," said Wilson. "It's astounding to me that they pride themselves on ‘Marines take care of their own’. Well, they haven’t taken care of us whatsoever."Col. Wilson was also convicted of unauthorized leave and conduct unbecoming of an officer. He'll stay behind bars while he awaits a re-sentencing for those charges. 1100
SAN DIEGO (KGTV) — An East County man suspected of posting graphic videos and plotting a downtown mass shooting was arrested Thursday.Steve Andrew Homoki, 30, was arrested and charged with multiple felony assault weapons charges, possession of a high capacity magazine, and child endangerment. San Diego Police say Homoki posted graphic videos online depicting assault weapons being pointed at unknowing pedestrians outside The Sofia Hotel in downtown San Diego.RELATED: FBI searching for terrorist from San Diego; million reward offered by State DepartmentSDPD served a search warrant at Homoki's Spring Valley home and seized several firearms from his residence. According to the warrant, Homoki has 14 firearms registered in California purchased between February 2018 and May 2019.According to the warrant, Homoki booked a room at the Sofia Hotel on March 22 and checked out the next day. On Sept. 17, a video was posted to a "Steven Anderson" Youtube channel, believed to belong to Homoki. The video showed the interior of a Sofia Hotel room from what appears to be a camera mounted to a man's body.The videographer is not seen as the video continues to show two assault-style rifles on a couch, along with a female mannequin head, a Department of Homeland Security license plate, an envelope, and ammunition scattered on the room's floor, documents stated.RELATED: FBI seeks men wanted for takeover bank robbery in EscondidoThe video then shows a semi-automatic handgun being loaded and pointed at people walking outside in the area of Front Street and Broadway, as the subject is heard saying "jams, boom," documents said. The ammunition then jams the gun and the subject unloads the round.The subject continues, picking up an assault-style rifle from the couch and pointing it out the window at pedestrians again and pulling the trigger while the firearm's chamber is empty, or "dry firing." The subject can be heard saying "one down, more to go," the warrant said.Another video posted to the same Youtube channel on Sept. 18 appears to be taken from inside the same hotel showing similar images play out, the warrant continued. The unknown person said they feared he was planning to do something, adding they can "almost guarantee if he is confronted while at home, he will open fire on Federal Agents or police."The unknown person said they watched the user "slowly become less stable over the period of almost an entire year" and post a goodbye message about five or six months prior.Authorities said they believe Homoki was rehearsing a domestic terrorist attack in the videos. SDPD has also filed a gun violence restraining order against Homoki.Homoki is scheduled to be arraigned on Monday. 3047

SAN DIEGO (KGTV) - An Ocean Beach man says he was home when two burglars in a white Mercedes-Benz were raiding his garage and stealing his vehicle. Along Lotus Street last week around 1:30 in the afternoon, Evan Montoya was in his upstairs bedroom and never heard a thing. But when he later went down to the garage, he noticed some things were out of place and his car keys were gone. Outside, the car belonging to Montoya - an Uber and Lyft driver - was nowhere to be found."My heart sank into the pit of my stomach. That's my livelihood. They took my entire world when they took my car," said Montoya.But that was hardly the entire loss. Montoya believes the intruders slipped under the garage door - left open because the garage gets hot - before grabbing anything electric."Basically they went on a shopping spree through our garage and took whatever they wanted," said Montoya. After the break-in, a neighbor handed him surveillance video showing a white Mercedes sedan stopping in the alley in front of the garage. In the video, a man and a woman are seen going back and forth to their garage, before they finally drive off."Makes you feel unsafe in your home, which is the one place you're supposed to feel safe," said Montoya.Montoya's car was found abandoned a few days later. Meanwhile, the video has been shared by neighbors across social media. Some seven other neighbors have reported similar, recent break-ins. SAN DIEGO (KGTV) — An Ohio man accused of pepper-spraying 11 San Diego Police officers during a demonstration last month has pleaded not guilty.Denzel Draughn, 28, pleaded not guilty on Wednesday to felony counts of unlawful use of tear gas against a peace officer and 11 felony counts of use of force against a peace officer.On Aug. 28, a group of demonstrators protesting the shooting of Jacob Blake in Kenosha, Wisc., marched through downtown San Diego.See Sky10 video of the demonstration below:Police say that as the group neared 9th and E Streets, a vehicle that was following the group failed to stop at red lights. After police stopped the driver, a crowd began to form near the car and officers who pulled the vehicle over.SDPD says that the group ignored demands to back up from the scene, prompting one officer to pull out pepper spray. Police say one person tried to knock the pepper spray out of the officer's hand, forcing the officer to discharge the spray.Several police officers then tried to arrest the person. As the officers were placing the person in custody, a pepper spray canister fell on the ground. Officers say Draughn picked up the canister and sprayed it twice, hitting 11 officers.SDPD says Draughn fled but was later found and arrested.If convicted, Draughn faces probation to 11 years in jail.
