SAN DIEGO (CNS) - Recent rainfall has led to an influx of seabirds washing ashore and becoming beached along San Diego's coast, the San Diego Humane Society said Friday.The organization's Project Wildlife program, which focuses on animal rehabilitation and conservation, has recently cared for multiple seabirds, including loons, western grebes and a blue-footed booby who became beached during periods of high surf and stormy weather.Seabird diets are also affected by rainfall as vacillating ocean temperatures cause their food sources to dive deeper than normal. Consequently, the birds are often too weak to get past strong coastal waves into the open ocean. Humane Society animal care staff recently transferred their rescued birds to SeaWorld for further rehabilitative care.Residents are advised to contact a lifeguard, the Humane Society's Humane Law Enforcement division at 619-299-7012, ext. 1, or SeaWorld at 800-541- 7325 if they see a beached or struggling seabird. SAN DIEGO (CNS) - San Diego County public health officials have reported 540 new COVID-19 infections and one new death related to the illness, raising the region's total to 59,656 cases and 908 deaths as the county continues to await news on whether it will sink into the dreaded purple tier of the state's four-tiered COVID-19 reopening plan.State officials reported Wednesday that San Diego County had an unadjusted new daily coronavirus case rate of 8.7 per 100,000. The adjusted case rate had dropped to 7.4 per 100,000, above the baseline of 7, qualifying the state for the purple, or most restrictive tier of the reopening plan. Last week's unadjusted case rate was 7.8 per 100,000.According to the reopening plan, a county has to report data exceeding a more restrictive tier's guidelines for two consecutive weeks before being moved to that more restrictive tier. A county then has to be in that tier for a minimum of three weeks before it may move to a less restrictive tier.San Diego County has been in the red tier for months, skirting but ultimately avoiding the purple tier, which would necessitate the closure of almost all indoor operations of nonessential businesses. Recent trends have shown a slow but steady increase in infection numbers.If the county cannot drop its adjusted daily case rate below 7 per 100,000, indoor operations in locations such as restaurants, museums, places of worship, breweries and retail businesses will have to either close entirely, move to outdoor operations only or modify in other ways.In recent weeks, the region had an unadjusted rate well above the purple tier guidelines, but a significant effort to increase the volume of tests had allowed for an adjustment to bring it back to the red, or substantial, tier.Dr. Wilma Wooten, the county's public health officer, said retail operations, including indoor shopping centers, will be limited to 25% of building capacity, down from the current 50%. Schools, unless they have already restarted in-person learning, will be restricted to distance learning. SAN DIEGO (CNS) - San Diego City Attorney Mara Elliott announced today that the city will use a 5,850 grant to fund a team of specialized prosecutors to handle cases involving drug-impaired drivers.The City Attorney's Office will use the renewed Drug DUI Prosecution Grant to handle cases of both drug-impaired and drug/alcohol-impaired driving, from arrest through conviction and sentencing. The state Office of Traffic Safety administers the grant from the National Highway Traffic Safety Administration."Driving under the influence of drugs can have devastating effects on San Diego drivers and their families," Elliott said. "Our city continues to see DUI cases involving the misuse of prescription drugs, marijuana and illegal drugs, often in combination with alcohol. This grant allows our highly specialized prosecution team to work closely with law enforcement to hold accountable those who endanger our community."Specialized prosecutors working under the previous grant from Oct. 1, 2017, to Sept. 30 of this year filed 228 misdemeanor cases of drug-impaired and drug/alcohol-impaired driving while the City Attorney's Office filed a total of 3,110 impaired driving cases during that time. The office has received grant funding for drug DUI prosecutions since the fall of 2014.Officials warn that use of prescription drugs and/or marijuana, especially in conjunction with alcohol use, can lead to a DUI arrest and conviction. SAN DIEGO (CNS) - The California Supreme Court on Monday upheld the conviction of a death row inmate found guilty of hiring another man to shoot and kill his fiancee in Alpine 20 years ago.Michael William Flinner applied for a life insurance policy for 18-year-old Tamra Keck, then arranged for his former employee, Haron Ontiveros, to kill her on June 11, 2000, according to the ruling.The killing occurred shortly after Flinner met Keck and began dating her.According to the ruling, Flinner named himself as the beneficiary in the insurance policy, and falsely alleged Keck was an employee at his landscaping business whose death would cause him to suffer financially. Prosecutors alleged Flinner arranged for Ontiveros to meet with Keck at a gas station, then direct her to his car in a nearby cul-de-sac under the guise of having engine trouble. Once there, he shot Keck in the back of the head.Separate juries convicted Flinner and Ontiveros of murder and conspiracy and found true special circumstance allegations of killing for financial gain and lying in wait. Jurors recommended capital punishment for Flinner and life imprisonment without the possibility of parole for Ontiveros.In the appeal, Flinner's counsel alleged his case was adversely affected by issues that included limited access to defense counsel, which was allegedly restricted by Flinner's relocation from the downtown San Diego jail to the jail in Vista. Flinner's defense attorney at the time claimed the distance to Vista and other limits on telephone communication would hurt the defense's preparation for trial. According to the ruling, the relocation was implemented because Flinner obtained the home addresses of the prosecutor and trial judge through another inmate.The state Supreme Court found the claims had no merit, as the trial court permitted increased communication between Flinner and the defense team at the defense's request.Another claim alleged juror misconduct by one panelist who sought to write a book about the trial. Flinner's counsel alleged her objectivity may have been compromised as a result. The state Supreme Court disagreed, though it noted the juror had made misconduct claims about other panelists, which the high court also ultimately ruled were unfounded. 2276
