SAN DIEGO (KGTV) - A "Day of Service" around Mission Bay will honor Maruta Gardner, the woman killed by a drunken driver while she was painting over graffiti in Mission Beach and Pacific Beach.Half a dozen service projects will take place around the bay all day Friday, Nov. 3."She was just a firecracker," said Dawn Reilly, one of the organizers with Beautiful MB. "She would liven everybody up and boost your morale and make you feel like you could accomplish anything if you just got together and did it."RELATED: Mission Bay activist killed in road rage crashFrom 10 a.m. until 12 p.m., volunteers will clean up the bike path from Rose Creek to Crown Point.The PB Street Guardians will help people do clean up and graffiti patrol around the Pacific Beach Business District from 11 a.m. until 1 p.m. and from 4 p.m.- 6 p.m.From 2 p.m.-4 p.m., the Mission Beach Town Council will lead volunteers on a clean up and graffiti patrol around MB.Volunteers can also spend time at a senior center near the bay all day if they want a non-physical option.Volunteers can also help paint utility boxes along Mission Boulevard.Full details on the activities, as well as links to register, can be found here.Organizers will also unveil a large mural on a wall at Mission Bay High School to memorialize Gardner. It was painted by local artist Israel Cervantes."It not only honors Maruta's spirit, but it also has the potential to inspire future leaders to make a difference in their community," said John Vallas, the Executive Director of Beautiful MB.Gardner was a principal at Mission Bay High for several years. Having the mural there not only memorializes her, but it can also help teach the next generation about what Gardner did and how to make a difference where you live."That's just as important what we're teaching every single day," said MBHS Principal Ernest Remillard.Several student groups will take part in the volunteer activities as well.Organizers chose November 3rd because that's the day the City Council declared as "Maruta Gardner Day" in 2015.Gardner was killed in February of 2016 by a drunk driver. She was removing graffiti at the South end of Mission Boulevard at North Jetty Road when she was hit.Jonathan Garcia pleaded guilty to a charge of gross vehicular manslaughter and was sentenced to 11 years in prison.Rather than focus on the crime, volunteers hope this day of service helps people remember how inspiring Gardner was to everyone who met her."She was amazing," said Remillard. "She was so proud and honored of her time here at Mission Bay.""I'm wowed by how many people were inspired by her," Reilly added. SAN DIEGO (CNS) - The San Diego-based owners and operators of the conservative One America News Network filed a million defamation lawsuit Monday against MSNBC and political commentator Rachel Maddow for saying on air the network ``really literally is paid Russian propaganda.'' The lawsuit filed in San Diego federal court by Herring Networks Inc., owners of the One America News Network -- or OAN -- calls Maddow's on-air statements ``utterly and completely false'' because OAN ``is wholly financed by the Herrings, an American family'' and ``has never been paid or received a penny from Russia or the Russian government.'' Maddow and MSNBC could not immediately be reached for comment. Maddow made the statements during a July 22 segment of her show, in which she cited a Daily Beast article stating that an OAN on-air reporter was ``on the payroll for the Kremlin.'' Herring Networks' court papers say the reporter, Kristian Rouz, is originally from the Ukraine and started his journalism career by writing articles for Sputnik News, which is affiliated with the Russian government. According to Herring Networks, Rouz was merely a freelancer for Sputnik who selected his own article topics for submission, and his work there had no significance toward his work for OAN. OAN demanded a retraction of Maddow's statement, according to the suit, which says that an attorney for NBC Universal refuted that Maddow's use of the word ``literally'' was not simply a figure of speech. The Herrings' attorney, Skip Miller, said in a statement that ``One America is wholly owned by the Herring family in San Diego,'' who he called ``as American as apple pie.'' Regarding Maddow's statements, Miller said, ``This is a false and malicious libel, and they're going to answer for it in a court of law.'' The suit also accuses Comcast, which owns MSNBC, of refusing to carry OAN on its cable service ``because it counters the liberal message of MSNBC,'' an act the plaintiffs call ``blatant censorship.'' 2004

SAN DIEGO (KGTV) -- A graduate program at the University of San Diego that teaches peacebuilding will evaluate whether or not to send students back to Culiacán, Mexico. The concern comes after Thursday's bloody battle involving Mexican federal troops and the son of notorious drug lord Joaquin "El Chapo" Guzman.The USD Kroc School's Trans-Border Institute has been regularly taking graduate students to Culiacán for the last five years, offering seminars and certificate programs in peacebuilding that have had an impact on the region, said program director Ev Meade."It's one of the only states in Mexico that's actually improved with respect to violence and was on the upswing until 3:30 yesterday afternoon and now all bets are off," Meade said in an interview.Meade was scheduled to speak at a conference on Friday but had to cancel the trip abruptly when cartel shooters laid siege to the city.The incident began when members of the Mexican National Guard patrolling a neighborhood in Culiacan and were ambushed by members of the Sinaloa drug cartel. Among those members of the criminal gang was Ovidio Guzman Lopez, the son of "El Chapo" Guzman.Cartel forces blocked roads with burning cars and demanded the release of El Chapo's son, who had been captured by Mexican security forces.Violence spread across the city until authorities suspended operations and released Ovidio Guzman Lopez.At least seven people were killed in the battle, one Mexican National Guard member, one civilian, and five cartel members, according to Security Minister Alfonso Durazo."It was terrifying. I had friends who were trapped in their offices. Other friends who were trapped in restaurant bathrooms," said Meade.The USD program in Culiacán has trained hundreds of local activists, public officials, and entrepreneurs in peacebuilding and social innovation, according to the Kroc School.Thursday's violence showed an entire militia of criminals could descend on the city in less than an hour, Meade said. He and school leaders are now weighing whether to send students back."I mean this is the point of a school of peace studies to go to places in conflict and help. Apply our best knowledge and methods. SAN DIEGO (KGTV) - A Delta passenger mauled by an emotional support dog has filed a lawsuit against the airline and the dog's owner, a Marine combat veteran.In June 2017, Marlin Jackson boarded a San Diego-bound flight in Atlanta headed for a work conference. Soon after, fellow passengers watched in horror as a brutal dog attack played out in front of them.Jackson sat in a window seat. In the middle seat was a Marine veteran was with an emotional support dog, a chocolate lab pointer mix, in his lap. According to a Jackson's just-filed lawsuit, while he was securing his seat belt, "the animal began to growl."RELATED: Service dog or pet? The lawsuit states the dog was briefly restrained, before pinning Jackson against the window and mauling Jackson again, resulting in 28 stitches and permanent loss of sensation in his face. He bled so profusely that "an entire row of seats had to be removed."The incident sparked national headlines, and tighter policies for emotional support and service animals. For example, Delta now requires proof of training, adding rules for the types and ages of the animals, as well the duration of flights that allow emotional support animals.Delta declined to comment citing pending litigation.
