SAN DIEGO (KGTV) - Fed up homeowners' associations are now turning to a local licensed private investigator for help with catching homeowners who are breaking HOA rules by renting out their homes on short-term vacation rental sites such as Airbnb, VRBO and Craigslist. “I admittedly watched a lot of Magnum, P. I. growing up,” jokes Nick Bradley of San Diego’s Bradley Investigative Services. In the last 6 months, Bradley has taken on a new field of investigative work. He and his associates are being hired by HOAs to investigate homeowners and tenants who are violating HOA bylaws and CC&Rs that prohibit turning units into short-term vacation rentals. Bradley gave 10News an exclusive interview about this new area of detective work. He declined to offer us specifics about how he executes his investigations into short-term rental violators. We ask, “Do you ever pose as a guest and do you do surveillance work?” Bradley replies, “No comment.” “My initial thought was [to laugh],” says San Diego attorney Dan Zimberoff. He represents homeowners and has previously represented HOAs. Zimberoff thinks it’s an extreme measure for HOAs to hire private investigators, but he understands why there’s so much passion over short-term rentals. “I think what makes this issue a little different [from others] is the dollars at stake, especially in San Diego. Some of these units can go for multiple hundreds of dollars a night or thousands of dollars. People care,” he adds. According to Airbnb, San Diego is the second ranking city in the state for Airbnb guests, after Los Angeles. Per Airbnb, in 2017 there were 537,000 guest arrivals in San Diego, generating 0 million in host income. “Right now, it’s too lucrative for [homeowners] to not do this,” says Bradley. The short-term rental fight in America’s finest city continues to be ugly. The city attorney has deemed short-term rentals illegal, per code. Meanwhile, the city council is delaying discussions over how to regulate them. Even so, certain HOAs have rules prohibiting them. The fines for violators can be astronomical. “It’s been ,000 per occurrence in some situations,” adds Bradley. If fines don’t work, court is another option. In 2012, The Mark condominium owners association filed a lawsuit against Thomas Stevens, a former condo owner, accusing him of violating the association’s policies about short-term rentals. He then had to pay out more than 0,000 after a judge ruled that he violated The Mark’s policies. Bradley can help gather the evidence that HOAs need to litigate. “When [HOAs] go to court, my documentation and reporting will basically count as expert witness testimony for our side,” he says. Zimberoff thinks it’s time for HOAs to consider allowing short-term rentals, but with reasonable and efficient regulations to curb nuisances, like excessive partying. “Instead of spending that energy trying to catch [a homeowner], let’s try to think of a long-term fix,” he adds. SAN DIEGO (KGTV) - Flooding from a fire service line threatened Wednesday to buckle a portion of a North Park street, blocks from the sites of several significant pipe breaks.The rupture was reported about 4:30 a.m. at the intersection of Polk Avenue and Kansas Street. The road buckled about 12 inches and water spilled onto half the roadway.Within an hour, the water department reached the scene to evaluate the situation. A city spokesperson tells 10News the break was on a fire service line, the pipe connecting a fire hydrant to a water main. They also said no one is without water, and that the break would be repaired the same day. SAN DIEGO (KGTV) - Dog owners who live in Normal Heights are worried about the future of the off-leash dog park at Ward Canyon.Earlier this month, signs appeared saying the large-dog area would be closed through the end of March 2020. People who use the park say it's because a few neighbors complained about the noise to the local Advisory Committee.Because the large-dog area is closed, all sizes of dogs have been sharing the small-dog area next to it."It's really crowded," says dog owner Christina Ardon. "When people get off work, everyone's over here. It's a little bit of a madhouse.""It's intimidating to smaller dogs," says Jason Douglas-Hiley. "They won't come into the park because they're afraid of the large dogs harassing the smaller dogs."Meanwhile, the City of San Diego has plans to renovate the entire park. Renderings show the area where the large-dog park currently sits would be turned into a community garden. The small-dog park would be expanded.But, City Councilmember Chris Ward's office says there is no funding for that project, and no timetable for when it could be added to the budget.People who use the park say they're afraid it will disappear while the project sits in limbo."To have to wait 2-5 years for them to construct a new park is a lifetime for a dog," says Douglas-Hiley.Park supporters have started a petition, asking the city to safeguard the small-dog area and also fence off a different portion of Ward Canyon for large dogs to use. SAN DIEGO (KGTV) - Families across the San Diego region are continuing to battle record high home prices and rents.But there are now several plans in the works to boost supply - and hopefully bring prices down."There's no magic bullet, no magic wand," said Rick Gentry, who heads the San Diego Housing Commission. "I don't see there's one solution. There are a host of solutions that we can bring to bear that over time will reduce the problem."Jimmy Ayala, who heads Pardee Homes of San Diego, says the biggest change that could lower prices is reducing the time it takes to get permits. "We think we can do that with lots of new development and lots of new housing, but we can't do it if our city government is going to throw out the rule book."Additionally, the San Diego Housing Commission is now able to help finance apartment projects with units for middle income earners, according to a new state law."The challenge for us is how do we develop lower than market rate product for this new customer base without taking away from the customer base that we've traditionally served," Gentry said, noting turnover has dropped drastically at its 3,400 affordable apartments in San Diego.Mark Goldman, a real estate lecturer at San Diego State University, said it would take decades to really balance out supply and demand.
