SAN DIEGO (KGTV) — The San Diego Sheriff's Department released several videos of a deadly shooting that occurred after a pursuit ended in Chula Vista.The shooting took place after a pursuit that started in Orange County around midnight on Oct. 4. The suspect of the chase, identified as Christopher Ulmer, 33, of Whitter, Calif., led officers to Chula Vista, where authorities stopped his vehicle using a pit maneuver on I-805 south near Orange Avenue at about 1 a.m.Police say Ulmer exited his vehicle and pointed his arm at officers who believed he was holding a firearm, prompting officers to fire their service weapons. Officers say Ulmer got back up and pointed at officers again, prompting a second round of gunfire.RELATED: Pursuit suspect shot by law enforcement on I-805 in Chula Vista identifiedUlmer was taken to a nearby hospital for treatment, where he was pronounced dead.Video released by the Sheriff's Department showed a photo of a black, cylindrical object found underneath Ulmer's body that authorities believed to have been a gun before they fired their weapons.The CHP officers involved in the shooting were identified as Sergeant John Holm who has been employed for 22 years, Officer Pakko Mendez who has been employed for 11 years, officer Javier Mendoza who has been employed for seven years, and officer Lauren Chi who has been employed for three years.RELATED: Authorities identify officers involved in deadly South Bay shootingThe San Diego Police officers involved in the shooting were identified as Sergeant Michael Pidgeon who has been employed for 26 years, and officer Patrick Harvey who has been employed for seven years. SAN DIEGO (KGTV) - There’s now a bombshell update about the standoff from earlier this summer at a condo complex near SDSU.Two officers were shot and dozens of neighbors were terrorized. 10News Investigative Reporter Jennifer Kastner has confirmed that officers wanted to search the suspect’s home for weapons days before the shooting.However, the Office of the San Diego County District Attorney did not attempt to get a search warrant. It was a horrifying night that ended with one person dead and two San Diego Police officers wounded by gunfire. Suspect Joseph Darwish died in the massive standoff.He had numerous hand guns and rifles, according to police. In the days after the shooting, 10News was tipped off by a law enforcement source that the FBI’s Joint Terrorism Task Force had wanted to search Darwish's home because they thought he had a weapon and was buying parts to make more weapons.Darwish wasn't supposed to own any weapons because of his criminal history. Our source says the FBI asked the District Attorney's Office to sign off on having a judge issue a search warrant, but the DA’s Office did not do so.For the past 7 weeks, 10News has been trying to confirm this with the DA’s Office.After our 10News attorneys got involved, the DA’s Office sent us a letter reading in part, “On June 13, 2018, the San Diego County District Attorney's Office received a request by law enforcement to review a draft of an affidavit in support of a search warrant to conduct a search of Mr. Darwish's person, property and residence. The District Attorney's Office determined that the warrant was legally deficient and so advised law enforcement.”June 13th was 10 days before the big shooting. 10News asked law enforcement expert and former police officer Kevin LaChapelle what "legally deficient" means. “It means that the District Attorney's Office felt that there was insufficient evidence or insufficient information that a judge would not grant a search warrant,” he explained.10News asked the DA’s Office why it turned down the FBI’s request to do a search warrant, but the DA’s Office will not answer that question, stating it's "exempt from disclosure".LaChapelle said this may have been a lesson learned the hard way, for the DA’s Office. He explained that the DA’s Office may reevaluate when it’s appropriate to seek a warrant. “It may help them start saying [a warrant] didn't meet [certain] criteria but it met this.It didn't meet a [level] 10 but it was at like a 7 and gosh, maybe [the DA’s Office needs] to start looking at this more so we can prevent these kinds of things,” he added. The FBI declined to comment about Monday’s story. San Diego Police have taken the lead on investigating the shootout. As of Monday morning, a lieutenant with the Homicide division said the investigation is still open and active and will probably take another couple of months to finish. 2913

SAN DIEGO (KGTV) - The San Diego City Council unanimously voted Tuesday to give final approval to place a measure on the November ballot that would change the city's police oversight structure.The current version is the Community Review Board; the ballot measure would replace it with a Committee on Police Practices."It is so desperately what the community wants and needs, so that we can build trust between the police department and the community," said Andrea St. Julian, co-chair of San Diegans for Justice, the group that wrote the ballot measure.The new committee would be appointed by the City Council, as opposed to the old board which was appointed by the mayor. The new committee would also have an independent lawyer and oversight from city staff not associated with the mayor's office or San Diego Police Department.St. Julian said these changes will help avoid conflicts of interest that the old board dealt with, especially because the CRB's lawyer was the City Attorney, who also acted as the lawyer for the police department.The new committee would also have broader power for investigations. It would be required to investigate any police shooting, as well as any time someone died while in police custody or while interacting with police.The committee could also investigate any other complaints against an officer and review all disciplinary action taken within the department."When a full investigation can be done by community members or at the direction of community members, people feel much more comfortable with the results," said St. Julian.Mayor Kevin Faulconer and County District Attorney Summer Stephan have both said they support the measure.
