SAN DIEGO (KGTV) -- Major changes are proposed to an exemption in state law that allows for a person under 21 to buy an assault-style rifle with a state-issued hunting license.The senator pushing behind the legislation also says he could author bring about more changes next year, including addressing an issue 10News uncovered in the wake of the Poway synagogue shooting in April. On Jan. 1, the state of California raised the legal age to buy all firearms - including long-guns - to 21. There were, however, exceptions for those over 18 who are military, law enforcement, or possess a valid, state-issued hunting license. Accused Poway synagogue shooter John Earnest, 19, purchased an AR-15 style weapon from a dealer in San Diego. State Sen. Anthony Portantino, a Democrat from the Los Angeles area, has amended current legislation, Senate Bill 61, to eliminate the hunting license exemption for "semiautomatic center-fire" rifles for those under 21."This is the weapon of choice that is finding itself into the wrong hands and, frankly, killing children,” Portantino said in an interview. "From our perspective we want to make sure we have a bill that gets signed into law that solves a problem.” Gov. Gavin Newsom has expressed support for this change.Portantino also said he would continue to seek out changes during next year's legislative. That includes potentially installing better verification practices when it comes to exemptions. That's because Earnest, a college student, did not have a valid hunting license when he purchased the firearm allegedly used in the attack, Fish and Wildlife has confirmed. 10News reported that under current law, the Justice Department leaves the responsibility to individual gun shops to verify hunting licenses. SAN DIEGO (KGTV) — Jalen McDaniels, San Diego State University basketball's sophomore forward, was accused of filming consensual sex acts with a classmate in 2016 without her knowledge and sharing it with friends, according to a civil lawsuit filed Wednesday in Washington.The civil suit alleges McDaniels recorded the intimate moments with an 18-year-old female student while they were both seniors at Federal Way High School near Tacoma, Wash.The lawsuit goes on to say while McDaniels later told the plaintiff about the unauthorized recordings and that he had shared it with his friends, she learned from other students that the video became widely circulated. When she confronted McDaniels, he explained he had gotten away with a similar incident involving another female student, according to the lawsuit.The plaintiff's attorney, Joan Mell, who filed the suit, wrote her client has suffered from several self-destructive behaviors as a result, including attempting suicide.SDSU is accused of wrongdoing in the lawsuit as well.Mell alleges in the lawsuit that SDSU was contacted by Washington police to provide them with McDaniels' phone number, but failed to do so. The suit says SDSU, instead, alerted former basketball coach Steve Fisher, who secured McDaniels a lawyer, and McDaniels refused to cooperate.The suit goes on to allege McDaniels' refusal to cooperate and, "that others concealed his wrongdoing prevented prompt criminal investigation and referral to the prosecutor's office for timely filing of criminal charges under Washington’s criminal offense of distribution of intimate images."In a statement, SDSU said there would be "no change in [McDaniels'] status at the university" at this time, after an investigation by Washington authorities resulted in no charges before McDaniels' enrollment at the school: 1837

SAN DIEGO (KGTV) - Inside an MCAS Miramar courtroom Thursday, the military held a preliminary hearing for a Navy corpsman who's charged in connection with the death of a fellow Navy corpsman, HM3 Michael Vincent De Leon. A corpsman is a type of medic.ABC 10News' cameras were not allowed inside, where accused corpsman HM1 Ryan Dini appeared in his military fatigues alongside his private counsel."A cover-up is what I felt [happened] from the get-go," Jose De Leon told ABC 10News just after the hearing. He has suspected a possible cover-up since his 30-year-old son died on the Twentynine Palms military base last year.At Thursday's hearing, the prosecution argued that HM1 Dini should face additional charges related to negligence. He's already charged in part with dereliction of duty resulting in death and drunk and disorderly conduct. HM1 Dini has 19 years of service with the military.The prosecution stated that HM1 Dini and a handful of others service members including Michael were at a house party on-base where alcohol was flowing, and guns were being dry-fired the night of the death.HM1 Dini's defense denied any wrongdoing."[HM1 Dini] being the most senior individual at this going-away party failed to protect not just Michael but everyone there because they were in danger when these firearms came out," said Jose De Leon. He told us in September, "We know that the firearm was dry-fired at Michael. The firearm was put away and it came out again and according to some statements they were horsing around, and the firearm came out again and that's when Michael was killed."He said that the shooting was first called in as a suicide but ABC 10News then learned from a source with close military ties that the death was being investigated as a homicide.A prosecutor named three other service members in the hearing. Their involvement remains unknown.The prosecution told ABC 10News that in about three weeks a judge will determine whether HM1 Dini's charges will be sustained and whether he'll face additional charges.Naval Criminal Investigative Service wrote to ABC 10News on Thursday that the investigation is still open. 2149
