SAN DIEGO (KGTV) -- A Hazardous Materials Team is investigating a Rancho Bernardo residence following reports of a possible fentanyl overdose death at the home Thursday morning.Crews responded at around 4 a.m. to calls of an overdose at a residence at 11300 Calenda Road located a few blocks from Westwood Elementary School.First responders discovered an unconscious 27-year-old male. The victim was declared deceased at the scene, according to San Diego County Sheriff's Office officials. Neighbors told 10News the man lived at the home with his parents.While at the scene, our 10News crew saw a woman being escorted out of the house and placed in an ambulance. It’s still unclear how she’s involved.The San Diego County Medical Examiner will identify the man and confirm his cause of death. 800

SAN DIEGO (KGTV) - A resident inside an Encanto home opened fire on an intruder Wednesday, San Diego Police said.The victim first vandalized a car in the 6800 block of Charlene Ave. in the Broadway Heights section of Encanto, according to police.Police believe the victim then used a rock to break into a home where people were inside. One person was armed and fired a shot at the intruder.The victim was taken to the hospital. He may be related to the people in the home, and may have been under the influence of alcohol or drugs, police said.Officers did not release the victim’s identity or condition. 612

SAN DIEGO (KGTV) - A new report paints a grim picture of the housing supply in San Diego.According to numbers just released by the Southern California Real Estate Research Council, housing permits in San Diego County dropped by 43% through the first six months of 2019, compared to the same period in 2018.So far this year, there have been 2,037 units of housing permitted in San Diego."We are in deep trouble in housing production," says Borre Winckel, the President of the Building Industry Association of San Diego County. "We can't build the housing for the people that need it most."Winckel says decades of increased costs from state and local fees, regulations, labor costs and more have led to this point. He says it's too expensive for developers to build anything that the average San Diegan can afford. He says that's pushing the "workforce" population of teachers, first responders and military out of the market."There will be homelessness, and there will be more workforce displacement to Temecula and points beyond," says Winckel. SAN DIEGO (KGTV) — A nurse who pleaded guilty in the brutal death of her boyfriend's baby has been granted parole."Angry, angry," said Deanna Stanley, the grandmother of 7-month-old Nicole Alegado.Stanley spoke to 10News after attending a state parole board hearing Thursday and learning the woman who killed her granddaughter was granted parole.Back in 2008, in order to avoid a trial, the baby's family supported a plea deal. "Emotionally we couldn't handle it," said Stanley.Eileen Villamajor, a nurse living in National City, pleaded guilty to second-degree murder in the killing her boyfriend's daughter, saying she was frustrated by her cries. She was sentenced to 15 years to life."Eileen picked her up by the hair and threw her to the ground twice. Nicole remained crying. Eileen held her head in her hands until she heard it crack, at which time Nicole stopped crying," said Stanley.Stanley sat through those unbearable details at Villamayor's parole hearing in Corona. She listened to Villamayor's petition, including her good behavior in prison and completion of classes to control her emotions. Stanley is still convinced Villamayor is dangerous."For someone to do something that something horrific with their hands ... I don't know if you can cure that in a class," said Stanley.Stanely says Villamayor showed no remorse during the hearing but revealed something new about the motive, which involved about Nicole taking up her father's time."She said she hated Nicole, resented Nicole. To me that shows premeditation. If we had gone to trial, I think she would have been convicted of first-degree murder," said Stanley.In the end, the parole board deciding to grant Villamayor parole. She could serve 13 years and 7 months of a sentence of 15 years to life. Proposition 57 passed in 2016 allows her to accrue good behavior credits which can reduce a life sentence."There is no justice here," said Stanley.The earliest Villamayor can be released is March 2020. The family has 120 days to appeal to the governor's office to overturn the decision, which they plan to do. The District Attorney's office, which backed the family at the hearing, says they will likely write a letter urging the governor to overturn the parole decision. 2250

SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington.The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program.When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim.In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann.But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees.The fate of those trees remains unknown. A city spokesperson said, “the city looks forward to working with the community and Council office on this matter.” A court hearing on the TRO is scheduled for Feb. 7. 2661
