The federal government and the court system have deemed variations of the phrase "go back to where you came from" when used by employees to be discriminatory, cases reviewed by CNN show.Since President Donald Trump tweeted that four progressive Democratic congresswomen of color "who originally came from countries whose governments are a complete and total catastrophe" should "go back to where" they "came from" last Sunday, the President has insisted his comments were not racist. The four minority lawmakers he referenced -- Reps. Ilhan Omar of Minnesota, Alexandria Ocasio-Cortez of New York, Rashida Tlaib of Michigan and Ayanna Pressley of Massachusetts -- are all American citizens. Three of the four were born in the United States.While Trump is not the employer of these four congresswomen and therefore likely not subject to laws governing their work environment, the federal government has deemed the phrase he used to be discriminatory.CNN reviewed several complaints filed with the US Equal Employment Opportunity Commission and found a few where similar language to what Trump used was considered evidence of discrimination in the workplace. The EEOC is a part of the federal government that enforces federal law to make sure employees are not discriminated against for their gender, sex, national origin or age.In 2007, the commission sued a company on behalf of a Muslim car salesperson of Indian descent who was repeatedly called "Taliban" and told that he should "just go back where [he] came from." EEOC also alleged a manager told the defendant "[t]his is America . . . not the Islamic country where you come from."The 5th US Circuit Court of Appeals sided with EEOC's claim that the salesperson was subjected to a hostile work environment based on his national origin and religion. The court cited the example of use of the phrase several times in rendering its decision. The case is cited on EEOC's website in a section where it specifically lists the comment "go back to where you came from" as an example of "potentially unlawful conduct."In another case, EEOC filed a lawsuit against a California hospital on behalf of 70 Filipino-American hospital workers. The hospital workers alleged that they were the targets of harassing comments. Some Filipino-American workers were told they would be arrested if they did not speak English and were told to go back to the Philippines.The hospital settled the case in 2012 agreeing to pay nearly million dollars in the EEOC national origin discrimination suit.New York University, one of the largest private universities in the country, agreed to pay 0,000 to settle a race and national origin harassment and retaliation lawsuit filed by the EEOC. In 2011, the commission alleged that NYU violated federal law by subjecting a Ghanaian-born employee to a hostile work environment that included "degrading verbal harassment." Settling a case is not necessarily an admission of wrongdoing.According to the EEOC's suit, the supervisor of the mailroom in NYU's Elmer Holmes Bobst Library regularly addressed the employee, a native of Ghana, with slurs like "monkey" and "gorilla" and insults such as "go back to your cage."In a 2006 case between a postal worker and a coworker, the postal worker said she faced discrimination in the workplace after a coworker said, "If you can't speak English, you don't belong here. Learn to speak better or go back to your own country." In this case, the EEOC found sufficient evidence to make a harassment claim.CNN legal analyst Laura Coates said Trump's tweets, "although obviously racist to the public," may not be unlawful in the case of the President."The EEOC guidelines are clear but they relate to employment," Coates said. The city of El Paso, Texas spent the day grieving and paying respects to the victims killed in a mass shooting Saturday. Multiple vigils were held in the city, honoring the 20 people who lost their lives after a gunman opened fire at a Walmart near the Cielo Vista Mall. Police received calls reporting a gunman in the area just after 10:30 a.m. local time.Bishop Jesus Ibarra held a special mass Sunday at La Paz Faith Memorial and Spiritual Center. “It hurts me to see the extent of violence, especially when it’s people who have nothing to do with the events that happened,” Bishop Ibarra said.The shooting hit the community hard. Twenty roses were displayed for the 20 lives lost in the attack. It’s a scene the bishop could have witnessed in person had he followed his usual routine. “That’s my Walmart,” he explained. “Every first Saturday of the month, I go stock up. I’m there from 9 to 11:30, but I didn’t go that day.” Members of the community gather at the vigils, looking for ways they can help.“Pretty tough, but all we can do now is remain together and don’t change who we are as people,” said the bishop, as he wiped away his tears.Perches Funeral Home, which is part of the La Paz Faith church, is working to help the families of the victims. “Everyone is putting their own part, so we are going to be offering the family free services for their loved ones,” said Jorge Ortiz with the funeral home.Ortiz says the El Paso community is based off love and unity, and love is needed more than ever in El Paso. “Without love, there is nothing,” said Bishop Ibarra. “We are nothing.” 1607
The body of University of Utah student Mackenzie Lueck has been found in a canyon north of Salt Lake City, police said Friday.Salt Lake City Police Chief Mike Brown said in a news conference that he was "relieved and grief-stricken" to report that Lueck's body was recovered Wednesday in Logan Canyon, about 90 miles north of Salt Lake City. The General Motors strike has caused a major disruption in the supply of auto parts to mechanics. Hannah Pelletier of Davis Auto Repair got the last brake module in her town to fix Chevy Suburban. “With the strike, we’re seeing parts take a week to two weeks,” said Pelletier.Pelletier said the typical wait is one to two days. “We normally get daily shipments and right now the shipments ha been sporadic,” said David Hunn, the service manager at Ed Bozarth Chevrolet in Aurora, Colorado. It’s not just the independent repair shops either. GM dealerships like Ed Bozarth's also in Aurora doesn’t know when their deliveries are coming. "Right now I’ve got three vehicles that are tied up waiting on parts,” Bozarth said.Hunn said one of his customers has been waiting three weeks to get their car fixed. There’s nothing he can do right now. He can’t fix it without the right pieces. In a statement, GM said dealers have a limited supply of parts, but that they're supplementing with inventory from wholesale dealers and other suppliers. The company says its ability to ship from distribution centers is limited. “Being an independent shop, our employees are very important to us. So if they felt they weren’t being taken care of we would want to do what we can because they’re what builds my business,” said Pelletier. Pelletier said she understands why the workers went on strike. But that doesn’t change the fact that she still needs parts to fix cars. “I would say if we had it for another month, that’s when we’re really going to start feeling it,” said Pelletier And dealerships like Ed Bozarth have been well stocked. “We do have a really good inventory plus we have two dealerships in town that we, we trade parts back and forth with,” said Hunn.
