SAN DIEGO (KGTV) - The target at the center of a murder for hire plot is suing his former business partner and his associates. Ninus Malan says, he suffers from severe emotional distress as a result of his business partners actions."I wish this would go away, but I wake up every morning, and it's there," Malan told 10News. In November, federal authorities charged Salam Razuki, Sylvia Gonzales and Elizabeth Juarez with offenses related to a conspiracy to kidnap and kill a business associate over a dispute involving real estate investment properties, most of which were leased to marijuana dispensaries.   According to a complaint filed on November 2018, in October of that year, Salam Razuki and Sylvia Gonzales met with a Confidential Human Source and asked the source to arrange to kill Malan. The complaint says according to Razuki and Gonzales, they had invested in multiple properties and business ventures together and were not involved in a civil dispute over their assets. The complaint alleges, "Razuki and Gonzales told CHS1 (confidential human source) that they wanted CHS1 to 'Shoot him in the face,' 'to take him to Mexico and have him whacked,' 'or kill him in some other way.'"Federal authorities say Elizabeth Juarez later joined Razuki and Gonzales, and the three talked about having Malan killed.The complaint says the confidential human source, Gonzales, and Juarez discussed a cost of ,000 for "the job." Federal authorities say during one of the meetings, Gonzales went to the Goldn Bloom Dispensary and returned with ,000 cash. "After the meeting, CHS1 provided agents with ,000 case provided by Gonzales," the complaint says.Federal authorities say, "according to the complaint, on November 15, 2018, the source met with Razuki and stated, 'I took care of it.'" Razuki replied, "So he will take care of it, or it's done?" The source replied, "Done." Malan told Team 10 investigator Adam Racusin that he's now forced to live his life day by day afraid for his family's safety. "My nine-year-old daughter had to see this on the news, and she knows all about it," Malan said. "I don't know how to explain it to her." Malan is suing Razuki, Gonzales, Juarez and a handful of businesses. The lawsuit alleges, interference with exercise of civil rights, unfair competition, intentional infliction of emotional distress and negligence. The lawsuit says the "defendants committed the acts herein despicably, maliciously, and oppressively, with the wrongful intention of injuring plaintiff, from an improper and evil motive amounting to malice, and with the conscious disregard of the rights and safety of Plaintiff and others." "Mr. Malan and Mr. Razuki were involved in a number of businesses together," said Malan's attorney John Gomez of Gomez Trial Attorneys. "That relationship kind of fell apart, so litigation commenced." Gomez says Razuki brought a civil suit against Malan and Malan filed a lawsuit against Razuki. "That's a big litigation involving a lot of money," Gomez said. "Mr. Razuki apparently thought it was ok to put a hit on Mr. Malan to eliminate him from the litigation." Gomez told 10News all the businesses and entities named in the lawsuit are affiliated with Razuki and participants in the litigation. "When he puts a hit on Mr. Malan to advance the litigation he's doing it on behalf of all of these businesses and people," Gomez said. With a criminal case underway, Malan was limited in what he was willing to discuss. He thanked the FBI, his family and told Team 10 investigator Adam Racusin he'll always be looking over his shoulder. "In the courts is where I'm seeking justice, not only for me but for my family who were terrorized by these people," Malan said. Criminal defense attorneys for Gonzales and Juarez have not yet responded to 10News requests for comment.Razuki's attorneys told 10News they have no comment. 4194

SAN DIEGO (KGTV) -- The San Diego County Office of Education says schools may hold on-campus classes beginning Tuesday under new guidance. The updated county health orders that take effect June 16 allows all schools -- with the exception of colleges and universities -- to hold on-campus classes as long as the schools comply with measures outlined by the California Department of Public Health.Those measures include face coverings required at all times, daily temperature checks recommended, increased emphasis on hand washing and sanitizing, enhanced cleaning and disinfecting in the classrooms and setting classrooms up to allow for increased physical distance between students.Each school must complete and post a document detailing the actions the school is taking to comply with the industry guidance issued by the state.The order from the San Diego County Health and Human Services Agency says: "All public, charter and private schools may hold classes or school business operations on the school campus, provided the school complies with the measures contained in the State COVID-19 Industry Guidance: Schools and School-Based Programs issued by the CDPH (including the face covering requirements contained therein), also incorporating where feasible the guidelines provided in Stronger Together: A Guidebook for the Safe Reopening of California’s Public Schools issued by the California Department of Education. Each school shall complete and post a document detailing the actions the school is taking to comply with the CDPH Industry Guidance measures after considering the CDE Guidelines noted above. SAN DIEGO (KGTV) - The San Diego City Council unanimously voted Tuesday to give final approval to place a measure on the November ballot that would change the city's police oversight structure.The current version is the Community Review Board; the ballot measure would replace it with a Committee on Police Practices."It is so desperately what the community wants and needs, so that we can build trust between the police department and the community," said Andrea St. Julian, co-chair of San Diegans for Justice, the group that wrote the ballot measure.The new committee would be appointed by the City Council, as opposed to the old board which was appointed by the mayor. The new committee would also have an independent lawyer and oversight from city staff not associated with the mayor's office or San Diego Police Department.St. Julian said these changes will help avoid conflicts of interest that the old board dealt with, especially because the CRB's lawyer was the City Attorney, who also acted as the lawyer for the police department.The new committee would also have broader power for investigations. It would be required to investigate any police shooting, as well as any time someone died while in police custody or while interacting with police.The committee could also investigate any other complaints against an officer and review all disciplinary action taken within the department."When a full investigation can be done by community members or at the direction of community members, people feel much more comfortable with the results," said St. Julian.Mayor Kevin Faulconer and County District Attorney Summer Stephan have both said they support the measure. SAN DIEGO (KGTV) — There have been 137 community outbreaks reported in San Diego County since June 1, according to San Diego County health officials.Since March 25, the county has reported 164 community outbreaks that have resulted in 1,220 coronavirus cases:March: 3April: 16May: 8June: 34July: 93August: 10County officials broke those numbers down from June 1, 2020, to Aug. 4, 2020, where the majority of community outbreaks have been reported at restaurant/bar and business settings. See the data below:The county adds that community outbreaks between June and August from business, restaurant, and restaurant/bar settings have resulted in a total of 212 cases in June, 508 cases in July, and 48 cases in August.On Wednesday, the county reported 30 community outbreaks, much high than the county's trigger of seven in a week.Even though a restaurant or restaurant/bar is linked to a community outbreak, County Public Health Officer Dr. Wilma Wooten says that doesn't mean a business is failing to adhere to public health orders.RELATED: San Diego County Board approves plan to allow businesses to operate at county parks"It may not mean there's anything going on wrong at the restaurant or at the restaurant/bar," Wooten said. SAN DIEGO (KGTV) - The San Diego City Council on Tuesday unanimously voted in favor of a proposal to purchase two city hotels and used them to help hundreds of homeless San Diegans.City leaders want to turn the Residence Inn hotels in Kearny Mesa and Mission Valley to be turned into permanent housing. The proposal was approved in a 9-0 vote.The hotels are price tagged at a combined 6.5 million. The hotels can house 400 people experiencing homelessness; residences of the properties would include people staying at the Convention Center as part of the Operation Shelter to Home, which started in April due to the coronavirus pandemic.Father Joe’s Villages will be providing services for the Kearny Mesa location, while People Assisting the Homeless (PATH) will provide services at the Mission Valley location. The services provided will include mental and behavioral health services, healthcare services, substance use services, and employment assistance.City leaders hope to get people moved in and the services running by the end of the year. 1058
