SAN DIEGO (AP) — Marine Corps prosecutors were meeting Tuesday to try and save its cases against 13 Marines accused of crimes tied to a human smuggling and drug investigation after a military judge ruled it was illegal to make the videotaped arrests made during a battalion formation while leaders called them “a cancer” and “bad Marines.”Maj. Kendra Motz said prosecutors at Marine Corps Camp Pendleton were exploring their options, but she did not know what they were considering. The judge, Marine Col. Stephen Keane, gave prosecutors until Nov. 25 to offer a way to remedy the situation. When ruling Friday, Keane agreed with defense attorneys that commanders violated the rights of the accused when they pulled the Marines out of a morning battalion formation of 800 troops at Camp Pendleton July 25 and accused them of the crimes in front of their unit, 1st Battalion, 5th Marines. The actions amounted to unlawful command influence, Keane said. That is when commanders use their positions of power to affect a case and compromise the ability for a fair trial. If the prosecution cannot remedy the situation, the court would be left with only one option: dismissing the charges, he said.Defense attorneys for some of the Marines have asked for charges to be dismissed. They say the public display would make it difficult to find an impartial jury pool and guarantee a fair trial. The Marine Corps filmed the arrests. The video was obtained by the San Diego Union-Tribune.The Marine Corps said in a statement when the newspaper obtained the video that it was made to document the arrest “in an unbiased, non-editorialized manner.”The video is for official use only and would not be released, Motz said. Prosecutors declined to be interviewed, saying they do not comment on pending cases. The military personnel are accused of various crimes from migrant smuggling to drug-related offenses, but officials have not said exactly how they were involved.U.S. Border Patrol officials say smuggling rings have been luring U.S. troops, police officers, Border Patrol agents and others to work for them as drivers — a crucial component of moving migrants further into the United States once smugglers get them over the border from Mexico.None of the Marines are accused of bringing immigrants across the border. 2309

SAN BERNARDINO, Calif. (AP) — Searchers are combing a section of the San Bernardino Mountains for signs of a missing off-duty firefighter. The San Bernardino County Sheriff's Department says the search Saturday is focusing on an area of Highway 18 where Carlos Baltazar’s car was located by the California Highway Patrol on Sept. 20. Baltazar is a member of a U.S. Forest Service Interagency Hotshot Crew. He was reported missing by family members on Sept. 24. At the time, he was off duty and not in the area of the El Dorado Fire in the San Bernardino National Forest. Another hotshot, Charles Morton, died while fighting that fire on Sept. 17. 654

SAN DIEGO — Demoralized business owners are venting their frustration and resentment over the new shutdown order meant to help stop the spread of the coronavirusMonday was day one of restaurants doing takeout only, bars, wineries and personal care shuttered, and hotels limiting travelers. This time, however, workers and employers alike feel like they're being hung out to dry."You're shutting us down, it's like, alright, here you go, good luck. That's what it feels like," said Cesar Vallin, who laid off 70 percent of the remaining staff at the Cloak & Petal restaurant in Little Italy. "The future is we're going to be here and we're going to get through this. I have to really question or ask myself if I want to stay in this business."For the second time since March, Cloak & Petal has been relegated to takeout only due to the new shutdown order. Bars, wineries and personal care salons are totally shut down, while hotels may have to turn away away non-essential out-of-state travelers. All of this - without the help of forgivable federal small business loans and a 0 dollar a week boost in unemployment, key stimulus during the first shutdown in march. The state says as of October, more than 118,000 San Diegans worked in food and drinking establishments. At the Intercontinental San Diego hotel on the waterfront, General Manager Chuck Abbott said he had to let go 10 to 20 percent of his staff - now that outdoor dining is outlawed. He expects occupancy to drop into the single digits this week as some leisure travelers cancel due to the order."Every day, every week, every time something else comes out, we have to readjust," Abbott said. "It's just hard."And they'll have to adjust to this reality for at least the next three weeks.Under the order, retail is able to remain open at 20 percent. 1827
