OCEANSIDE, Calif. (KGTV) — Oceanside Police Chief Frank McCoy wrote a letter to Oceanside residents saying he was concerned after watching a video of one of his officers tasing a man to the ground. The letter comes after the department released body camera footage, just two days after the incident. Chief McCoy has since asked the Professional Standards Unit to review the case.A man topples to the ground after being tased by an Oceanside police officer. On Tuesday afternoon, officers learned about a man armed with a knife, punching, stabbing, and attempting to carjack several people in the Mesa Margarita neighborhood. When officers arrived, they found the suspect, David Avila.In the video released on the department's twitter page, you can see two perspectives of the incident. One was from the body camera of the officer who deployed his taser. The other was a cell phone video, shot by a citizen.During a heated altercation, the video shows Avila with his hands up, kicking what looks to be a knife towards the officer in front of him. At the same time, the officer switches to his less-lethal option, the taser."Stay back. Stay back! Down on your knees!" the officer yelled.Avila then takes two steps toward the officer, stops, and is then shot by a taser.Two days after the incident, McCoy not only released the footage but said in a statement, "I have had the opportunity to review this video and it has raised concerns to me."Retired San Diego Police lethal force instructor, Ray Shay, says it could be that the officer tased the suspect who already had his hands up, from the front. Under the department's Policy and Procedures Manual, it states:"A TASER should be aimed at a suspect's upper torso and, when tactically possible, should be aimed at the suspect's back. This provides a larger target and avoids possible injury to a suspect's eyes. (Revised 07/01)"However, Shay believes this was justified."With the taser to the front, and then lethal option behind him, and the bean bag option to the left, in this challenging circumstance, the officers did the best they can do to safely take the suspect into custody," Shay said.Barry Pollard, formerly with the San Diego Citizens Advisory Board on Police Community Relations, says what bothered him was what happened as officers subdued Avila."You would think, in these days, nobody's knee would come close to the neck are," Pollard said. "It looked like a reaction is what it looked like, then he caught himself and moved his knee."However, Pollard says because the knee was not directly on the neck, he does not see this as a blatant violation.ABC 10News reached out to Oceanside Police to see exactly what parts of the video concerned the Chief. ORLANDO, Fla. (AP) — Almost two months after reopening, Universal Orlando is laying off an undisclosed number of workers. Universal spokesman Tom Schroder said in an email Monday that the Florida theme park resort was reducing its workforce "to reflect current priorities and needs." Universal has put the construction of a new theme park, Epic Universe, on pause because of the pandemic. Universal Orlando closed its doors in March as the novel coronavirus started spreading in the U.S. It was the first of Orlando's major theme park operators to reopen when it welcomed back visitors in early June. One of the largest addiction treatment companies in the country is on the hook for millions of dollars after a jury found it partly liable for the death of a California man.Shaun Reyna killed himself less than a day after checking into a treatment facility in Murrieta.“Shaun Reyna is a good man,” said attorney Jude Basile.In an interview with 10News, Basile said Reyna was losing his eyesight after 20 years working in a factory. He eventually lost his job, and depression led to drinking and self-medication.Reyna and his family decided treatment was the best option.He ended up going to a spot called A Better Tomorrow in Murrieta, which is part of the parent company American Addiction Centers. The location was more than 300 miles from his home in Atwater.Basile said less than a day after Reyna was admitted, "He was found dead due to self-inflicted cuts and bled to death."In February, a jury awarded the family a million verdict against American Addiction Centers and other defendants. The jury found them negligent.Court documents claimed “Decedent should have never of been admitted into ABTTC (A Better Tomorrow Treatment Center) DEFENDANTS program, and instead should have been referred to a facility/program that could provide the level of services he needed. ABTTC DEFENDANTS admitted Decedent Shaun Reyna knowing they could not provide the level of service he needed. They did so out of pure greed, putting profit ahead of patient safety.”According to a news release from the law firm representing the Reyna family, evidence revealed a call center that was staffed by people with little to no experience in addiction screening."When they called the call center they would be met with folks at the intake call center that were being paid on commission, that had quotas, and whose job was simply to sell, not to properly screen, but to sell,” said Reyna family attorney Jeremiah Lowe.In one of the recorded calls between Reyna and a treatment center representative you can hear the desperation in Reyna's voice.“Yeah, I have to do something," Reyna said. “Because I can't -- I feel like I can't hold on any longer.” A representative on the other end told him he understood. “I get it. We're reaching crisis mode, and if -- you need to get into a safe environment.”An addiction specialist who testified as an expert for the Reyna family told 10News the first thing the treatment center should have done was referred Reyna to a higher level of care than they were providing."The complications that can result if it’s not treated properly are seizures, strokes, hallucinations, confusion and things like what happened in this case with depression and suicide and they also required very close observation,” said Dr. Michel Sucher.The head of American Addiction Centers, Michael Cartwright, spoke to Team 10 investigator Adam Racusin by phone. Cartwright said he disagrees with the verdict. He believes Reyna's treatment location was appropriate. A spokesperson for American Addiction Centers directed 10News to a Yahoo Finance article on the technological advancements being implemented in its treatment centers. While Reyna's case is extreme, it's not the first time the company has faced criticism.10News’ sister station in Tampa, Fla., exposed questionable practices with the company's River Oaks Treatment facility. Of those deaths, 251 occurred in San Diego County.With the opioid epidemic reaching crisis level, addiction treatment centers are in high demand.However, in California, there's concern the lack of supply to meet that demand has allowed for some to take advantage of people in need.According to information provided by the California Department of Health Care Services, in the 2016-17 fiscal year, there were 540 complaints against addiction treatment centers statewide. That's up from years past.There were also 36 people who died while participating in addiction rehab facilities statewide in 2017-18.Experts tell 10News there are also more people checking in to treatment facilities."When you look at that compared to the 300 plus thousand people who were treated in those facilities you see that is drastically lower than one percent and I will stack up our industry's results with any hospital system in California,” said Stampp Corbin with the Addiction Treatment Advocacy Coalition.Corbin said there are more than 1,700 treatment facilities in California.He told 10News that because there is an opioid crisis, people need access to treatment and the vast majority of facilities are helping people and saving lives.Corbin said, just as you would check your doctor's qualifications, potential patients should ask for the information about who will be providing their treatment. He suggests asking what the treatment process is and for people to check with the California Department of Health Care Services, which tracks any adverse incident."I don't think people should be worried about treatment centers any more than they are worried about hospital systems,” Corbin said.Reyna’s attorney believes the treatment center industry is needed, but needs better enforcement."We have good regulations that if they are enforced would clean up a lot of the industry,” Lowe said. ‘The problem is right now those regulations aren't being effectively enforced." 5797

Appropriately named Cafe 101, when you step inside, you take a step back in time inside a 50s-style diner filled with memories and history. Café 101 has been an Oceanside fixture since 1928 for one reason. "Location, location, location," says John Daley sitting at the counter. Daley should know for several reasons. He's a developer, a third-generation Oceanside native, and former owner of Cafe 101 and much of its rich history."At one time, this was even our local bus stop for Greyhound out in front of us," adds Daley. When Camp Pendleton opened during World War II, Oceanside exploded from 5,000 people to more than 12,000. Cafe 101 was not only a drive-in diner, but it also served as a trailer park. "So those people had to have some place to live, they have to have some place to eat, and some place to recreate,” explains Daley. “So, it was just a crazy time in Oceanside history."For those Marines, Cafe 101 was like a second home and the employees who worked there were like family. Years later, when Daley and his partners bought the restaurant in the mid-80s he would see those Marines, much older now with children and grandchildren, return to the cafe to relive memories."Me being a big talker, I love to go out and say high to as many as I could recognize, and thank them for their service, and tell their kids what a great job they did to make our country free," says Daley with a smile. Cafe 101 is pure nostalgia. From home cooked food to the stainless-steel tables, the red booths, and the table side jukeboxes. But what sets Cafe 101 apart is its symbolic mural on the south wall of the cafe. It’s been featured in magazines and newspapers all over the world. That mural is what makes Cafe 101 such an essential part of Oceanside. "It was kind of iconic in a sense," says Daley. "Which is really a 101-highway mural too.
