San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. SAN DIEGO (KGTV) -San Diego is expecting the most powerful Santa Ana winds of the season this week. The winds are expected to pick up late Tuesday into Thursday. Cal Fire is urging residents not to let their guard down, but cautions, this is not the time to start clearing defensible space. "This week we really want people to tap the brakes on going out and clearing their property, we don't want them to start the next fire trying to do the right thing, the wrong way, at the wrong time, so please don't clear your property this week, focus on having an evacuation plan so you can get your family members, pets and livestock out when the need arises," said Captain Thomas Shoots, Public Information Officer for Cal Fire San Diego.RELATED: Check 10News Pinpoint Weather ConditionsFirefighters from San Diego, Chula Vista, Coronado, Imperial Beach, and Cal Fire are helping to fight the fires in Sonoma County and the Getty Fire in Los Angeles. Still, Shoots said there is no strain on local resources. "We know that a lot of times, this time of year, we'll have multiple major events happen at the same time, so we can send out plenty of resources and still be staffed up in San Diego so we are watching that very closely and we want to make sure that if anything takes off here we have plenty of resources to draw from," said Captain Shoots. Crews are able to monitor all the fire activity across the state from the command center at the Cal Fire Headquarters in Rancho San Diego. "Regionally, we're looking pretty good, we're fortunate that both fires that we had on Friday we were able to jump on it, put a ton of resources on it, and we were able to stop those before they became major incidents," said Captain Shoots. According to Shoots, this has been a mild fire season compared to last year. "We continue to see fires this year, but most people haven't heard about a lot of the fires that we've had because we've been able to keep them small. With Cal Fire, our goal is to keep 95% of the fires at 10 acres or less, and we've been fortunate with that this year because the conditions have been milder," said Shoots. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail.
