VISTA (CNS) - An Oceanside man convicted of abusing his neighbors' dogs, including gouging out the eye of a Siberian Husky, was sentenced to nearly 10 years in custody Friday.Jurors last summer found 37-year-old David C. The dog has never been found and is presumed dead.Police found a small amount of blood in Herbert's car and on a baseball bat he owned.Herbert, who represented himself at trial, testified that Lala jumped in his car and he was about to take her to a shelter when she jumped out and ran off. 1580

VISTA (CNS) - A man who allegedly fired a BB gun at an Oceanside business that had put up a sign supporting the Black Lives Matter movement was charged Friday with felony vandalism and a hate crime allegation.Steve Soto, 23, of Carlsbad, allegedly drove by Bliss Tea & Treats around 7:10 p.m. on June 4, then fired a BB gun out the window of his vehicle, shattering a window at the Mission Avenue business and causing more than ,800 in damage, Oceanside police Sgt. John McKean said.The business had a sign in the window at the time that read: "Black owned, we stand with you," McKean said.RELATED: Man arrested, accused of firing pellet gun at Oceanside business windowThe sergeant said surveillance video helped detectives identify the vehicle used in the crime and, ultimately, Soto, who was arrested July 15.Soto is charged with vandalism and a hate crime allegation in connection with the Bliss Tea & Treats shooting, and assault with a deadly weapon for allegedly shooting a man with a BB gun on May 28.He also faces two misdemeanor counts of discharging a BB gun in a grossly negligent manner stemming from unspecified incidents occurring in June and July, according to the criminal complaint.During his arraignment Friday morning, Soto pleaded not guilty to all charges and was served with a criminal protective order requiring him to stay away from Bliss Tea & Treats' owner, as well as the victim of the alleged May 28 shooting.Soto remains in custody in lieu of ,000 bail and is due back in court Aug. 28 for a readiness conference.A GoFundMe page created last month to raise funds to repair the damage to the shop has raised more than ,000. WASHINGTON (AP) — A federal appeals court said Thursday it plans to review a decision ordering the dismissal of the Justice Department’s case against former Trump national security adviser Michael Flynn.The action by the U.S. Circuit Court of Appeals for the District of Columbia is likely to prolong the fight over Flynn’s fate and represents yet another dramatic development in a case that has taken unexpected twists and turns over the last year and turned Flynn into something of a cause celebre for President Donald Trump and his supporters.Flynn pleaded guilty in 2017 to lying to FBI agents about his conversations with a Russian diplomat ahead of the inauguration of President Donald Trump.The court set arguments for Aug. 11. It did not offer an explanation for its decision in a brief order posted online, saying only "FURTHER ORDERED that oral argument before the en banc court be heard at 9:30 a.m. on Tuesday, August 11, 2020. The parties should be prepared to address whether there are 'no other adequate means to attain the relief' desired."A three-judge panel of the court ruled 2-1 last month that U.S. District Judge Emmet Sullivan had overstepped his bounds by not granting the Justice Department’s request to dismiss the case against Flynn.The Justice Department in May moved to dismiss the case against Flynn, one of the signature prosecutions of special counsel Robert Mueller’s investigation into Russian election interference.The motion followed a review by a U.S. attorney appointed by Attorney General William Barr to scrutinize the case.But rather than immediately dismiss the case, Sullivan appointed a retired federal judge to argue against the Justice Department’s position and to consider whether Flynn could be held in criminal contempt for perjury. WASHINGTON — As President Donald Trump continues to press his argument that the vote was rigged against him, the machinery of government and democracy is moving inexorably toward Joe Biden's presidency.As U.S. District Judge put it this week in throwing out a lawsuit challenging Biden's win in Michigan: "This ship has sailed."Trump has refused to recognize that fact and vows to press on with his challenges. On Wednesday, Trump tweeted a call to "#OVERTURN" the results of the election and has continuously tweeted baseless claims that he was the winner.But Biden is firmly on track to become president Jan. 20, after having won a decisive majority of the electoral vote.As of Tuesday, nearly every state has now certified the results of their elections, a process known as "safe harbor." With Biden's win certified, the electoral college will formally recognize Biden's win on Dec. 14.The Trump campaign and other Republicans continue to file lawsuits attempting to overturn election results on widespread fraud claims. But none of those lawsuits have proved any systematic fraud or consequential error in U.S. voting systems.Trump has also not been helped by the newly-conservative Supreme Court and the hundreds of federal judges that he's appointed. His repeated attempts to personally pressure election officials in Michigan and Georgia into delaying certification also amounted to nothing.Ultimately, Biden will be sworn in on Jan. 20 after receiving 306 electoral college votes — the amount of votes Trump won in his 2016 win over Hillary Clinton, which he has referred to as a landslide win. 1610
