SAN DIEGO (KGTV) - A grieving mother says the flu was the main cause in the death of her healthy teenage son.Cellphone video captured a smiling Brian Finete, 19, surprising his mother with flowers for her birthday last Tuesday night at their home in Clairemont."The moment was special. He was always a happy boy with a big heart. He loved life and always wanted to make people happy," said Maria Finete.Later that night, Finete played Xbox all night with his friend at his home. Just past 4 a.m., he went to the bathroom. About two hours later, the friend woke up and went looking for him. Finete was found collapsed in the bathroom."I started screaming, said to call 911. I start CPR," said Maria.Finete was rushed to a hospital, but was declared brain dead a few days later. He was taken off life support on Saturday."We have no words to describe this. We don't understand why," said Maria.Finete, who had no known underlying conditions, tested positive for influenza B. Doctors told her the flu had spiked his blood sugar levels, and the combination of the flu and the high blood sugar levels caused him to collapse and stop breathing. "I never thought in my mind my kid would die from that," said a tearful Maria.She says her son had few symptoms. He had a lingering cough from a cold from last month. The night before he collapsed, he woke up in a sweat next to his girlfriend."When he sleeps he always sweats a little bit. He did tell her, 'I'm not feeling that good,'" said Maria.She says he didn't have a fever, took ibuprofen for a headache and seemed fine that Tuesday night. He was discovered hours later."Just so hard to see my baby gone. Don't know what to do without him," said Maria.Amid the grief: the pain of 'what ifs.' Her son decided not to get a flu shot this season, despite almost always getting it in the past."Take it. Take the flu shot if you can," said Maria. SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) — A deceased whale was found by lifeguards floating off the coast of San Diego Thursday.San Diego Fire Rescue Lifeguards at Black's Beach spotted the dead whale floating about two to three miles off Sumner Canyon.Lifeguards responded to the gray whale, found to be about 30 feet in length and show obvious sounds of bloating and decomposition, according to SDFD spokesperson Monica Mu?oz.RELATED: Humpback whale feeding frenzy off San Diego's coastSDFD lifeguards are working with the National Oceanic and Atmospheric Administration to secure samples of the whale carcass and figure out what disposal options are available.It wasn't immediately clear what led to the whale's death.
