SAN DIEGO (CNS) - An ex-con accused of sexually assaulting a 24-year-old woman in broad daylight on a Mission Beach street pleaded not guilty Thursday to a charge of assault with intent to commit a sex crime. Philemon Shark, 40, who has two prior convictions from Washington state for residential burglary from 2014 and 2015, faces life in prison if convicted, said San Diego County Deputy District Attorney Trisha Amador. Judge Joseph Brannigan set Shark's bail at million and ordered the defendant to have no contact with the alleged victim. Amador said all sexual assaults -- no matter what level -- are ``serious'' and taken ``exceptionally serious'' by the District Attorney's Office. ``I think part of the concern is that when an individual is attacked in broad daylight in an area where they felt safe or did not feel a threat, of course that's added concern, but our office takes all sexual assaults equally as serious,'' the prosecutor said outside court. The attack happened about 8:40 a.m. last Sunday on Bayside Lane near San Jose Lane, just off Mission Boulevard, according to San Diego Police Lt. Jason Weeden. Weeden said the victim was walking south when Shark allegedly approached her from behind, threw her to the ground and held her down while he assaulted her. The woman screamed for help, and several residents forced the man off her, the lieutenant said. When Shark tried to leave, some of the residents followed him but lost track of him, Weeden said. Then, about 45 minutes after the attack, one of the neighbors found Shark hiding in a breezeway. Shark allegedly fled but was apprehended by patrol officers and booked into jail. Weeden said Shark is from the Seattle area and was believed to have been living in San Diego for the last few months. He will be back in court Jan. 8 for a readiness conference and Jan. 10 for a preliminary hearing. 1880

SAN DIEGO (CNS) - Military officials today publicly identified a U.S. Marine who was fatally injured in a weekend training accident at Camp Pendleton.Staff Sgt. Joshua Braica, 29, was behind the wheel of a MRZR tactical vehicle that overturned Saturday at the military station north of Oceanside, according to Maj. Nicholas Mannweiler of U.S. Marine Corps Forces, Special Operations Command. Two other Marines suffered minor injuries in the crash.Braica, a critical-skills operator with 1st Marine Raider Battalion, was airlifted to Scripps Memorial Hospital La Jolla, where he succumbed to his injuries Sunday evening.The Sacramento native enlisted in the Marine Corps in July 2010 and served as an intelligence specialist with 1st Battalion, 4th Marines, and with Marine Aircraft Group 36.Braica deployed to the Pacific Command area of operations with the 13th Marine Expeditionary Unit in 2011, and to the Indo-Pacific Command region with 1st Marine Raider Battalion in 2017.His military decorations include a Navy and Marine Corps Achievement Medal, two Good Conduct Medals, a National Defense Service Medal, a Global War on Terrorism Expeditionary Medal, a Global War on Terrorism Service Medal and three Sea Service Deployment Ribbons.He is survived by his wife and son. 1284

SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. SAN DIEGO (CNS) - California State University police chiefs Friday banned the use of the carotid restraint and pledged to implement policing recommendations offered by a 2015 federal task force on the CSU's 23 campuses, which include San Diego State and Cal State San Marcos."As police chiefs of the California State University's 23 campus police departments, we have been galvanized by the many voices across our state and nation demanding accountability, equity and justice," the chiefs said in a joint statement. "We have seen the tragic impact of racism and bigotry, and many in our departments have experienced it personally. We are unitedly determined to take action."CSU Chancellor Timothy White and every CSU campus president supports the pledge to adopt recommendations of The President's Task Force on 21st Century Policing, reported to then-President Barack Obama in May 2015, according to the chiefs."We are determined to lead by example, joining a growing number of American cities that have committed -- collectively and collaboratively -- to address police use-of-force policies," the statement continued. "To that end, and effective immediately, we are prohibiting the use of the carotid control hold by all CSU police officers. Additionally, no CSU police officer will receive or participate in trainings that teach the carotid control hold."The task force's recommendations are organized around six pillars: Building Trust and Legitimacy, Policy and Oversight, Technology and Social Media, Officer Wellness and Safety, Community Policing and Crime Reduction, and Training and Education.The chiefs also committed to looking for ways to incorporate those concepts into the training and certification provided by the California Commission on Peace Officer Standards and Training. SAN DIEGO (CNS) - A man who went on a South Bay crime spree that included shooting at a moving vehicle and ramming an occupied San Diego police vehicle during a pursuit was sentenced Thursday to 19 years in state prison.Alfonso Ayala Flores, 26, pleaded guilty earlier this year to charges of assault with a semi-automatic firearm and resisting arrest for a series of crimes last November that culminated in him driving toward officers who cornered him in a cul-de-sac and ramming a patrol car.One officer opened fire on the pickup truck Flores was driving, striking the truck, but not Flores.He was also given a separate 16-month sentence for an unrelated burglary case, but that term will be served concurrently with his 19-year prison term.The spree began with Flores carjacking a motorist's Ford F-150 pickup at the Frontier Motel in San Ysidro on Nov. 6. Deputy District Attorney Mary Naoom said that on the following day, Flores shot at an occupied vehicle.Two days later, he sped off when San Diego police spotted him driving the stolen truck in the 1900 block of Dairy Mart Road in San Ysidro. The suspect, who had a female companion in the truck with him, fled west, where he wound up at the end of a cul-de-sac in the Nestor neighborhood.As officers got out of their cars and shouted at him to halt, Flores made a U-turn and accelerated toward them, prompting one of the officers to open fire, police and prosecutors said.Naoom said Flores rammed the patrol car with the pickup as he sped away, with police again in pursuit. The subsequent chase ended in the 1200 block of Holly Avenue in Imperial Beach, where he pulled over and ran off along with the woman, according to Sainz.His companion was quickly apprehended and questioned by police before being released.
