SAN DIEGO (KGTV) - San Diego Police officers who fired shots at a man in Rolando last year were justified in their use of deadly force, the San Diego District Attorney’s office announced Monday. Body camera video recorded by San Diego Police shows the officers engaged in gunfire with Joe Darwish on June 23, 2018. Police responded to a disturbance call at the condo on Rolando Court. When they smelled smoke, they called firefighters to the scene, the DA’s office said in a news release. Firefighters forced entry into the home but were met with gunfire. Darwish shot one officer in the back with a large caliber weapon, according to the DA’s office. Two officers returned fire as they provided cover for the wounded officer, who couldn’t move for several seconds. The wounded officer eventually managed to roll onto his stomach and crawl away from the line of fire. Darwish also shot a second officer during the exchange of gunfire. RELATED: Neighbor describes Rolando gunman as volatile, dangerous The DA’s office said the shooting eventually stopped and officers found Darwish dead from a self-inflicted gunshot. Darwish had also been hit in the face and arm from one of the officers’ shotguns. “This harrowing incident shows just how quickly a routine call for service can turn deadly for police officers who suddenly found themselves in the line of fire, trying to protect their wounded fellow officers and keep the shooter from endangering members of the public,” said District Attorney Summer Stephan. “It’s a tribute to these officers’ bravery and quick response that the gunman didn’t injure more people or kill the officers and firefighters involved.” Darwish had been wearing a bulletproof vest. He was armed with two homemade guns: an assault weapon and a 9 mm semi-automatic pistol, according to the DA. Neither gun was registered. Last summer, Team 10 reporter Jennifer Kastner broke the story about how officers wanted to search Darwish’s home for weapons, days before the massive shootout. However, the Office of the San Diego County District Attorney did not attempt to get a search warrant. In the days after the shooting, 10News was tipped off by a law enforcement source that the FBI’s Joint Terrorism Task Force had wanted to search Darwish's home because they thought he had a weapon and was buying parts to make more weapons.Darwish wasn't supposed to own any weapons because of his criminal history. Our source said the FBI asked the District Attorney's Office to sign off on having a judge issue a search warrant, but the DA’s Office did not do so.For 7 weeks, 10News had been trying to confirm this with the DA’s Office. After our 10News attorneys got involved, the DA’s Office sent us a letter reading in part, “On June 13, 2018, the San Diego County District Attorney's Office received a request by law enforcement to review a draft of an affidavit in support of a search warrant to conduct a search of Mr. Darwish's person, property and residence. The District Attorney's Office determined that the warrant was legally deficient and so advised law enforcement.”June 13th was 10 days before the big shooting. 10News asked the DA’s Office why it turned down the FBI’s request to do a search warrant, but the DA’s Office stated it was "exempt from disclosure".This afternoon, we emailed the DA's Office for new comment. SAN DIEGO (KGTV) – San Diego Police are investigating a reported scam that seems to be targeting the elderly.Frank Dabalack says someone knocked on his door Monday at noon, claiming they could fix a dent on the back of his car for 5.  “I’ve wanted it fixed for a long time and here’s a guy who came over, it looked like he knew what he was doing,” Dabalack said.But once he agreed and the man and his crew began work the price kept jumping to nearly 0.“I was angry with myself,” Dabalack said, “because I knew it was scam, and I’d been scammed.”He found out with the help of his neighbor, who he asked to come over.  She took a closer look at the men’s repair work. She says they were damaging the car instead of fixing it. They covered the back of the car with some gooey residue but never touched the dent.  One of the men also took pliers to the grill and started bending it out of shape.When she started asking them questions, they took off. Dabalack says he wrote them a check for 5 but was able to cancel it with his bank.Martinez said when police arrived, they said they were familiar with the scam. The men look for handicapped plates on cars in driveways and try to trick the owners into paying large amounts of money.“Frank is from a generation where people kept their word, not scammed the elderly,” Martinez said. “Frank is like a dad to me. I don’t like anyone doing that to him or any senior.”  1445

She works at the Knotty Barrel on Market Street, relying on tips to help make the rent. “It’s a lot slower than in the summer, when we have baseball games and conventions,” said Devine. She pays 0 to split an apartment in North Park. “I feel like I’m saving all of my money for the first and then all of my money gets swiped for rent." Devine among thousands of San Diegans competing for the region’s low supply of homes.The average rent in the county is now about ,900 a month, according to Marketpointe Realty Advisors. One of the big challenges is that people keep moving to San Diego for jobs, but there aren’t enough homes being built to accommodate them. The state reports that employers have added 26,000 payroll positions in the last year, but developers have only pulled permits for about 11,500 new housing units. “You can’t have population growth and one half of the units that are needed to house these people,” said Borre Winckel, who heads the San Diego County Building Industry Association. The BIA’s new report says San Diego County homes are nearly 60 percent more expensive than the national average. “Developers and builders can’t respond to the demand because the cost to construct the new units exceeds the pocketbook of the folks who need these houses the most,” Winckel said, adding labor costs and regulations are the two biggest challenges.Meanwhile, new laws continue to be developed - one, taking effect Jan. 1, streamlines more affordable developments near transit centers. SAN DIEGO (KGTV) - San Diego churches have an idea to help solve the housing crisis. They want to build affordable housing on their unused land.UPLIFT San Diego is leading the effort, called YIGBY (Yes in God's Back Yard)."There are 1,100 churches in San Diego County with over 3,000 acres of property," says UPLIFT leader Tom Theisen. "If just 10% of those churches, 100 churches, were to build 20-30 units each, we're talking thousands of units of housing."Theisen used to serve as the Board President of the San Diego Task Force on the Homeless. He's now spearheading the YIGBY effort for UPLIFT."I can't tell you how many faith communities have called me and asked what they can do to help," he says. "I have a hard time telling them to hand out blankets and peanut butter and jelly sandwiches. They want to do something that makes a difference, and housing makes a difference."Theisen says he already has 12 churches that want to build housing.One church that is already working to make the idea a reality is Clairemont Lutheran Church. They have a plan to build as many as 21 units on land that is currently part of their parking lot."Using our parking lot for something other than empty weeds growing seems like a good idea," says Pastor Jonathan Doolittle."We want something that works in the scale of our neighborhood, so our neighbors don't notice a huge change," he says. "But, we want it to be large enough to make a difference in the lives of those who need a place to live."Doolittle shared preliminary floor plans and renderings of the apartments. He says the church has been trying to get the project going for four years, but red tape keeps holding it up.One problem is changing zoning rules on the land. The other is parking regulations with the city.The plan would take 20 spots out of the parking lot. City law requires a certain number of parking spaces per church based on pew capacity. Without those 20 spots, the church would be under the legal requirement.Doolittle says his church only reaches capacity on major holidays. The rest of the year, those spots sit empty. He also pointed out that the church is on a transit corridor, and new city laws saw affordable housing is not required to have parking along transit corridors.UPLIFT has already met with Mayor Kevin Faulconer to discuss ways to ease those requirements on churches and other faith-based organizations that want to build affordable housing units. Theisen says churches would be more sensitive to concerns within the neighborhood than a private developer."These projects are self-sufficient," he says. "We can do as many of them as we have willing churches to work with us."UPLIFT hopes that a successful start to the YIGBY project will spur similar development. He thinks unused land owned by non-profit groups, health centers and even the City of San Diego could also be used for housing. 2888
