SAN DIEGO (KGTV) -- A second lawsuit has been filed by family members of a mother and daughter killed by a YouTube star in a deadly wrong-way crash last year.18-year-old Trevor Heitmann, known as McSkillet on YouTube, drove his McLaren the wrong way on I-805 in August 2018. The crash killed Aileen Pizarro and her 12-year-old daughter Aryana. This latest lawsuit was filed August 22nd by Angelo Pizarro and Arcelio Garcia. Pizarro is one of the sons of Aileen Pizarro. Garcia is the father of Aryana. A lawsuit earlier this summer was filed by Aileen Pizarro's other son, Dominic, and her father. The lawsuit claims wrongful death and negligence by the City of San Diego and the County of San Diego. The family is also suing Heitmann’s estate. It states that San Diego police received a “mental case” call that Heitmann was “screaming, paranoid and delusional and threatening to harm his mom.”Police were advised by a licensed psychiatrist that Heitmann needed to be “possibly placed on a 5150 mental hold,” according to court records. However, officers did not speak to or evaluate Heitmann to determine if he was a danger to himself or others. The lawsuit also states that “one or more of the Police Officers represented or implied that they were part of a San Diego County Psychiatric Emergency Team.”Team 10 reached out to both county and city officials. As of Wednesday afternoon, there was no comment regarding the lawsuit from the city. A county spokesperson said they have not seen the lawsuit yet. Cynthia Chihak, the attorney for Pizarro and Garcia, sent Team 10 a statement which reads in part:"I am privileged to represent Angelo Pizarro, the son of Aileen Pizarro, and Arcelio Garcia, the father and sole heir of twelve year old Aryana Pizarro, who were killed on August 23, 2018 when their car was struck head-on by a McLaren automobile driven by Trevor Heitmann... This family is not excusing Mr. Heitmann’ s reckless behavior, but believe this tragic loss of three lives could have been prevented if the City of San Diego has taken seriously earlier reports of his violent and dangerous behavior. The loss suffered by this young man Angelo, of his mother and sister and the loss to Mr. Garcia of his daughter can never be rectified. SAN DIEGO (KGTV) — A San Diego tradition will return this holiday season, though not to the same stage we're used to seeing.The Old Globe's production of "Dr. Seuss’s How the Grinch Stole Christmas!" won't be taking the theater's stage this year, instead, coming to audiences on the radio and online. The free, audio-only production can be heard on 89.5 FM and can also be streamed on the KPBS website or mobile app, and on smart speakers on Nov. 26, Dec. 5, and Dec. 20 at 12 p.m.; and Dec. 24 at 6 p.m.Of course, fans of the show can expect their favorite songs, including "Santa for a Day," "You’re a Mean One, Mr. Grinch," and "Welcome, Christmas (Fah Who Doraze)."And though live showings at the Old Globe are canceled until further notice due to the pandemic, another piece of holiday cheer will return outside of the theater. The 15th annual Globe Christmas Tree Lighting Ceremony will take place virtually on Nov. 22 at 6 p.m. and can be viewed on the Globe's website or social media channels. SAN DIEGO (KGTV) - A vandal left a trail of flattened car tires and angry drivers across a mile-long stretch of Pacific Beach on Monday."Frustrated is the best word I can use," said Jennifer Whetstone. Whetstone discovered a flat tire on her Jeep Wranger near her home on Felspar Street just after noon. Replacing the slashed tire will cost her more 0.Police actually contacted her and her husband on the phone to let them know about the slashing, because officers were already in the area. According to Whetstone, police told her the same vandal had just slashed the tires of six vehicles in a Bank of America parking lot.It all happened in broad daylight, off busy streets. The description of the vandal was provided by a witness to police."He saw the whole thing, heard the pop and then saw a guy on a mountain bike - tall, skinny and wearing a hat - pedal off," said Whetstone.The witness saw the man bike down the street in a hurry. SAN DIEGO (KGTV) - A U.S. Marine Corps veteran is spreading the message anyone can do anything they set their mind to.Kionte Storey enlisted with the USMC in 2007. He joined after witnessing the Twin Towers attack in 2001 and wanted to discover himself and push his limits."I did join knowing I was going to go to war." Storey said his second deployment took him to Afghanistan. His team went to investigate a building, ten members went in, leaving him and one other Marine outside."I make two steps in and the IED goes off. It's kinda like a movie or what you would see in video games where everything goes gray, my ears ringing, but it felt like I was hit by a truck."He said he tried to get up but his legs weren't doing what he was asking them to. He lost his right leg in the blast. He propped himself against a wall in the hallway and said he tried to remain calm, focused on the team's safety.Back home, the Semper Fi and America's Fund took care of him, starting with getting a prosthetic leg."Learning how to walk was not the hardest part, it was the easiest part out of my entire experience." Storey said it was the mental game that was most challenging. So he took it head on."I've done more than I think I would have ever done with both my legs, than I've done with one and I've exceeded all my expectations by far." Storey has run marathons, climbed mountains like Kilamanjaro in Tanzania and Vinson Massif in Antartica."It was not only difficult because of the climb itself but but it was a mental break-through that I had that opened a lot of new possibilities of once I got to the summit [of Mt. Vinson]. I was like I can do anything, there is nothing that can stop me at this point." Storey said he hopes his story encourages others facing challenges to keep fighting.The Fund has not left his side, helping Storey buy a house, enroll at Cal State San Marcos, where he's studying Kinesiology, and connect him with Koja, his service dog."He's my best friend and I couldn't see life without him... He's made my life completely worth it." SAN DIEGO (KGTV) - After eight weeks of rehabilitation, SeaWorld San Diego rescue teams release seven rescued sea lions back into the ocean. Six of the sea lions were malnourished pups when they were first rescued. It took rescue crews about two months to help them regain their strength and nutrients needed. The seventh sea lion was discovered on La Jolla Shores with a shark bite wound to his shoulder. Rescue crews tell 10News they watched him for three days and then took him to their veterinarians because they noticed he wasn't using his left fin at all. After x-rays, SeaWorld San Diego vets discovered several broken bones in his front left fin and his left shoulder was snapped in half. Intense rehabilitation over the past eight weeks has him in good condition to return to the wild Tuesday. During the rescue return trip, General Hospital actress and dedicated animal advocate Carolyn Hennesy joined. Hennesy works closely with the SeaWorld San Diego rescue center and often joins them on return trips. As part of tradition, before animals are released, Hennesy said a few words to the sea lions, "Considering myself part of the SeaWorld family, I will say it was wonderful having you." All seven were released into the ocean about an hour from shore. SeaWorld San Diego tells 10News they've rescued over 600 animals in 2019 already including, 137 sea lions. 1379
