The Ohio State University had its application to trademark "The" tentatively denied by the U.S. Trademark Office on Wednesday. "The applied-for mark appears to be used in a merely decorative manner that would be perceived by consumers as having little or no particular source-identifying significance," the Trademark Office concluded. The Trademark Office will allow Ohio State to alter its application to have the trademark request reconsidered. The application submitted in August was to allow OSU to trademark the use of "The" on clothing using standard characters, without claim to any particular font style, size, or color. 640

The alleged victims of accused sex trafficker Jeffrey Epstein are angry they will not get the opportunity to face in court the man they say raped them as girls."We have to live with the scars of his actions for the rest of our lives, while he will never face the consequences of the crimes he committed, the pain and trauma he caused so many people," Jennifer Araoz, who accused Epstein of raping her when she was 15, said in a statement. The multimillionaire hedge fund manager's death from an apparent suicide Saturday in his cell ends the criminal case against him, but what does that mean for his accusers' quest for justice?Authorities have said they will continue to investigate Epstein's alleged actions, and US Attorney General William Barr said Monday the case "will continue on against anyone who was complicit with Epstein." At the same time, legal experts say the civil cases against Epstein, and anyone connected to the allegations in the case, will continue."It is a shame that Epstein will not face justice, and the survivors in this case will not have the satisfaction of his conviction," Scott Berkowitz, president of RAINN -- one of the largest anti-sexual violence organizations in the nation -- told CNN. "However, reporting has made clear that there were others who aided and abetted Epstein in his crimes, and we hope that the US attorney will continue to pursue those individuals. Epstein's death should not let them off the hook."Two unnamed accusers asked a federal judge to roll back a nonprosecution agreement that Epstein reached in 2008 in Florida, which provided immunity to his alleged co-conspirators, according to a court document filed Monday in 1691

The Chicago police union again is calling for a federal investigation into State's Attorney Kim Foxx to determine the extent of her involvement with the Jussie Smollett case.Kevin Graham, president of the Chicago Fraternal Order of Police, said the demand is based on news reports about text messages between Foxx and an attorney about, according to him, "diverting the case from Chicago police department to a federal investigation."Foxx, the state's attorney for Cook County, recused herself from the Smollett investigation in mid-February.Graham, who spoke to reporters after prosecutors announced they were dropping charges against Smollett, said he originally made the request to the US Department of Justice last week. He also has asked federal investigators to look into a letter sent to Smollett days before he alleged he was attacked on a Chicago street."We're doubling down on that. We want to make sure that the Justice Department takes a very hard look with that case and what went on today," he said.Text messages obtained by CNN through an open records request show Smollett family friend Tina Tchen -- a former chief of staff for first lady Michelle Obama and a lawyer -- reached out to Foxx on February 1. Tchen wrote the family had "concerns about the investigation."Foxx emailed Tchen saying in part, "Spoke to Superintendent Johnson. I convinced him to (r)each out to FBI to ask that they take over the investigation. He is reaching out now and will get back to me shortly."Later another person, identified by Foxx's office as a family friend, asked the prosecutor whether they could talk on the phone. She says Tchen gave her Foxx's number.Hours later, Foxx texts the unidentified family friend that she "spoke to the (police) superintendent earlier, he made the ask. Trying to figure out the logistics."The person responds: "Omg this would be a huge victory."The text message exchange went back and forth with Foxx and the family friend until Feb. 13 and these messages are why Foxx recused herself from the investigation, Cook County State Attorney's Office spokeswoman Tandra Simonton said earlier this month.CNN reached out to Foxx on Tuesday but didn't get a response.Efforts to get a comment from the Department of Justice on Tuesday night were also unsuccessful. 2301

The Florida Bar is investigating Republican Rep. Matt Gaetz after his threatening tweet last night about President Donald Trump's former lawyer Michael Cohen.Francine And¨ªa Walker, the group's director of communications, said the Florida Bar received a number of calls and emails regarding the tweet after it posted.According to disciplinary guidelines for the group, which is the organization of all lawyers licensed by the Supreme Court of Florida to practice law in the state, the state bar's lawyer regulation arm must determine that an allegation against a bar member "would constitute a violation of the Rules Regulating The Florida Bar" before a probe is opened. On Tuesday night, just hours ahead of Cohen's public testimony before the House Oversight Committee, Gaetz -- a Trump ally -- tweeted at Cohen, "Do your wife & father-in-law know about your girlfriends? Maybe tonight would be a good time for that chat. I wonder if she'll remain faithful when you're in prison. She's about to learn a lot..."Gaetz later deleted his tweet and issued an apology. As part of their investigation, Walker said the Florida Bar on Wednesday would send Gaetz a letter outlining the allegation against him. Gaetz will have 15 days to respond. The Daily Beast first reported the investigation Wednesday."It seems that the Florida Bar, by its rules, is required to investigate even the most frivolous of complaints," said Jillian Lane Wyant, a spokeswoman for Gaetz, when asked for a response to the investigation.A state bar investigation is not a criminal probe, and in Florida, there are further layers of investigation that the probe will go through before any potential disciplinary action is brought down by the Florida Supreme Court.Rules regulating the Florida Bar say that "a lawyer's conduct should conform to the requirements of the law, both in professional service to clients and in the lawyer's business and personal affairs. A lawyer should use the law's procedures only for legitimate purposes and not to harass or intimidate others." 2055
