Simpson at The Cosmopolitan Wednesday. Simpson was thrown out of the hotel-casino after accusations of being drunk. According to two witnesses, Simpson wasn't seen drinking and was not being unruly."He was very nice, very cordial," said Michelle Messer.Simpson's lawyer, Malcolm LaVergne, told KTNV that the story about Simpson being drunk at The Cosmopolitan is completely untrue.LaVergne says that Simpson is a social drinker, meaning he usually orders one drink and sips on it while socializing, and that he was at the Cosmopolitan to eat chicken wings.LaVergne also told KTNV that the hotel-casino had apparently decided before Simpson's visit to trespass him from the property. LaVergne says that after Simpson was notified, he left the hotel-casino quietly.In addition, Simpson is challenging anyone with proof that he was drunk and belligerent to come forward. Lawyers for CNN and the Trump administration are awaiting an initial ruling on the network's federal lawsuit over press access to the White House.And they're going to have to wait a little while longer.Judge Timothy J. Kelly heard nearly two hours of oral arguments about CNN's request for a temporary restraining order and preliminary injunction on Wednesday. Then he said court would reconvene Thursday at 3 p.m.But on Thursday afternoon, he rescheduled the next hearing for Friday at 10 a.m.If Kelly grants CNN's requests on Friday, CNN chief White House correspondent Jim Acosta would get his press pass back for a short period of time. If it's denied, Acosta's pass will remain suspended.Either way, this is just round one. By filing for a temporary restraining order, CNN is seeking what's known as "emergency relief." CNN is arguing that Acosta's First Amendment rights are being violated every day he is banned from White House grounds.CNN is also asking for "permanent relief," meaning a declaration from the judge that Trump's revocation of Acosta's press pass was unconstitutional. This legal conclusion could protect other reporters from retaliation by the administration.But the judge will not be ruling on that yet. Kelly is only expected to weigh in on the temporary status of Acosta's press pass.Further hearings are likely to take place in the next few weeks, according to CNN's lawyers.The lawsuit alleges violations of the First and Fifth Amendments.Kelly, a Trump appointee, has been on the federal bench just more than a year now. He was very inquisitive at Wednesday's hearing, asking tough questions of both sides, drilling particularly deep into some of CNN's arguments.A Justice Department lawyer, James Burnham, argued that the Trump White House has the legal right to kick out any reporter at any time for any reason.Burnham, who's been tasked with defending President Trump and several White House aides from CNN and Jim Acosta's lawsuit, was responding to a hypothetical from Kelly. Burnham said that it would be perfectly legal for the White House to revoke a journalist's press pass if it didn't agree with their reporting. "As a matter of law... yes," he said.Burnham's comment in court made the stakes of CNN v. Trump crystal clear.Attorney Theodore Boutrous, representing CNN in court, called Trump's move to revoke Acosta's hard pass "the definition of arbitrariness and capriciousness.""What are the standards?" Boutrous asked. "Rudeness is not a standard. Pete Ricketts doubled down on his opposition to medical marijuana in Nebraska on Monday after a legal challenge was mounted against a ballot measure seeking to legalize that in the state.“There is no such thing as medical marijuana,” Ricketts said during a press conference. “This is not something that would be prescribed by a doctor. It’s not going to be distributed through a pharmacy. These are dispensaries that would be in your communities.”Ricketts argued that in other states where it has been legalized, people show up to work “stoned” and are at greater risk for accidents on the job. He also argued that the cognitive development of children is impacted when they have access to marijuana."This is not a benign thing. This is a dangerous thing," Ricketts said.The comments come as the Nebraska Supreme Court is set to decide whether or not to let voters decide on medical marijuana in the state this November.Supporters of the measure had been collecting signatures for months, and Nebraska Secretary of State Bob Evnen said they had enough to qualify the measure for the ballot.But Lancaster County Sheriff Terry Wagner filed a challenge against the measure on Friday. An attorney representing Wagner said it violates state rules requiring ballot measures to focus on a single question. He argued the measure poses two separate questions: whether residents should have the right to use marijuana for medical purposes, and whether private companies should be allowed to grow and sell it.Supporters of the measure called the legal challenge “a last-minute attempt to derail the precious right of the people.” They are confident the measure will survive the legal challenge.While Ricketts is opposed to the ballot initiative, he said the court will ultimately make the final decision on whether or not it should go before voters. According to the City of La Mesa, charges against Peter Carzis, 76, include one count of felony vandalism and three counts of misdemeanor battery.An additional misdemeanor charge of committing a lewd act in public was also issued for an incident that occurred on January 18. Monday, news crews gathered outside Peter’s Men’s Apparel, a clothing store owned by Carzis, to speak with him about reports of lewd acts occurring outside the store over the weekend. As cameras rolled, Carzis was seen cursing before attacking a news photographer and slapping the phone out of a reporter’s hand. Police said Carzis caused “irreparable damage to a video camera reported to be worth approximately ,000.”According to police, Carzis "is also the suspect in two other reported crimes, a misdemeanor battery and a misdemeanor lewd act in public" that occurred on Jan. 18 in front of his store.
