SAN DIEGO (KGTV) — It’s a form of paid time off that predates sick leave.California requires businesses to give an employee up to two hours of paid time off on Election Day to vote, if the employee is unable to vote during non-working hours.“They can take advantage of this paid time off at either the beginning of their shift or at the end of their shift and they can take as much time as they need to vote. But realize that only up to two hours of that time is going to be with pay,” said attorney Dan Eaton.Eaton said Californians have had some sort of mandatory paid time off to vote since 1891, making it the oldest kind of mandatory PTO.Workers who want to take advantage of this must notify their bosses two working days in advance. For people who work Monday through Friday, Eaton said they need to inform their bosses first thing Friday morning, although there are exceptions for unforeseen circumstances.The caveat is that this right is only for employees who cannot vote during their non-working hours.It’s somewhat harder to make that argument this election cycle at a time when every registered voter in California got a mail-in ballot, and early in-person voting at polling places begins Saturday, but Eaton doesn’t expect much pushback from companies.“There could be a court dispute but the optics of that are not going to be good even if, ultimately, the employer is legally justified,” he said.Even though turnout is on pace to be record-breaking this year, the U.S. still ranks near the bottom in voter participation each year. It ranked 26 out of 32 countries in the 2016 election, according to the Pew Research Center.So why not follow some other countries and make Election Day a national holiday?The idea has been floated before but it hasn’t gotten far. Senator Bernie Sanders tried unsuccessfully in 2018.“A federal holiday does not guarantee that your employer is going to close. And they’re expensive. Federal holidays tend to cost the federal government 450 million dollars just in personnel costs just for the one day in overtime,” said Matthew Weil at the Bipartisan Policy Center.Rather than a federal holiday, Weil said state holidays on Election Day can be helpful and several states have them. Among other advantages, he said they free up schools to be used as polling places.But state holidays won’t give many voters the day off from work. 2381

SAN DIEGO (KGTV) -- Memorial Day Weekend DUI arrests are down in San Diego County compared to last year, according to California Highway Patrol. In San Diego County, 42 people were arrested between 6 p.m. Friday and 6 a.m. Sunday. By this time on Memorial Day Weekend in 2018, 57 people were arrested. One person died this weekend in San Diego County due to a DUI crash, tying it with last year. Statewide, 741 people have so far been arrested for driving under the influence. By this time last year, 674 people were arrested for DUI. So far this weekend, DUI-related crashes have claimed 18 lives throughout the state compared with 14 by this time last year. 668

SAN DIEGO (KGTV) - Marine Corps Air Station Miramar broke ground Friday on its first hangar to house the F-35, the most advanced fighter jet in the world.While the plane may be controversial, the hope is to replace aging aircraft. The new project will also include a flightline expansion."We're building new F-35 joint strike fighters and we're going to send them right here to Miramar,” President Trump said in his visit to the base Tuesday.Congressman Scott Peters and other military leaders were in attendance at the groundbreaking, thrilled about finally moving these projects forward."We're really taking care of the nation's defense," said Rep. Peters, representing the 52nd District. "One of the things when I went to the Armed Services Committee was to make sure that this facility was high on the list of priorities," he said. Harper Construction won the bid and will employ about 2000 workers.  The 160,000 square foot hangar is designed to hold up to 12 F-35s."We need to upgrade the infrastructure, the connections, the systems inside the hangers," said Col. Jason Woodworth, the Commanding Officer at MCAS Miramar.While critics have pointed to design flaws and skyrocketing costs on the new planes, the military says aging aircraft like the F/A-18 hornets are becoming tougher to maintain."Older airplanes are like that telephone on your wall you had when you were a kid with the rotary dial on it," Woodworth said. SAN DIEGO (KGTV) – James Prince, the owner of a recycling center in Point Loma, went to the Peninsula Community Planning Board Thursday night to try and save his business.Prince Recycling is being evicted from his location on the property of the Stump’s Family Market Place.Prince Recycling has become a controversial business in the past one or two years.  It is the only recycling center in the area, but many neighbors have started complaining that it is bringing homeless problems to the area.Dirk Stump, the owner of the grocery store, confirmed he is evicting the recycling center, ending their agreement for the past five years. The area is required to have a recycling center, and Dirk says the state could fine him more than ,000 a year for cutting ties with recycling, but at this point, he is willing to pay, because he says the center is attracting homeless and chasing away customers.  He said Mr. Prince is a good person and it was purely a business decision.“I recycle thousands of tons of material, and it’s not just from homeless,” Prince said.  “Not only that, they’re people too. What am I supposed to do? You’re homeless you can’t come in?” The planning board did not take any action on the issue. Prince says he’s not making any plans to vacate. SAN DIEGO (KGTV) - Law enforcement agencies across San Diego Country will have extra officers stationed near busy railroad intersections this week as part of "Operation Clear Track. "The week-long enforcement ties into National Rail Safety Week, from Sept. 22-28.In Carlsbad, officers will be near Carlsbad Village Drive and Grand Avenue during the lunch hour, reminding people to only cross when there are no trains nearby."The goal is to raise railroad safety awareness through education and the enforcement of state railroad grade crossing and trespassing laws," the Carlsbad Police Department said in a statement.Amtrak officers will also keep an eye on well-known trouble spots along the coast, like a stretch in Del Mar where surfers and hikers frequently cross over tracks to get to the beach."It's not safe to cross here," said surfer Cooper Baker, who admitted he does it regularly. "But, if people have their wits about them and make good choices about where they're stepping, it's totally safe. So I just try to make sure I know a train is not going to be here and that my footing is sure. I think it's fine."A recent study found San Diego is the 9th deadliest county for accidental train casualties in the U.S. from 2013-2017. In that time, 44 people were killed while trying to cross tracks. Los Angeles County topped the list, with 110 deaths in that time."It's definitely good to give people a reminder that trains are coming through," said surfer Shayne Jensen. "You gotta be safe."In the last year, the North County Transit District has taken steps to make trains safer. In 2018, they equipped all of their trains with Positive Train Control, a new technology that automatically slows trains down if any danger is detected.Meanwhile, there have been calls in Del Mar for more railroad crossings to be built. Residents are asking for more options, so they're not tempted to cross illegally.
