BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. BUFFALO, N.Y. - At a house in Buffalo, you'll find a resource to help neighbors in need."I think Buffalo really has the chance and ability to want to really come together and put some positivity into the air right now you know?" said Jessie Reardon.Reardon is the woman behind the Buffalo Community Fridge. She's also a registered nurse at Roswell Park Comprehensive Cancer Center.The fridge is for anyone who needs fresh produce, baby food, or even a pre-packaged meal. She got all the logistics together starting in July and put the fridge out last week.Reardon said the fridge was a donation from a friend. Since then, a few others have offered to find fridges for the effort."The ultimate goal is to for there to be refrigerators all over the city, in every neighborhood, all over. Spreading mutual aid giving food to people that need it," said Reardon.It's a resource critical to Buffalo's east side, which is considered a food desert."It's hard to get fresh fruit and the natural resources that our families need for their children, so they have the proper nutrition," said Pastor Dwayne Jones, with Mt. Aaron Missionary Baptist Church.Pastor Jones, an advocate for getting produce to food deserts, said there's only one supermarket on the east side.He's been working on a local, state, and federal level to get more supermarkets to that area."We need a supermarket down on this part of the east side," he said. "Everybody needs an apple, fresh milk, everybody needs fresh milk, fresh produce."Right now, Reardon wants other people to get encouraged to host a refrigerator themselves, and she is more than willing to help them get started."Anyone can do this, absolutely. It is anyone's project, it's just as much as your project as it is my project," she said.Any food items are accepted, except for raw meat or seafood. BRIGHTON, Colo. -- Ava Breiterman is struggling with her emotions after a traumatic event over the weekend."Her whining and not waiting is a result of what happened on Saturday," said Ava's mother Kelly Breiterman.Five-year-old Ava has level 2 autism. Kelly Breiterman says her daughter has sensory issues that cause Ava to have "meltdowns".Kelly and Ava flew Southwest to Omaha from Denver nearly two weeks ago with no problems. The flight back was a different story.Breiterman says from the time she went to check her bags in the Omaha airport, all the way to when she and her daughter got on the plane, they were told Ava must keep her mask on."I was trying to get her to put her mask back on, she wouldn’t. So the manager came back in and said, 'sorry ma'am, we’re going to have to deboard you because this is a policy and she wasn’t wearing a mask,'" Breiterman said.Breiterman says Southwest employees ignored a doctor's note explaining Ava may have difficulties leaving her mask on because of her illness.Jesse Ogas at Firefly Autism says his organization actually teaches kids with autism to wear a mask. Both he and Breiterman would like to see policy changes."I’m telling you right now some kids aren’t going to wear a mask because of the sensory issues involved in that," Ogas tells Denver7.We asked Southwest Airlines if their policy should be changed, they responded saying "As of July 27, there are no exemptions to Southwest’s face covering requirement."After being kicked off the plane, Breiterman says Southwest offered a voucher for another flight and refused to grab their bags which stayed on the plane to DIA. The next day, the Breiterman's were forced to rent a car and drive 500 miles home.
