SAN DIEGO (KGTV) -- A San Diego couple is challenging a luxury carmaker after their BMW SUV suddenly caught on fire. The Pearsons said they bought a BMWx5 in August 2018 because they thought it would be safe and reliable. In December, they replaced the battery at BMW of Escondido. The next month, Lisa Pearson was driving on Interstate 15 when she noticed a warning light showing an airbag and parking brake error. She pulled over and noticed smoke coming from the back of the car.“It happened so fast,” Lisa said. A fire had started from the rear of her vehicle. A passing tow truck driver stopped to help put out the smoke and flames. Firefighters told her it could have been a different story if her children were inside in their car seats. “It was really nerve wracking,” Lisa said. “I was really thankful since I saw that the fire was happening in the back of the car that the kids weren’t there.”They said their SUV was a total loss. It was after the fire that the Pearsons ran into even more problems. When BMW of North America inspected the vehicle, they blamed it on “an improperly secured connection of the battery cable." In the letter to the Pearsons dated February 29, 2019, Executive Customer Care Representative Michael Pigoncelli wrote, “BMW NA cannot accept responsibility for any damage, injury, or loss associated with the fire…” BMW of Escondido disagreed with corporate’s allegations, writing to the Pearsons that “the repair was done as per the BMW guidelines.” “It just seems that they’re pointing fingers at each other. Nobody cares about us or the consumer,” said Ryan Pearson. “It was still under factory warranty,” Lisa added, saying they hadn't even had it for five months. “What’s it going to take? Does someone need to die?” The Pearsons are not the only local couple to have their BMW catch fire. In October 2017, Laura Ohme said her parked BMW started a fire at the Torrey Hills homes where she lived with her family.She was in the shower when she heard a strange noise. “I just hear this really really weird popping kind of noises,ll ” Ohme said. With her two kids asleep in their rooms, she threw on a towel to find out what was going on. She went downstairs and saw smoke. “The door itself [was] literally black and glowing.”Ohme grabbed her two children and ran outside the house. “The fire, it was raging at that point,” she said.Fire investigators determined her recently purchased 2014 BMWx5 started the fire. It was a certified pre-owned vehicle she bought just a few months before. Ohme said the vehicle was sitting in the garage and turned off at the time of the fire. "I didn’t even put 5,000 miles on the car,” Ohme said. She said BMW has had a “non-response” to the situation. “BMW is not taking responsibility,” she added.While the Ohmes and Pearsons’ fires started under different circumstances, they shared things in common. Both BMWx5s were recently purchased just a few months before the fires. They both had warranties and neither vehicle was under a recall.ABC News started investigating mysterious BMW fires in 2017. Like the Ohmes, dozens involved vehicles that were parked and turned off. Since then, about 1.6 million BMWs have been recalled for fire risk. A BMW spokesperson told Team 10: "BMW notifies owners of vehicles affected by a recall via registered mail to advise them that their vehicle is part of an upcoming recall campaign and what the next steps are. BMW recently expanded its recall notification system for vehicles built after 3/2016 to allow owners to also be notified through the BMW Connected App on their smartphone. A vehicle recall may require that a part be replaced or software be updated." A spokesperson for BMW of North America told Team 10 they could not comment on the Ohme’s situation “due to litigation.” The Ohmes' attorney told me they are preparing a class-action lawsuit for the damages caused by the BMW fires.“I was able to get myself and my children out safely, but at some point someone is going to die,” she said.Regarding the Pearsons, BMW of North America wrote on March 22nd that they still believe the Pearsons’ vehicle caught fire because of “an improperly tightened battery terminal after a recent battery service.” The spokesperson added: “BMW is currently working with the dealer and the owner to resolve the matter.”In an email on March 22nd, a few days after Team 10 first contacted BMW of Escondido, the service manager wrote he “sent the Pearsons claim and contact info for [their] insurance company” and instructed their insurance to settle her claim as quickly as possible. They still disagree with BMW of North America’s findings. “We can’t let this go on and hurt other people,” said Ryan.“You are saying you are a very high quality company that sells very luxury cars, and yet your cars are catching fire. SAN DIEGO (KGTV) — A new political attack ad accuses mayoral candidate Barbara Bry of repeatedly falling asleep at public meetings. The ad is from a committee that supports State Assemblyman Todd Gloria. It says San Diego needs a mayor on alert given the coronavirus outbreak, the threat of wildfires, and the homeless crisis. It then cuts to shots of Bry appearing to doze off at two City Council Committee meetings within the last year. The committee, called Neighbors for Housing Solutions Supporting Todd Gloria for San Diego Mayor 2020, is backed by more than a dozen organizations, including the Municipal Employees Association and the Regional Chamber of Commerce. Attorney Gil Cabrera, its principal, is responsible for the ad."If it was a random falling asleep during a 10-hour council meeting, I'm not going to get into that, there's an amusement factor to it but I'm not going to get into it. It's the pattern of it," Cabrera said.Cabrera said Bry regularly dozes off at public meetings, but also said employees who see it fear retaliation for speaking out. Still, the ad raises questions about accuracy. It shows an image of Bry appearing to sleep at a committee meeting on the city's Get it Done app, while the narrator says she fell asleep during a meeting on police reform. "If this ad is talking about a meeting on police reform but showing a picture of Barbara Bry in a very different hearing, one, that plays a bit fast and loose with the truth and two, it makes problems with the ad the story rather than the Barbara Bry falling asleep on the job, which is what the backers of this ad wanted you to think about," said Thad Kousser, political scientists at UC San Diego. SAN DIEGO (KGTV) - A handful of minor city code violations have forced the Hillcrest Farmers Market to make changes to their layout, resulting in a handful of vendors losing their spot.Market officials tell 10News they didn't get any officials citations or warnings, but they heard from police and the fire marshal in the past few weeks about the problems, and have worked with the city to address all of them.One, in particular, has led to the most disruption. Fire officials told the market they needed to keep a 20-foot buffer between the booths and the median on Normal Street, to allow enough room for a fire truck to drive through. To accommodate that, the market had to remove about 30 of its 200 vendor spots. Some of the booths were put in the north parking lot of the DMV, but 13 vendors still haven't returned to the market.Also, market officials say they had gotten complaints from local churches and business about parking and people crossing the street without using crosswalks near the vendor parking lot. To change that, they've hired a parking attendant to oversee the lot. The attendant also directs non-vendors to the free parking areas at nearby schools."All these changes have made things better," says Market Manager Mark Larson. He says it's been an adjustment, but the feedback has been great from both customers and vendors."Sales are up," Larson says while pointing out that the extra walking room has made it easier for families and people with strollers to navigate the market.The market also plans to expand onto Harvey Milk Street to make room for the vendors who lost their spot. They're also looking into adding a concert stage for live music. To do that, they need to re-submit their permit to the city. SAN DIEGO (KGTV) - A new grant is helping a San Diego nonprofit expand its services during the coronavirus pandemic.Kitchens for Good recently got a ,000 grant from the San Diego Foundation and San Diego Gas & Electric.With the new money, Kitchens for Good is now cooking 7,000 meals each week, which local food banks give away to people in need.The meals are "heat and eat," said co-founder Aviva Paley. That helps people who can't cook or don't have a full kitchen get healthy meals."If you are a home-bound senior or someone who doesn't have a full kitchen or the capacity to cook for yourself, it can be really difficult to turn that bag of mixed match groceries into a healthy nutritious meal," said Paley.Before the pandemic, Kitchens for Good made 2,000 meals per week. The program provided job and skills training to people with troubled past, many of whom had been in prison or experienced homelessness.RELATED: San Diego program transforming lives in the kitchenThe grant is helping Kitchens for Good rehire some of their graduates who had lost jobs during the pandemic."Many of our apprentices have been on that other end of the food line; hungry, hopeless and homeless," said Paley. "This gives them an opportunity to really support someone. And they know how much food can mean to someone who's really struggling."The grant will allow Kitchens for Good to make an additional 100,000 by the end of 2020. SAN DIEGO (KGTV) -- A new poll shows many San Diegans would “definitely” or “probably” get a COVID-19 vaccine if it were available to them at little or no cost.An ABC 10News/San Diego Union-Tribune scientific poll recently asked 500 San Diego adults about their thoughts on a potential coronavirus vaccine, including who should get a vaccine first and their feelings towards vaccinations in general.Among the questions participants were asked: “A vaccine for the Coronavirus may soon be available to the public. If clinical trials go well, and a vaccine is available to you that is either free or costs just a few dollars, would you definitely get the vaccine? Probably get the vaccine? Probably not get the vaccine? Or definitely not get the vaccine?”The poll shows 38% of San Diegans would definitely get the vaccine; 32% would probably get the vaccine; 12% would probably not get it; 10% would definitely not get it; 8% are not sure.The release of the poll comes on the same day biotech company Moderna announced its COVID-19 vaccine candidate is 94.5% effective.The company’s chief medical officer, Dr. Tal Zaks, called the news one of the greatest moments of his life, adding, “It is absolutely amazing to me to be able to develop this vaccine and see the ability to prevent symptomatic disease with such high efficacy."Moderna reported no major side effects, and that unlike Pfizer’s vaccine announcement last week, Moderna’s vaccine does not require extreme refrigeration temperatures -- something many experts agreed would be a significant advantage for distribution.The federal government has said the coronavirus vaccine would be free, and some experts have suggested that with the FDA’s Emergency Use Authorization -- which both companies are expected to apply for in the next few weeks -- there could be enough doses manufactured to immunize 20 million people by early next year.Other poll questions that San Diegans were asked: 1948
