SAN DIEGO (CNS) - A man who ambushed a janitorial worker at a Little Italy coffee shop at knifepoint, tried to sexually assault her and stole her SUV, was sentenced today to 14 years in state prison.Christopher Merron, 28, was also ordered to register as a sex offender for life.The attack occurred around 4:30 a.m. last Oct. 14 as the victim was cleaning the coffee shop in the 1700 block of India Street. Merron pushed the woman into a back room, took her car keys and threatened her with a knife, according to police and prosecutors.Following a struggle, she was able to break free and run out of the building, said San Diego police Lt. Jason Weeden.The assailant fled in the woman's 1998 GMC Jimmy. Merron was arrested in Mission Valley the next day and the victim's SUV was recovered, Weeden said.Merron pleaded guilty in January to assault with intent to commit a sex offense, robbery and sexual battery charges and admitted a knife-use sentencing enhancement allegation. Other charges, including kidnapping with the intent to commit a sex offense, attempted oral copulation, false imprisonment with force and auto theft, were dismissed at sentencing. 1165

SAN DIEGO (CNS) - A man who was operating a panga boat carrying several undocumented immigrants when it capsized off the coast of southern San Diego County earlier this year, killing two men aboard, was sentenced today to nearly seven years in federal prison.Julio Cesar Murillo-Arce, 42, pleaded guilty earlier this year to federal charges stemming from the Feb. 3 boating accident off the coast of Imperial Beach.He was sentenced to 78 months in prison in connection with the boat fatalities, and an additional five months for violating the terms of his supervised release stemming from a separate maritime alien smuggling conviction last year, according to the U.S. Attorney's Office.According to court papers, Border Patrol agents spotted the boat in the early morning hours of Feb. 3. It began experiencing engine trouble about 150 yards off the coast, prosecutors said, then eventually became inoperable.Prosecutors say Murillo-Arce told the others aboard not to identify him as the boat's captain, then dove into the water.The boat was capsized by a large wave, sending all six occupants into the sea. Four were able to make it to shore, but Ramon Ponce-Rodriguez and Modesto Rodriguez-Ballesteros did not.Ponce-Rodriguez was pronounced dead on arrival at a hospital, while Rodriguez-Ballesteros was initially hospitalized in critical condition and died Feb. 4.The surviving occupants of the boat told investigators that the boat's captain abandoned the vessel and swam away, despite being told some of the people aboard could not swim. The boat's occupants -- or someone else on their behalf -- paid between ,000 to ,500 each to be smuggled into the United States from Mexico, according to the criminal complaint.``This is yet another tragedy that never should have happened,'' said U.S. Attorney Robert Brewer. ``This defendant and others like him care only about their bank accounts and their own safety. SAN DIEGO (CNS) - A man convicted of sex crimes against children in Northern California who was recommended for conditional release to a Pauma Valley home will no longer be considered for placement in San Diego County, prosecutors said Friday.Joshua Cooley, 40, is classified as a Sexually Violent Predator, a designation for those convicted of sexually violent offenses and diagnosed with a mental disorder that makes them likely to re-offend.According to the San Diego County District Attorney's Office, Cooley was convicted in Humboldt County of sex crimes against underage girls.The Department of State Hospitals recently recommended placing Cooley at 15077 Adams Drive after attempts to find a suitable Humboldt County location were unsuccessful, according to the DA's Office.The address is the same location where another Sexually Violent Predator, Joseph Bocklett, was recently recommended for release. San Diego County Superior Court Judge Howard Shore ultimately decided against the placement, ruling that it would bring the 76-year-old Bocklett too close to areas frequented by families.San Diego County District Attorney Summer Stephan lodged a strong objection to Cooley's proposed placement, citing Shore's ruling and the potential risks to the public."Ignoring and overlooking Judge Shore's thorough, thoughtful and well- reasoned conclusions and continuing to consider this location for placement of an SVP is reckless and irresponsible," Stephan wrote in a letter to Liberty Healthcare and the California Department of State Hospitals, which are tasked with locating suitable post-release housing for sexual predators.Stephan wrote that if the placement was considered inappropriate for Bocklett, a senior citizen, the much younger Cooley represented an even greater risk.According to the DA's Office, Liberty Healthcare has stated that the recommendation was made in error, and the Department of State Hospitals no longer feels the Pauma Valley address is a suitable location for Cooley. An Oct. 9 virtual court hearing was scheduled in Humboldt County Superior Court to discuss the proposed placement, but that hearing has since been vacated."This placement would have put children and families at risk, so we went to battle alongside our community, and we prevailed," Stephan said. "I want to acknowledge that the system worked in that the State Department of Hospitals gave serious consideration to our concerns and spared us from an extended legal battle in court. They showed that they care about our community. I also want to acknowledge the SAFE Task Force, led by the sheriff's department, for all their work giving notification and gathering input from the community. As always, the DA Sex Crimes and Human Trafficking Division demonstrated their commitment to keeping our children safe and the community stood firmly with us in stopping this placement." 2888

  

SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. As a result, HomeyTel received "a multitude of angry complaints" from people who received the calls, as well as a cease-and-desist letter from Graham, according to the FCC.The agency said 47,610 robocalls were made during the two-day period, with multiple calls sometimes sent to the same recipients.The calls violated the Truth in Caller ID Act prohibiting manipulation of caller ID information -- otherwise known as spoofing -- with the intent to defraud, cause harm or wrongfully obtain anything of value, according to the FCC. 1697

  

SAN DIEGO (CNS) - A man waiting for an Uber was stabbed in San Diego Sunday morning, according to San Diego police.At 2:08 a.m., a 37 year-old male was waiting for his Uber ride on the corner of 8th Avenue and B Street when he was approached by two female suspects and a male suspect, all in their 20s. The victim began talking to one of the women when she reached into his pocket and stole his cellphone. The suspects ran away and the victim chased them. After he caught up with them, the male suspect turned and jabbed the victim in the right arm.The victim began to bleed and witnessed the three suspects running away and getting into a red Chevy Camaro that fled westbound on B Street. The victim was taken to a hospital with non-threatening injuries.San Diego Police Central Division is investigation.
