President Donald Trump plans to announce his Supreme Court nominee on Saturday. He has said it will be a woman and she will be conservative.If the nominee goes through, it would give conservative justices a 6-3 majority over their more liberal counterparts.That sets up talk about abortion, but the Roe v. Wade debate isn't all about the Supreme Court.“Enough lower courts have not decided what they think about this,” said Carol Sanger, a professor at the Columbia law school. “We, the Supreme Court, doesn't like to lead on a particular issue until the lower courts who have trials and so on have thought about it.”Under a conservative majority, the Supreme Court has ruled on an abortion case. Conservative Chief Justice John Roberts sided with a ruling that kept abortion clinics open by not requiring abortion doctors to have nearby hospital admitting privileges.The high court already ruled on a similar case out of Texas.“There is a special doctrine called stare decisis, which means when you have a case and it’s like a previous case, look to that previous case and say how did that come out,” said Sanger. “And unless there is a very, very strong reason to change that decision, you follow precedent, you follow what happened the last time this issue came up.”Sanger says enough lower courts have to rule and be split on the decision to make it to the Supreme Court.The Supreme Court would need to decide it wants to take up Roe v. Wade before courts before them. Sanger believes that's unlikely to happen.“It seems pretty clear that he doesn't want to be known as the guy who had Roe knocked out under his chief justice-ship,” said Sanger.Both Justices Kavanaugh and Gorsuch said they accepted Roe v. Wade as the law of the land during their nomination hearings.Sanger says just because the justices on the court change, it doesn't mean they change laws all over again. 1887

(KGTV) - A North County gun store, Poway Weapons and Gear Range, is part of a group suing the state of California over a law which took effect earlier this year.The law makes it illegal to sell rifles and shotguns to anyone younger than 21. There are exceptions for military, law enforcement, and people with hunting licenses. It was already illegal for those under 21 to buy handguns.Store Director of Sales Danielle Rudolph tells 10News the lawsuit is about sticking up for their customers."The constitution protects anybody that’s an adult in the United States. An adult is 18,” she says.The state legislator who wrote the law says he was inspired to act by the shooting in Parkland, Florida, in which a man is accused of killing 17 students and staff members at a school while using an assault rifle. A similar weapon was used by the gunman in the shooting at the Chabad of Poway synagogue, which killed one person and injured three others.Supporters of the law say it's a common sense regulation to help keep guns out of the hands of those who should not have them.Rudolph says California already has the strictest gun laws in the country and that more aren't needed. She also says the law prevents her store from offering the gun safety and training programs for teens and children that are an important factor in creating a culture of responsible gun ownerships. President Donald Trump is expected to name his pick to replace the late Justice Ruth Bader Ginsburg sometime this week.Previously, the president announced his Supreme Court pick in a primetime address and similar plans are expected this time. Barrett is also by legal standards young at only 48 years of age. In recent years, both political parties have opted for younger justices to ensure they can serve for decades.In recent years, Barrett has sided with conservatives on cases involving immigration, guns rights and abortion.In a 2017, Barrett took issue with Chief Justice John Roberts’ ruling to keep the Affordable Care Act in tact in 2012.Writing for the Norte Dame Law Journal, Barrett said “Chief Justice Roberts pushed the Affordable Care Act beyond its plausible meaning to save the statute."Judge Barrett and her husband, Jesse Barrett, a former federal prosecutor, have seven children, including two adopted from Haiti.POSSIBLE PICK #2If the White House sees an issue with Judge Barrett, Trump may look at Judge Barbara Lagoa. By looking at Lagoa, the President may also find a major political advantage with winning Florida.Lagoa is a Florida Cuban-American and according to her biography, the first Latina to ever sit on the Florida Supreme Court.Politico reports that Florida Republicans are lobbying hard for Lagoa, believing Trump would certainly win Florida if she is selected. Lagoa is a Florida native.Lagoa recently sided with Florida Republicans in an 11th Circuit case upholding a Florida law that all ex-felons must pay outstanding fines before they can legally vote.Lagoa is married to Paul C. (KGTV) — San Diego Sheriff's deputies Saturday were investigating a homicide at a North County apartment complex.Sheriff's deputies responded to the Sofi apartment complex on Midland Rd. at about 1:45 a.m., deputies said.Early Saturday morning, the San Diego Sheriff's Department received a call from Pomerado Hospital in Poway of a man who was brought in with a gunshot wound. Just after 3:00 a.m, Michael Walker died at the hospital.10News spoke to a neighbor, Christine Zobel. She was woken up at around 1:45 am after hearing commotion upstairs. "There was an altercation in the apartment on top of my children's room, and there was a gunshot that went through the wall and killed a man that was sleeping," Zobel said. Minutes after the shooting, Zobel saw Walker's wife drive him to the hospital. But he did not make it. "That could've gone through the floor and into my kids' room, or anybody around us could've been affected from this reckless event," Zobel said. Saturday afternoon, Sheriff's Homicide detectives arrested Manuula Save for murder. The investigation is ongoing.
