SAN DIEGO, Calif. (KGTV) - A proposal to build a four-story, 48 unit apartment complex in Carmel Valley has riled some neighbors, to the point where hundreds of them have now signed a petition asking the San Diego City Council to abandon the project.The complex would be at 10211 Rancho Carmel Drive, just off the 15 Freeway near Ted Williams Parkway. It's less than a half-acre. Right now, a two-story parking structure sits on the plot of land.Plans from developer New Pointe Communities say they would build the complex on top of the parking garage, essentially creating a six-story building.People who live in the nearby Provencal community say it doesn't fit the neighborhood. They've started an online petition to stop it."That’s pretty tall, and that just doesn’t fit in" says Eric Von Waldner, who signed the petition."It’s going to take away our view, take away our privacy. There will be balconies looking right at us. I just don’t like the idea of it," he adds.Von Waldner says neighbors worry the added units will overwhelm the area's electrical, water and sewage grid.They also say it will cause traffic headaches at the signal light on Rancho Carmel Drive and Provencal Place."You got Starbucks over there. You got people that live in my community. If you add 48 more units, it’s going to be crazy," says Von Waldner.They plan to send the petition to District 5 City Councilmember Mark Kersey, asking for a new plan. The Council already has an agreement with New Pointe to sell the land.“A number of residents have contacted me about the proposed project on Rancho Carmel Drive, and I continue to welcome feedback from my constituents. Any redevelopment plans for the site will go through an extensive public process with numerous opportunities for input from the community,” Kersey said in a statement to 10News.According to Eric Edelmen, the chair of the Carmel Mountain Ranch Community Council, the developer still has to submit a formal proposal to the city. They also have to ask for the area to be re-zoned to allow the extra units.Right now, Edelman says the land is only zoned for eight units.He says the last time they heard from New Pointe was at a November 14th meeting. The Community Council would have to approve the proposal first. Then it would need to pass through the Planning Commission and finally the full City Council. 2361

SAN FRANCISCO (AP) — A small wildfire broke out Sunday morning near Vallejo (vuh-LAY'-ho) with flames coming dangerously close to homes and forcing a college to evacuate at the northeast end of San Francisco Bay.A live broadcast on KGO-TV shows the fire on both sides of Interstate 80 and homeowners using hoses on a hillside to try and fight it.The fire forced the freeway to close and the California State University Maritime Academy to issue an evacuation order.The wildfire halted traffic at the Carquinez Bridge toll booth as the freeway became shrouded in thick smoke.Vallejo is 55 miles (88.5 kilometers) south of Geyserville where a massive wildfire forced 180,000 people to flee their communities. 714

SAN DIEGO, Calif. (KGTV) -- A San Diego couple woke up to find guns pointed in their face inside their own home. The home invasion happened on the 3200 block of Bramson Place just before 7 a.m. on Monday. Officers say the couple was sleeping when they found the suspects inside their home. The suspects were masked and one of them also had a knife. Police say the burglars put the knife to the man's throat, cutting him several times. Neighbors were too afraid to talk on camera but told 10News said they heard all of the commotion. One witness said they saw the two men running towards a nearby parking lot and getting into a red car. Police don't have a suspect description since the suspects were wearing masks. SAN FRANCISCO (AP) — In the latest call to re-name racially charged brands and logos, nearly 1,000 people have signed an online petition urging Trader Joe's to stop labeling its international food products with ethnic-sounding names.The petition says labeling Chinese, Mexican or Italian food under the labels “Trader Ming's,” “Trader Jose,” or “Trader Giotto's” is racist because it exoticizes other cultures.Petitioners argue the names perpetuate harmful stereotypes."The Trader Joe’s branding is racist because it exoticizes other cultures - it presents 'Joe' as the default 'normal' and the other characters falling outside of it - they are 'Arabian Joe,' 'Trader José,' and 'Trader Joe San.'"In response, the grocery store chain said it decided several years ago to use only the Trader Joe’s name on its products and has been in the process of updating the ethnic-sounding labels.The company said it will soon complete the work. 941

SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407
