SAN DIEGO (KGTV) -- A 2-year-old boy who was reported missing by his stepfather in San Diego in 2002 suffered a fatal injury and died while in the sole custody and care of the stepfather, who disposed of the body, a prosecutor said Thursday, but a defense attorney said her client loved the child and didn't kill him.Tieray Jones, 39, told police that Jahi Turner disappeared from a park near the southern end of Balboa Park the afternoon of April 25, 2002.Deputy District Attorney Bill Mitchell told a jury that Jones married Jahi's mother -- Tameka Jones -- after Jahi was born and the couple moved to San Diego from Maryland in February 2002.The defendant was left to care for Jahi when Tameka Jones -- who was in the Navy -- went out to sea on April 22, 2002, the prosecutor said.Three days later, the defendant called 911 and said his step son disappeared in the park when the defendant walked to a vending machine."We will piece together what happened that week," Mitchell told thejury. "You're gonna know what happened to Jahi based on the evidence."Two days before he reported the child missing, Jones told his wife that Jahi had fallen off the bed and bumped his head, but it was "no big deal," the prosecutor said.Jones also complained that Jahi had wet the bed, according to Mitchell. Witnesses at the apartment complex where Jones lived said they saw the defendant carrying three large trash bags to a Dumpster just before the trash was to be picked up the day before the child disappeared, the prosecutor told the jury.One neighbor commented, "It didn't look like regular trash," Mitchell said. The prosecutor pointed to "glaring inconsistencies" in the defendant's statements to police about what happened.Mitchell said there was "no credible evidence" that Jahi was at the park that day. Despite a massive search, the child's body was never found.Jones was arrested in April 2016 in North Carolina and brought back to San Diego to face a murder charge.Deputy Public Defender Courtney Cutter told the jury that her client was a suspect in his stepson's disappearance almost immediately.Cutter said the defendant and Tameka Jones were used to just "getting by" and had very little when they moved to San Diego.The attorney said her client loved Jahi as if he were his own. "Tieray did not kill this child," Cutter told the jury."He was an imperfect father, yes, but not a reluctant one." SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. On that day, the initial response of our captain and crew to address all immediate safety concerns and ensure the well-being of all guests aboard, was exceptional. Hornblower has noted several inaccuracies in the NTSB report on this matter, and therefore disagrees with its determinations as to the probable cause of the allision.  Due to ongoing product defect litigation, Hornblower cannot comment further at this time. Hornblower, deeply appreciates the amazing loyalty of our customers and guests over the years, and we continue to work with care and diligence, every day, to deliver on that trust.” 2739

SAN DIEGO (KGTV) - A day after deliberations began in the wrongful death civil case over a mysterious Coronado mansion death, a jury has reached a verdict.A jury Wednesday found Adam Shacknai responsible in the death of Rebecca Zahau at the Spreckles Mansion in 2011. Zahau's family will be awarded million in punitive damages.Jurors were asked two main questions: Did Adam Shacknai touch Rebecca Zahau (before she died) with the intent to harm her? Did that touching cause her death? Jurors determined "yes" in both instances.The San Diego County Sheriff’s Department said Wednesday that they are standing by their findings that Zahau committed suicide. SAN DIEGO (CNS) - Virulent Newcastle disease was detected this weekend at a property in central San Diego County, a state veterinarian said Sunday. Friday's detection was identified when a private veterinarian submitted dead birds to the California Animal Health and Food Safety Laboratory System, according to state veterinarian Dr. Annette Jones. Response team members from the California Department of Food and Agriculture and the U.S. Department of Agriculture are working through the Labor Day weekend on control measures, including restriction of bird movement, mandatory euthanasia of infected and exposed birds, and surveillance testing near the property where infection was detected. "We are moving quickly to investigate the origin of disease as well as any movement of birds or equipment that could carry infection," Jones said in a statement. Detections of virulent Newcastle disease have decreased greatly over the last few months, she said. "Our priority remains to stop the spread of the virus and eradicate the disease," Jones said."We have made significant progress toward this goal by identifying and clearing remaining pockets of disease, but this case reminds all bird owners in Southern California to remain aware of VND signs, practice good biosecurity, stop illegal movement of birds from property to property, and report any sick birds immediately to the Sick Bird Hotline, 866-922-2473."Members of the 'home flock' community encourage keeping your birds where they are, wash your hands, change your clothes and shoes after contact with the birds to prevent the spread of the disease.The disease put California on a quarantine, keeping businesses from buying new chickens, leaving cages empty. SAN DIEGO (KGTV) — A driver struck a fire hydrant outside San Diego International Airport Saturday, causing water to rocket into the sky outside Terminal 2 and headaches inside the airport.Terminal 2's East entrance on West Harbor Drive was temporarily closed after the driver struck the hydrant along the terminal's departure lanes around 10:40 a.m. Airport officials also closed Terminal 2 East's concessions and directed all traffic through Terminal 1.At one point, vehicles backed up onto Harbor Dr. as drivers encountered the closure caused by the geyser, according to a witness. Fire crews worked feverishly for about two hours, as gallons of water and kicked up rocks showered them below, before the water was turned off around 12:35 p.m. 753
