In the summer of 2013, Aimee Stephens sent her employer a letter explaining she was about to change her life. She was a transgender woman, and she intended to start dressing as such at work.She never expected then that she was about to enter into a yearslong legal dispute, one that might soon become a litmus test for lesbian, gay and transgender rights before the next US Supreme Court.Stephens had spent months drafting the message to management at R&G and G&R Harris Funeral Homes, a family-owned business in the Detroit area, she says. She was 52 years old at the time, and she had spent her entire life fighting the knowledge she was a transgender woman, to the point that she had considered ending her life.Now that she was coming out at work, she hoped her nearly six years of positive performance reviews, which had earned her regular raises, would count in her favor.But her boss, a devout Christian, told her the situation was "not going to work out," according to court documents. Thomas Rost offered her a severance package when she was fired, but she declined to accept it.She filed a complaint with the Equal Employment Opportunity Commission, the Department of Labor's enforcement agency, and the government sued the funeral home. The department accused the funeral home of firing Stephens for being transgender and for her refusal to conform to sex-based stereotypes.A district court agreed with the funeral home that the federal workplace discrimination law known as Title VII did not protect transgender people. But it found that the funeral home did discriminate against Stephens for her refusal to conform to its "preferences, expectations, or stereotypes" for women. The EEOC appealed.The 6th Circuit Court of Appeals ruled in favor of Stephens and the EEOC in March. The funeral home's lawyers accused the court of exceeding its authority by expanding the definition of sex in a way that threatens to "shift" what it means to be a man or a woman.In July, lawyers representing the funeral home asked the Supreme Court to take up the case to determine if transgender individuals are protected under Title VII's sex-based provisions. If the court takes up the case, it could have broader implications for the definition of sex-based discrimination. And it could impact case law that precludes firing anyone -- gay, straight or cisgender -- for not adhering to sex-based stereotypes."The stakes don't get much higher than being able to keep your job," said Harper Jean Tobin, director of policy for the National Center for Transgender Equality. "Harris Funeral Homes is a stark example of the job discrimination that so many transgender people face."Advocates say it's one of the most important current civil rights issues for the transgender community, along with similar considerations in education and health care. And they say it has been settled by years of case law. In the past two decades, numerous federal courts have ruled that federal sex discrimination laws apply to transgender and gender-nonconforming people, including Title VII, the Title IX education law, and Section 1557 of the Affordable Care Act.But lawyers from the Alliance Defending Freedom, the conservative Christian nonprofit representing the funeral home, say it's far from settled."No court or federal agency has the authority to rewrite a federal statute. That power belongs solely to Congress. Replacing 'sex' with 'gender identity,' as the 6th Circuit and the EEOC have done, is a dramatic change," senior counsel Jim Campbell said in a statement."What it means to be male or female shifts from a biological reality based in anatomy and physiology to a subjective perception. It’s been four months since most of the nation’s schools abruptly shut down because of the COVID-19 pandemic. Now, schools are considering reopening, while COVID-19 cases continue to rise. So what’s changed that supposedly makes a return to campus safe?“Occasionally you have schools close because there's an outbreak of measles or flu or something like that, but not to this scale,” Dr. Elizabeth Hinde, Dean of the School of Education at Metropolitan State University of Denver, said.Districts are scrambling to figure out how to return to school this fall as COVID-19 continues to spread across the U.S.Back in March, almost every school was forced to close, a mindset much different than today's.So what has changed? We sat down with a global health affairs professor, an education expert, and an infectious disease doctor to look at the changes between now and four months ago.Within the span of a week, states told their schools to shut down.“When everything closed down in March, we were comforting a new disease, we were terrified at what it could do,” Dr. Sandy Johnson, director of the global health affairs program at the University of Denver, said.Little was known about COVID-19.“School closures are always a part of the mitigation strategy along with quarantine, stay at home orders, etcetera,” Dr. John Hammer, an infectious disease specialist at Rose Medical Center, said. “The difference between March and now is that we have a better sense of how the virus works. How it’s transmitted.”There’s more to this decision than a better understanding of the virus.“When we’re talking about whether or not schools should open, another factor is the loss in achievement and also there are equity issues that have really come to the fore” Dr. Hinde said.Kids finished the school year from home -- some didn't have the proper tools or the support of a school, opening the door for inequity.“We know that there are mental health issues,” Dr. Johnson said. “Our front line social workers that are looking for domestic violence and we know domestic violence has been going up. So there are many important roles in addition to education that come in those schools.” This also includes food and housing insecurity.Another factor in consideration -- teacher health.“These folks are balancing fear. Fear for their health, fear for the health of their families, with this real desire. They understand how important education is,” Dr. Johnson said.“There's just no definitive answers that principals and superintendents and teachers can lean on,” Dr. Hinde said.What was a state decision in the spring has now been put on the shoulders of school districts, as they weigh the pros and cons of returning to in-person learning.“Every school board, every school district, has to make a very tough decision. It is a very delicate balancing act,” Dr. Hammer said.“Local control is a strength in American schools, but it does make decision making very complex, because the superintendents of schools and principals are listening to all these different voices,” Dr. Hinde said.From teacher health and safety, to inequities in learning and the mental health of children, school leaders have a lot of elements to look at when it comes to opening classroom doors.“I think in the next couple weeks we’ll see decisions made,” Dr. Hinde said. “All of this, it’s a new world.” 3367

Certifying election results takes a while,” said Kira Lerner, the managing editor of Vote Beat, a non-partisan, non-profit covering election administration and voting.“Canvassing is the process of counting the ballots,” said Lerner. “It's what election officials are doing across the country right now. They're working tirelessly, overnight in some cases, to make sure that every single vote is counted in the certification process. Each state has a different deadline.”Certification happens after canvassing – whereby election officials verify that every single ballot was counted and there were no clerical errors. But tallying has taken longer due to record turnout and a surge in mail-in ballots.Still, six states have a deadline of within one week of the election to certify their results and have already done so. (Delaware, Virginia, Vermont, South Dakota, Oklahoma, and Louisiana).In 26 states and Washington D.C., the certification deadline is between November 10 and the 30. But that doesn't mean that we won't know without a doubt who our president elect is, which we already do,” said Lerner.And then there are the recounts. In some states, they are automatically triggered when the victory falls within a razor thin margin. In Georgia, for example that’s .5%.But in the majority of states, candidates, political parties and in some cases voters can request a recount.Currently, the Trump administration is calling for recounts in Wisconsin and Georgia.“In Wisconsin, you have two days after the winner of the race has been certified to call for a recount. In other states, like Georgia, the secretary of state has already said that he will be seeking a recount on Donald Trump's behalf.”Lerner says legal challenges and recounts will likely fail to change the outcome of the election. Electors will vote by mid-December and deliver to officials in Washington just before Christmas. INDIANAPOLIS -- Firefighters at an Indianapolis fire station opened the door early Friday morning to a one-of-a-kind request for help: A frantic woman, distressed because her pet raccoon was stoned off of too much weed.The raccoon, according to Wayne Township Fire Dept. PIO Capt. Michael Pruitt, had been exposed to "too much" of someone else’s marijuana, and its owners were worried it was overdosing. Not knowing what to do, they brought it to Station 82.“The raccoon was very lethargic,” Pruitt said. “She started explaining what had happened.
