NEW YORK (AP) — A federal judge on Sunday postponed a Trump administration order that would have banned the popular video sharing app TikTok from U.S. smartphone app stores around midnight. A more comprehensive ban remains scheduled for November, about a week after the presidential election. The judge, Carl Nichols of the U.S District Court for the District of Columbia, did not postpone that later ban. The ruling followed an emergency hearing Sunday morning in which lawyers for TikTok argued that the administration’s app-store ban would infringe on First Amendment rights and do irreparable harm to the business.Earlier this year, President Donald Trump declared that TikTok, owned by Chinese company ByteDance, was a threat to national security and that it must either sell its U.S. operations to American companies or be barred from the country.TikTok is still scrambling to firm up a deal tentatively struck a week ago in which it would partner with Oracle, a huge database-software company, and Walmart in an effort to win the blessing of both the Chinese and American governments. In the meantime, it is fighting to keep the app available in the U.S.TikTok said in a statement that it was pleased with the court ruling and continues to work to turn its deal proposal into an actual agreement. The Commerce Department, which is responsible for the specific orders banning TikTok, said it will comply with the judge’s order but intends to vigorously defend the administration’s efforts against the app. 1519

NOBLESVILLE, Ind. -- A Noblesville, Indiana woman says a trip to the spa with her daughters ended with a serious infection and a long stay at the hospital.Jennifer White said she got the pedicure nearly two weeks ago at “Nails and Lounge” in Noblesville.Over the next two days, White said she noticed her foot start swelling and turning purple and decided to go to the emergency room.She was admitted to the hospital last Tuesday with a severe infection and she’s been there for nearly a week.“I was worried I could possibly lose my toe. I could lose my foot,” said White. “I’m out of work … all for that 35 minutes of getting a pedicure.”White says the doctors tell her that the scrapings on her foot probably caused a small incision which allowed an infection to enter her foot.“I’m still here and they’re saying it’s due to the fact that I went to the nail salon… unclean, unsanitary and it’s made the infection settle in my foot,” said White.According to the Indiana Administrative Code, the use of razor devices to shave, reduce or remove calluses or corns is prohibited at spas in the state.Nails and Lounge’s manager says they did not use any prohibited devices and that they sanitize and dispose of all tools according to state law. She says they also bleach the pedicure tubs after each use, but have ordered plastic liners for each tub because of this experience.The spa manager denies that their pedicure caused the infection but says they are open to working with White to pay for her medical bills.  1525

NEW YORK CITY — The co-owner of a Staten Island bar that continues to flout local coronavirus restrictions was arrested again early Sunday morning after allegedly hitting a sheriff's deputy with his vehicle, officials said.After a night of surveillance at Mac's Public House, two uniformed deputy sheriffs approached Daniel Presti, 34, just after midnight to place him under arrest, but he ran from the officers, got into his vehicle and began to drive away, according to the sheriff's office.Presti allegedly drove into one of the uniformed deputies, officials said. The deputy was thrown onto the hood of the vehicle and Presti reportedly continued to drive down South Railroad Avenue with the injured deputy still clinging to the hood of the car.,Presti drove about 100 yards before stopping his vehicle, officials said. He was arrested and taken to a police precinct, where he is expected to be charged.The deputy sheriff who was struck by the vehicle was taken to Staten Island University Hospital for treatment, officials said.The car crash was the latest incident surrounding the controversial Staten Island bar — which has garnered national attention and was even spoofed on Saturday Night Live over the weekend.Presti was also taken into custody by deputy sheriffs on Tuesday after an investigation revealed the bar was offering indoor dining and defying several other coronavirus restrictions despite rising infection rates in the area. Staten Island has the highest COVID-19 positivity rate in New York.Bars and restaurants in state-designated "orange" microcluster zones are only allowed to offer takeout and outdoor dining, with a four-person maximum per table.Despite Presti's initial arrest and the loss of the the bar's liquor license, Mac's Public House opened its doors to indoor diners again this weekend, according to the sheriff's office.On Saturday night, deputy sheriffs reported witnessing dozens of people entering and exiting a neighboring commercial space to access the back door of the bar.According to the sheriff's office, food and alcohol were being served to unmasked and standing patrons in exchange for "monetary donations."Following Presti's arrest Saturday night, Mac's Public House said on Facebook that the restaurant would remain open."We will not back down! You have not scared us!! The world is watching and it's time for everyone to wake up!" a statement on the bar's Facebook page said.Mayor Bill de Blasio's press secretary, Bill Neidhardt, commented on Presti's second arrest on Twitter Sunday afternoon."Presti has been telling the world who he really is for days now, but last night's incident made it crystal clear. Whether it's flouting public health laws or ramming a car into a deputy, this guy clearly has no regard for the lives of others.
