LOS ANGELES (CNS) - Uber and Lyft will keep operating in San Diego and across California -- for now -- with a state appeals court Thursday putting on hold a ruling requiring the ride-hailing companies to classify their drivers as employees instead of independent contractors.The decision by the state's 1st District Court of Appeal averted threats by Uber and Lyft to shut down all California operations at midnight. Uber officials said earlier this week they would likely shut down, and Lyft issued a statement earlier Thursday saying its operations would be halting at midnight.In a blog post on Thursday morning, Lyft stated: “At 11:59PM PT today our rideshare operations in California will be suspended. This is not something we wanted to do, as we know millions of Californians depend on Lyft for daily, essential trips.”Lyft added: “This change would also necessitate an overhaul of the entire business model -- it’s not a switch that can be flipped overnight.”The dispute traces its roots to the state's passage of Assembly Bill 5, which effectively required the companies to classify their drivers as employees, a move supporters said would guarantee their wages and assure them of other benefits and workplace protections.The companies, however, said the move would require a complete overhaul of their operations and would actually hurt drivers -- forcing them to work set schedules instead of giving them the flexibility to work only when they wanted. The companies also said the move would result in many drivers losing their jobs unless they could work standard hours, and would likely also harm overall service for riders.California Attorney General Xavier Becerra, and the city attorneys of San Diego, Los Angeles and San Francisco argued in court that Uber and Lyft have misclassified their drivers as independent contractors, preventing them from receiving "the compensation and benefits they have earned through the dignity of their labor" such as the right to minimum wage, sick leave, unemployment insurance and workers' compensation benefits.On Aug. 10, San Francisco-based Judge Ethan P. Schulman ruled against the companies, but he stayed his decision for 10 days to give them time to appeal. They did so, resulting in Thursday's last-minute ruling putting Schulman's ruling on hold.The court, however, warned the companies to continue preparing for the possible switch to employee drivers, saying each company must submit a sworn statement by Sept. 4 "confirming that it has developed implementation plans." The companies must also affirm they are prepared to actually implement those plans and switch to the employee system within 30 days if they ultimately lose their appeal and a company-sponsored measure on the November ballot fails.That ballot measure, Proposition 22, would allow ride-hailing drivers to work as independent contractors.The court scheduled oral arguments in the appeal for Oct. 13.Lyft contends that four out of five drivers prefer working as independent contractors so they can have more flexibility. 3056

LOS ANGELES (AP) — The Los Angeles Police Department has opened an internal affairs investigation into a front desk officer's response in the aftermath of rapper Nipsey Hussle's murder.The department's Office of the Inspector General confirmed Monday an investigation was underway.Grand jury testimony shows the woman who drove the alleged shooter, Eric Holder, from the scene had gone to the 77th Street station because her car was on the news. She was turned away by a desk officer who told her not to worry about it.The woman was able to speak to detectives later. LOS ANGELES (CNS) - A new COVID-19 testing site will open at Dodger Stadium Tuesday, which city officials say will accommodate three times more people than any other testing site in Los Angeles County.Los Angeles Mayor Eric Garcetti, Los Angeles Fire Chief Ralph Terrazas and Dodgers CEO Stan Kasten will be on hand for the site's official opening at 10 a.m.In announcing the center on Friday, Garcetti said health officials would be testing as many as 6,000 people a day at the new location."I know that we all have fond memories of summer nights at Chavez Ravine, taking in a game and cheering on our boys in blue. Now, even with baseball season on hold, we can still go to the stadium to find help and hope," Garcetti said. LOS ANGELES (CNS) - A China Airlines flight crew spotted what appeared to be a person flying a jet pack 6,000 feet above the ground near LAX Wednesday, less than two months after two separate airline crews reported seeing a jet pack in the Cudahy and South Gate areas.China Airlines flight 006 was approaching LAX about 1:45 p.m. when the crew "reported seeing what appeared to be someone in a jet pack at an approximate altitude of 6,000 feet, about seven miles northwest of Los Angeles International Airport," the Federal Aviation Administration said.The FAA is also investigating an Aug. 30 sighting of what appeared to be a person in a jet pack about 3,000 feet above the ground in the Cudahy and South Gate areas, but investigators have not been able to verify those reports, the FAA's Ian Gregor said Wednesday.RELATED: FBI releases map of Sunday's 'guy in a jet pack' in Los AngelesAt the time of the August sightings, the pilot of American Airlines flight 1997 radioed the LAX tower to make the unusual report of somebody apparently flying at about 3,000 feet with a jet pack. More specifically, it appears the plane was in the area west of the 710, east of San Juan Avenue, north of Firestone Boulevard and south of Cudahy Park."Tower, American 1997. We just passed a guy in a jet pack," the pilot said on the August radio transmission. An air-traffic controller -- noticeably taken aback by the report -- responded, "American 1997, OK, thank you for the update. Left side or right side?""Off the left side," the pilot replied, "at maybe, uh, 300 yards or so, at our altitude."At least one other pilot, aboard a Southwest Airlines flight that August, also spotted the unusual aviator: "Tower, we just saw the guy pass by us," the pilot reported.The LAX tower alerted an inbound JetBlue pilot to beware of "a person with a jet pack reported 300 yards south of the L.A. final at about 3,000 feet."
