SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) - The nation's first kitten nursery, established in San Diego, is celebrating its tenth season running.San Diego Humane Society's kitten nursery has cared for more than 10,000 underage, orphaned, and otherwise kittens in need around-the-clock for the last decade, according to the Society.Currently, the nursery has more than 100 orphaned kittens."We are in kitten season," Jackie Noble, with the Humane Society, said. "We usually get two big peaks ... usually goes with the weather. As the weather gets warmer, more kittens are born and that's when we see the majority of our kittens come through the doors."And as Mother's Day nears, prospective owners are searching for lovable kittens to call their own."Yes everyone wants a kitten. We're getting a lot of people asking if they can adopt these babies." SAN DIEGO (KGTV) - The California Restaurant Association has a grim forecast for the restaurant industry as communities across the state begin to see more and more restaurant closures.When the coronavirus pandemic started, the CRA projected that 20 to 30 percent of restaurants could close their doors for good because of the pandemic. That projection is looking to be on the higher end now, according to Jot Condie, the CRA's president and CEO."With this second shutdown, it's likely to be closer to 30 percent," Condie said. "A lot of restaurants that we're learning are closed, are doing it quietly. There are no signs posted, no banners saying we're closed for good."He said while many variables are at play, even when restaurants can reopen completely, many restaurant owners will not be out of the woods yet."After the opening, you'll see a sort of shaking out of the industry in those first 18 months," Condie said.Condie said the restaurants most at risk are fine dining and independently owned.He also said the impact will likely vary in various parts of the state. Condie believes that San Diego County and Southern California's restaurant industry may fare better than the rest of the state because of better weather throughout the year. The weather will be a significant factor for restaurants that can offer outdoor dining and expanded outdoor dining."Where the weather cooperates almost all year, you're likely not to see the challenges of survival that you will see in, for example, San Francisco or the Bay Area," he said. 1546

SAN DIEGO (KGTV) — The family of 19-year-old Dylan Hernandez, the San Diego State University (SDSU) freshman who died after falling off a bunk bed last November, say they are concerned about the investigation conducted by Campus Police and the University. The family believes the University Police Department is not pursuing certain angles, including a possible cover-up.Last November, Dylan Hernandez died after attending a Phi Gamma Delta fraternity party. In police reports obtained by the San Diego Union-Tribune, the freshman made it back to his dorm room around midnight. On the morning of Nov. 7, 2019, he fell off the top bunk bed and hit his head. An autopsy concluded that Hernandez had fractured his skull, suffering from a brain bleed that ultimately led to his accidental death. Reports also state that his blood-alcohol level was about 0.23, nearly three times the legal limit. RELATED: San Diego State suspends 14 fraternities after student is hospitalizedIn a newly released statement to 10News, the Florida native's family said they are disturbed at how poorly Campus Police and San Diego State are handling the investigation. "The Hernandez family is concerned because witnesses they provided to SDSU and UPD still have not been questioned," George Kindley, Hernandez family lawyer, said. The same University Police reports state that UPD never interviewed anybody from the Phi Gamma Delta fraternity. They also never sought out search warrants for Snapchat videos or phone records, despite knowing that some fraternity brothers instructed others to delete possibly incriminating videos and messages. According to the report, one of those messages read, "Remember, silence is golden."This was a shocking revelation to the family. "The Hernandez family also told 10News they are questioning the SDSU's bunk bed safety enforcement. SAN DIEGO (KGTV) -- The man accused of shooting two people outside a Metallica concert in the Gaslamp, including an off-duty sheriff’s deputy was back in court Tuesday.In July Ray Pitoau had his first trial. He was found guilty of three firearm charges, including felon in possession of a gun.The jury deadlocked when charging him with three counts of assault with a deadly weapon. The District Attorney’s Office refiled for a retrial.RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffA few months later that retrial is in session and Pitoau now faces potential life in prison for allegedly shooting sheriff’s deputy Jason Philpot three times, aiming the gun at his brother, Joshua Philpot and shooting and hitting a third person walking by.During his testimony Tuesday, Pitoau tells the jury he didn’t intent on actually firing the gun. "When I see the gun it was like okay you know what I mean, just show it to these guys. It be like okay split parts, I run this way they run that way. It be cool," Pitoau said.Pitoau was asked by the defense attorney and prosecutor to recollect the night of August 7, 2017. The night he got into an altercation with the Philpot brothers and it ended in shots fired.RELATED: Suspect in Gaslamp shooting that injured off-duty deputy arrested in MexicoWhen Pitoau grabbed the gun from his friend that night he tells the jurors he didn’t think Jason Philpot in law enforcement and would know how to remove a gun from a shooter.“I had it in my right hand his left hand cam over my hand and his right hand came under my hand,” Pitoau continued. “So he grabbed the whole thing like he close don it so he started twisting my wrist." Pitoau went over the entire night and even included details of fleeing the country after he saw the shooting on the news the next morning. “I took off to Mexico, well I cut my hair, shaved my beard and then I walked to the trolley station and went to Mexico."After a month in Tijuana he was brought back to the United States and immediately handed over to U.S. Marshals.
