NASHVILLE, Tenn. — Joseph Webster was in his 20s when he was convicted for a first-degree murder he didn't commit. At 41 years old, the father of four is readjusting to his newly granted freedom.Webster was released on Tuesday after a Davidson County judge ruled to vacate his murder conviction. New DNA evidence and key witnesses with different accounts of the incident helped solidify the decision.It's the first time a person was exonerated of murder because of his innocence in Nashville, according to attorney Daniel Horwitz."It's unbelievable but believable," Webster said. "The truth will set you free. I just didn't know when."Webster was sentenced to life in prison 15 years ago for the beating death of Leroy Owens in 1998. Horwitz helped uncover new evidence alongside the Davidson County Criminal Review Unit that points to a different suspect.Webster always maintained his innocence and never wavered from his hope that one day he'd get out of prison."It's a rare entity within the district attorney's office. Wrongful convictions are fairly rare, but they do occur," Horwitz said.In early 2019, Davidson County District Attorney Glenn Funk said he would reopen the case after new testing revealed that Webster's DNA was not found on the murder weapon. The only witness in the case allegedly changed her story several times, and at times the testimony pointed to a different suspect.In late October, Webster's attorney announced that Funk had vacated his sentence after a reinvestigation by the Conviction Review board, which cleared the way for Webster's possible release."The Conviction Review Unit no longer has confidence in the conviction of Mr. Webster," the motion stated. "We recommend Mr. Webster's conviction be vacated and the charges against him dismissed."With the victim's family in the courtroom, the state said there was no other option but to free Webster.Seconds after he could walk free, Webster's mother and children swarmed him with hugs and tears. He said he's been laying low and hanging out with loved ones who helped keep his strength over the years.Webster said there are others in his position without a support system. He eventually wants to his use experience to speak to teenagers about life in prison and to stay out of trouble.In the meantime, he wants to reconnect with society and heal from years of emotional, mental and physical stress."I just want to see the other side, and I just want to be happy and enjoy life," he said.He spent part of his day Thursday trying to get a driver's license with his attorney. Webster wants to rent his own apartment, get a commercial driver's license, and start a trucking business with his children.Horwitz said there are currently no plans to pursue restitution, but he has started a GoFundMe to help raise money for Webster.Money raised above the goal will be donated to the Innocence Project. MOYOCK, N.C. – Three-year-old Vernon Smith is passionate about fire trucks and got a major surprise from dozens of first responders this weekend. Crawford Township Volunteer Fire Department in North Carolina hosted a drive-by parade for the little boy who is about to have his third open heart surgery.Vernon’s dad, Blake Smith, wanted to put a smile on his son’s face, so he asked if the local fire truck could drive by. Word got around about Vernon’s story, and dozens of firefighters, police and others wanted to be part of the surprise.Other surrounding departments learned about the event and joined in: Moyock Volunteer Fire Department, the Lower Currituck Volunteer Fire Department, the South Camden Volunteer Fire Department, Currituck County Fire-EMS, the Currituck County Sheriff’s Department, the Camden County Sheriff’s Department, Pasquotank EMS, Lantz’s Towing, and North Carolina State Highway Patrol.One of the assistant chiefs for the Crawford Township Volunteer Fire Department, Keith Storf, said the support they got from the neighboring departments was just phenomenal.Vernon’s mom, Brittany Blackwelder, said when she was 21 weeks pregnant, they learned that Vernon had a heart defect called hypoplastic left heart syndrome. It is a rare disease that causes the left side of his heart to not work properly, which causes the right side to work double-time.Blackwelder said this will be his third reconstructive surgery, and said hopefully it will stabilize him. She said he can never play competitive sports and gets tired easily, but she said otherwise he should be able to live a normal life.Storf said the little boy has gone through more than most adults. However, if you take a look at Christmas tree and decoration sales, they tell a different story.It is one of the busiest years for Christmas tree sellers and farmers, and most of these businesses were not expecting a busy year.“Sales have been up a lot,” said Christopher Gregory. “We initially thought maybe people were buying early. Now, we think there are just more people buying and they’re buying early!”Gregory has owned of Elsie and Sons Christmas Trees, located in Boston, for 47 years and never expected this holiday season to be one of his busiest. In fact, just a few weeks ago, he worried about being able to sell anything this season.“We were afraid there would be a shutdown, that we would get all the Christmas trees in and the day after they’ll shut down,” said Gregory.However, that is so far from how this season has actually panned out. Sales for Christmas trees, wreaths, and almost every holiday decoration are selling so fast he worries about running out of stock now.“We are running out of stuff and it is only the 8th of December,” Gregory added.The Boston Christmas tree seller explained local farmers have stopped cutting trees, so to get more trees, he has to place an order from a tree farm in Canada. Even with this additional order, he is anticipating still not have enough trees for all the demand and says he’ll likely end his season early.All across the country, Christmas tree sales are up almost 30 percent, according to a survey of tree retailers done by Evercore ISI. It seems people are not only buying more Christmas trees, but they are focused on buying bigger ones and spending more on additional season decorations.The uptick is notably unexpected since typically during economic downturns consumers pull back on unnecessary spending. They have not historically pulled back from Christmas tree shopping, but most economists and business owners would likely have forecasted a decline in spending on additional décor.That is, in fact, what Gregory forecasted for his business this season.“It’s a comfort to people, I think, observing the tradition, decorating the house and so on. This is what people get pleasure from now,” said Gregory.Gregory says he is just happy to be a part of something bringing people some much-needed joy this year. 2407
