SAN DIEGO (KGTV) - Inside an MCAS Miramar courtroom Thursday, the military held a preliminary hearing for a Navy corpsman who's charged in connection with the death of a fellow Navy corpsman, HM3 Michael Vincent De Leon. A corpsman is a type of medic.ABC 10News' cameras were not allowed inside, where accused corpsman HM1 Ryan Dini appeared in his military fatigues alongside his private counsel."A cover-up is what I felt [happened] from the get-go," Jose De Leon told ABC 10News just after the hearing. He has suspected a possible cover-up since his 30-year-old son died on the Twentynine Palms military base last year.At Thursday's hearing, the prosecution argued that HM1 Dini should face additional charges related to negligence. He's already charged in part with dereliction of duty resulting in death and drunk and disorderly conduct. HM1 Dini has 19 years of service with the military.The prosecution stated that HM1 Dini and a handful of others service members including Michael were at a house party on-base where alcohol was flowing, and guns were being dry-fired the night of the death.HM1 Dini's defense denied any wrongdoing."[HM1 Dini] being the most senior individual at this going-away party failed to protect not just Michael but everyone there because they were in danger when these firearms came out," said Jose De Leon. He told us in September, "We know that the firearm was dry-fired at Michael. The firearm was put away and it came out again and according to some statements they were horsing around, and the firearm came out again and that's when Michael was killed."He said that the shooting was first called in as a suicide but ABC 10News then learned from a source with close military ties that the death was being investigated as a homicide.A prosecutor named three other service members in the hearing. Their involvement remains unknown.The prosecution told ABC 10News that in about three weeks a judge will determine whether HM1 Dini's charges will be sustained and whether he'll face additional charges.Naval Criminal Investigative Service wrote to ABC 10News on Thursday that the investigation is still open. 2149
SAN DIEGO (KGTV) -- La Mesa Police Department announced it has dropped their charges against Amaurie Johnson, a black man whose controversial arrest was captured in a viral video last week.La Mesa Chief of Police Walt Vasquez said that "after a full review of all of the evidence in the criminal investigation" against Johnson, the police department will not seek prosecution "on any of the alleged misdemeanor charges."The announcement comes two days since the department released body camera footage showing the events that led up to an arrest video that surfaced last week.A week prior, a video surfaced showing an argument between Johnson, a black man, and a white police officer at the Grossmont Trolley Station. The officer is seen pushing Johnson into a sitting position onto a bench. Eventually, Johnson is handcuffed and told he is being charged with assaulting an officer.It's unknown what actually occurred in the first few moments of the encounter because the witness video began recording sometime after the confrontation began, and the first the 30 seconds of the video provide by police starts without any sound. On the day the body camera video was released, Vasquez said the beginning of the video is muted because of the way the body camera is activated."Mr. Johnson is relieved that the criminal aspect of this case seems to be over with (but) until we have something formal from the prosecuting agency, he is not at rest in believing that it is completely over with," Johnson's attorney, Troy Owens, said. "He has still expressed that he is shaken up and upset by what took place. He has expressed that this is not the first time an incident like that has happened, it's just the first time it happened to be captured on camera, so Mr. Johnson is adamant he wants to see change.""We do believe that the officer should be investigated for potential criminal liability, but there is also a civil aspect to this. Mr. Johnson and I are discussing our options as far as moving forward with a complaint with the city of la mesa and potentially taking this to state or federal court," Owens added.The incident sparked a large protest last Saturday in La Mesa. Thousands of demonstrators took over city's streets to protest Johnson's arrest and the department's investigation of the incident. The peaceful demonstration and marches ended when a large group gathered outside of the La Mesa Police Department and began attacking a bear cat vehicle that was brought in to help disperse the crowd. SAN DIEGO (KGTV) – It's exploding in the wellness industry, but is CBD safe? 10News visited a San Diego lab that tested CBD products for ingredients like pesticides and heavy metals. The results were surprising to lab personnel. Shelby Huffaker is the lead cannabis educator at Torrey Holistics in Sorrento Valley. The licensed dispensary recently conducted its own CBD study to show customers just how unreliable the open market can be. "We collected about a dozen different products from various locations around San Diego and also on the internet," she tells 10News. Torrey Holistics collected samples from places like farmers' markets, grocery stores, and the internet. The company bought CBD products such as lip balms, caramels, creams, and bath bombs, then sent to San Diego's Infinite Chemical Analysis Labs. "It's pretty busy right now with it being harvest time," says David Marelius, Ph.D. He's the co-founder of Infinite Chemical Analysis Labs, which tests cannabis and related products. "People are definitely trying to take advantage of the CBD boom right now," he adds. Both CBD and THC come from the cannabis plant, but CBD does not have the psychoactive properties that give you the feeling of being high. CBD received praised for claims of health benefits like reducing anxiety and inflammation. According to Infinite Chemical Analysis Labs, none of the CBD samples purchased on the internet by Torrey Holistics had any CBD in them. Dr. Marelius tells 10News that the majority of the overall samples didn't meet their packaging claims. He adds that the products' potencies were off, and one product had almost 70% less CBD in it than what it advertised. Three of the products reportedly failed for pesticides, although the levels were so low that they likely weren't harmful. "It's kind of the wild west out there," says Sally Greenberg with the National Consumers League. Greenberg tells 10News that CBD sellers often exaggerate the benefits of CBD without having the science to back up the claims. "[They say] that they cure cancer or treat Alzheimer's or treat AIDS," she adds. The National Consumers League is advocating for federal oversight from the Food and Drug Administration, which currently doesn't regulate most CBD. In California, the Bureau of Cannabis Control tests CBD that's sold in licensed dispensaries, like Torrey Holistics. "You're going to want to look for a Batch number or UID number. That ensures that we're able to match the testing results with that specific product," says Huffaker. The dispensary is hoping that the lab results will highlight the importance of researching your CBD before buying. "Everything carried in a licensed cannabis store is going to have to be verified [and] vetted by the dispensary [to be sure] it has gone through the necessary testing," adds Huffaker. SAN DIEGO (KGTV) - In an exclusive interview with ABC10 News, a firefighter shared his heroic story of helping battle the massive fire that erupted aboard the USS Bonhomme Richard this past July.“It was a crazy situation,” said Deputy Fire Chief Robert Sepulveda with Navy Region Southwest Fire Emergency Services. “We [had] about 400-plus firefighters on-scene at the time,” he stated and added, “I was on the front lines with the firefighters and was directing the fire attack on the forward side of the ship at that time.”His first shift lasted for 30 hours. It took almost a week to knock it all down. “What I was feeling at that time was obviously fear and wanting to make sure that everyone was safe on-scene and make sure I had that command presence to be able to unify everybody,” he told ABC10 NewsHe has now received a civilian of the year award for his heroic actions.On Monday, Navy officials announced that the warship would be decommissioned after it was gutted this summer during the explosive fire at Naval Base San Diego. The Navy reported that it’s not cost effective to bring the ship back, which could require up to billion and seven years to restore.At the time of the fire, more than 60 personnel including sailors and civilians were treated for injuries like heat exhaustion and smoke inhalation.In August, ABC10 News was the first to report that the fire was being investigated as an arson and the lead suspect is a navy sailor, according to multiple sources with close ties to NCIS.To date, the Navy will only confirm that the cause is still under investigation.Sepulveda remains grateful to the many sailors who ran to help just minutes after the flames erupted. “These ships are like homes to them and to see them in action and put everything on the line to make sure that their home was safe at the end of the day [was] incredible,” he added.The time lines for towing and dismantling the decommissioned ship are still being finalized. 1973
SAN DIEGO (KGTV) — Lime is rolling its dockless scooters and bikes out of San Diego, a month after a hearing officer ruled the company could keep its operating permit.Lime announced Thursday they would not be renewing their permit to operate in San Diego but would monitor the opportunity to return in the future.“As part of our path to profitability, Lime has made the difficult decision to exit San Diego and focus our resources on markets that allow us to meet our ambitious goals for 2020," a statement from Lime said. "We’re grateful to our team members, riders, Juicers and communities who supported us throughout this journey.
