SAN DIEGO (KGTV) - A gray whale spotted frolicking in shallow waters attracted dolphins and a crowd of swimmers and surfers in the ocean off Mission Beach Wednesday. Lifeguards got a call about the whale possible tangled in fishing line about noon, an official said. A lifeguard who swam toward the whale to investigate determined it was free.The gray whale was young, possibly a year and a half old, whale watcher and photographer Domenic Biagini told 10News. Gray whales are starting to migrate north from Mexico during the spring. There is a good chance San Diegans will see more mothers and juvenile whales closer to shore, Biagini says, because the shallow waters keep the whales safe from orcas. "It's some of the most exciting times for us as professional whale watchers to see these animals, but it's also when we see the most conflicts with these animals coming in with people," said Biagini.Sky10 was above the whale as a group of surfers and swimmers approached it near Mission Beach, coming close to the giant mammal.Biagini warns that can be extremely dangerous for humans and can also stress the animal."These gray whales, despite not being the largest of the great whales we see out here, they can still get 50 feet long and weigh up to 80,000 pounds, so you're talking very large animals. All it takes is one flick of the tail and you have a catastrophic accident. And moms are naturally protective of their young," said Biagini. The National Atmospheric and Oceanographic Administration adopted in 2011 new regulations under the Marine Mammal Protection Act and Endangered Species Act to encourage the public to ‘be whale wise.’ The NOAA guidelines include:DO NOT APPROACH or position your vessel closer than 200 yards to any killer whale in the U.S. DO NOT APPROACH or get closer than 100 yards to any other marine mammals or birds, whether on the water or on land.BE CAUTIOUS, COURTEOUS and QUIET when around areas of known or suspected marine wildlife activity, in the water or at haul-outs and bird colonies on land. Especially from May to September during breeding, nesting and seal pupping seasons.LOOK in all directions before planning your approach or departure from viewing wildlife.SLOW DOWN: reduce speed to less than 7 knots when within 400 yards of the nearest marine mammal and reduce your engine’s noise and vessel’s wake.ALWAYS approach and depart from the side, moving parallel to their direction of the animal’s travel. If the animal(s) are approaching you, cautiously move out of the way and avoid abrupt course changes. DO NOT approach from the front or from behind.IF your vessel is not in compliance with the 100 yards approach guideline (#1), place engine in neutral and allow animals to pass.PAY ATTENTION and move away, slowly and cautiously at the first sign of disturbance or agitation from any animal.STAY on the OFFSHORE side of the whales when traveling close to shore.ALWAYS avoid going through groups of porpoises or dolphins and hold course and reduce speed gradually to discourage bow or stern-riding.LIMIT your viewing time to 30 minutes or less. This will reduce the cumulative impact of all vessels and give consideration to other viewers.DO NOT disturb, swim with, move, feed or touch any marine wildlife. SAN DIEGO (KGTV and CNS) -- A suspected arsonist was arrested for allegedly starting a series of brush fires in Otay Mesa West, Sunday afternoon. MAST (Metro Arson Strike Team) investigators booked 49 year-old Ramon Guevara for arson.According to the San Diego Fire-Rescue Department, the blaze broke out just after 10:30 near 4th Avenue and Private Road. The fires were ignited in the valley at Otay Valley Regional Park.Crews say at least 10 spot fires started along the road and, as of 12:30 p.m., and had burned three acres. Sunday marked the third day in a row small brush fires popped up in the area. RELATED: Apartments near SDSU evacuated due to brush fireCrews blocked off Beyer Way as they battled the flames until 4:00 pm. Units from the Chula Vista and San Diego fire departments and two firefighting helicopters joined to battle the flames. SAN DIEGO (CNS/KGTV) - A federal judge in San Diego today ordered the Trump administration to immediately start new asylum screenings for eligible reunified families, despite objections from the government that the agreement has not been finalized.Under the proposed settlement agreement – which U.S. District Judge Dana Sabraw gave unofficial preliminary approval to last month – reunited migrant families would get a second chance at applying for asylum.Attorneys for the migrant families argued that when the families were separated at the border, most children were not interviewed to determine if they had a credible fear of returning to their native country. Their parents were granted interviews, but were so distraught after being separated that they didn't clearly advocate for themselves, attorneys said.Under the settlement, reunited migrant families still in the U.S. will be allowed to remain until all family members have completed the asylum process.When Sabraw unofficially approved the settlement, both sides agreed that the asylum determination process should get underway as soon as possible.Sabraw granted preliminary approval last week, paving the way for credible fear interviews to proceed within days of a migrant confirming his or her wishes to go forward with an asylum claim.The ruling appears to apply to about 60 people who are detained and had signed paperwork agreeing to the terms of the new process.It could end up applying to many more.Another status conference on the class-action lawsuit is scheduled next month. 1576

  

SAN DIEGO (KGTV) - A Coronado Police officer who was among the first to arrive at the Spreckels Mansion after the death of Rebecca Zahau testified Monday in the wrongful death civil case.Zahau’s death was ruled a suicide in 2011 but her family believes she was killed. They sued Adam Shacknai, the brother of Rebecca’s boyfriend.Adam Shacknai called 911 to report the body hanging from the balcony.TIMELINE: Rebecca Zahau?caseIn testimony Monday, the unidentified officer said his duty was to go through the home and make sure no one was still inside, deeming it safe for investigators to enter. Investigators would later find a single boot print on the balcony where Zahau’s nude body was found bound and hanging. The shoe print would end up being one key piece of evidence. Investigators needed to find out who it belonged to, and if someone else was with Zahau before her body was discovered.SLIDESHOW: Coronado death investigationThe Zahau family lawyer is trying to prove Adam Shacknai was with her and played a role in her death. Shacknai’s lawyers argue there is not a single piece of evidence that ties him to Zahau’s death.  His DNA was never found at the scene, and there were no eyewitness accounts to support the Zahau family’s claim, lawyers say. The officer on the witness stand was questioned about the shoe print by Keith Greer, Zahau’s family lawyer.“Do you know whether or not that footprint on the deck is yours?” Greer asked.“Personally I do not, but I’ve been told that it is,” replied the officer.He said as part of the investigation, his boots were taken in as evidence.Investigators later determined the print was accidentally left behind by the officer during his sweep of the home.The same officer who testified answered questions from Shacknai’s lawyers about a call he responded to at the home days before Zahau’s death.Zahau’s boyfriend’s son, Max Shacknai, had suffered a life-threatening fall inside of the home while in her care.“Once I entered the house I saw a small boy on the ground with some debris on him,” said the officer.He went on to say he remembers seeing Zahau very emotional and crying, but doesn’t remember directly speaking with her.A PERT counselor, a fingerprint expert and a handwriting expert are also expected to testify Monday. 2314

  

SAN DIEGO (KGTV) - A European carrier is hoping to transform the way Southern California travels between major cities.FlixBus will start offering service to 10 Southern California cities, including in San Diego, beginning May 31. The service, which has operated within Europe since 2013, is hoping to carve out a presence with discounted ticket prices and some high-tech additions.For a limited time, travelers can snag fares from Los Angeles to Las Vegas for as low as on select dates throughout June, according to the service's website. The prices are set to eventually rise.RELATED: Southwest Airlines to begin service from Southern California to HawaiiFares to and from San Diego are beginning as low as to L.A. or to Las Vegas, with departures from El Cajon, La Jolla, San Diego State University, and the San Diego Zoo.
