SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. SAN DIEGO (CNS) - A San Diego woman and former contract employee with the state's Employment Development Department was charged with a dozen federal wire fraud and identity theft counts Thursday stemming from allegations that she conspired with her prison inmate boyfriend to steal hundred of thousands of dollars in pandemic unemployment aid.Nyika Gomez, 40, was employed by an EDD contractor as a call center agent assisting people in processing their unemployment insurance claims.According to the U.S. Attorney's Office, Gomez submitted false unemployment insurance claims using personal identifying information she acquired from inmates, with the help of her boyfriend, an unidentified inmate serving a 94-year-to life sentence for murder at California State Prison, Sacramento.Gomez's boyfriend also allegedly helped her buy stolen personal identifying information from out-of-state residents to submit additional false unemployment claims.The benefits were allegedly paid out in the form of debit cards, which were mailed to Gomez's residence or the home of someone working with her. She allegedly returned some of the proceeds to inmates by transferring money to their prison accounts.Gomez was arrested Wednesday at her home and made her initial court appearance Thursday afternoon.The case comes as state investigators are looking into allegations of hundreds of millions of dollars of fraud allegedly committed by inmates at state prisons and local jails."Pandemic unemployment insurance programs are a critical part of our safety net designed to support hardworking citizens who are suffering during this unprecedented time," said U.S. Attorney Robert Brewer."Fraud related to COVID-19 is particularly disturbing as it exploits a national crisis for personal gain." 1785

SAN DIEGO (CNS) - County Supervisor Nathan Fletcher and Mayor Kevin L. Faulconer, along with other regional leaders, Monday urged the Board of Supervisors to approve as part of its budget .4 million to fund behavioral health at new permanent supportive housing projects.The group -- which also included San Diego City Councilman Chris Ward, chair of the Regional Task Force on the Homeless (RTFH), and San Diego Housing Commission (SDHC) Executive Vice President Jeff Davis -- unveiled a strategy to provide intensive behavioral health and care coordination services on-site to support up to 400 new units at upcoming hotel housing projects.The board is scheduled to meet Tuesday to have a final discussion and vote on its .4 billion fiscal year 2020-21 budget.Starting in April, the city and county of San Diego teamed up with the RTFH and the housing commission to provide shelter and services to nearly 1,200 people experiencing homelessness with Operation Shelter to Home at the San Diego Convention Center. The county's Health and Human Services Agency has provided on-site behavioral health and care coordination services at the operation, expanding on the services provided at the city's bridge shelters.Now, the organizations are working to replicate and build on the same coordinated care model outside the shelter setting.According to the group, these types of services are critical to stabilizing individuals so that they can stay in permanent housing. In a survey conducted by the SDHC of clients at Operation Shelter to Home, nearly 70% of clients required permanent supportive housing level of services or higher for success."The county can tackle the debilitating cycle of homelessness by making behavioral health and care coordination services more readily available," Fletcher said. "Redirecting .4 million toward mental health and substance misuse treatment is a better way to use the funds, reduce the reliance on a broken crisis-care model, and ensure people's needs are being met. I urge my colleagues to join me on Tuesday in supporting this approach."Faulconer and Ward have been working with housing commission on transition plans for the individuals staying at the convention center. Earlier this month, the commission's board authorized SDHC to submit applications to the state for "Project Homekey" grant funds for two or more properties.Through the Homekey initiative, California has made 0 million in grant funds available statewide to purchase and rehabilitate hotels and convert them into interim or permanent housing."By converting hotels into hundreds of permanent homes, the city and county of San Diego have an opportunity to continue to lead the state in creating new solutions to reduce homelessness," Faulconer said. "It's critical that when we have keys in hand for these units, we also have the services in place to support them, and the county's vote Tuesday can ensure that happens."If the Board of Supervisors approves the .4 million, SDHC will be able to pair the services to clients placed at the new supportive housing units."(The) .4 million in behavioral health and care coordination services will give struggling San Diegans the security and peace of mind that a new home is a permanent home," Ward said. SAN DIEGO (CNS) - Margaret Hunter, who pleaded guilty along with her husband -- former Rep. Duncan Hunter -- to illegally spending hundreds of thousands of dollars in campaign funds for personal purposes, was sentenced Monday to eight months of home confinement, slated to begin immediately, and three years probation.The former East County congressman's wife, who also acted as his campaign manager during much of the time the pair improperly spent campaign funds on personal expenditures, pleaded guilty to a conspiracy charge more than a year ago.Duncan Hunter pleaded guilty about six months later, then resigned from Congress the following month. He was sentenced in March to 11 months in federal prison, but has yet to serve any of his term as the COVID-19 pandemic led to a postponement of his self-surrender date. He's not expected to report to prison until possibly as late as January.Margaret Hunter's attorneys argued for an out-of-custody sentence involving home confinement and prosecutors agreed, citing her agreement to cooperate with investigators and the manner in which prosecutors say her husband directed blame at her when the allegations became public.Prosecutors did seek to have her home confinement delayed until January, as they stated it would be more punitive at that time, with the COVID- 19 pandemic currently keeping the majority of the general public confined to their homes.However, U.S. District Judge Thomas Whelan opted to begin her term immediately.Margaret Hunter made a brief, tearful statement to the court prior to sentencing, saying "I continue to take full responsibility. I'm deeply sorry."Assistant U.S. Attorney Emily Allen said the defendant spent most of the funds, but her role was "far less egregious" than that of her husband, who the prosecutor said was "the driving force" behind the crime."He was the elected official. He was the person in charge of the campaign and he was the decision maker who chose to allow this to go on," Allen said.Prior to his plea, Duncan Hunter repeatedly and publicly denied wrongdoing. He attributed more than ,000 in video game purchases to his son, while later suggesting his wife may have been responsible for the misspending, as she was the campaign manager and in charge of those finances.He later accused the U.S. Attorney's Office of a politically motivated prosecution, saying some of the lead prosecutors in his case attended a fundraiser for Hillary Clinton's presidential campaign. He alleged the prosecution targeted him because he was one of the earliest supporters of Donald Trump's presidential campaign."Today we're reminded that no one is above the law," Assistant U.S. Attorney Mark Conover said following the hearing.The prosecutor said the sentence handed down was appropriate because "not only did she have to withstand being thrown under the proverbial bus by her husband, but she took responsibility."Conover also credited Margaret Hunter's cooperation, saying that without it, prosecutors would have likely had to go to trial in order to secure a conviction against Duncan Hunter. Her cooperation "led Congressman Hunter to understand that he would not escape responsibility for his crime," according to Conover.The couple were indicted in 2018, charged with unlawfully spending hundreds of thousands of dollars on family vacations, restaurant and bar tabs, clothes and other frivolous expenses over the course of several years, while falsely stating to staff that the purchases were campaign-related.Prosecutors said that despite their lavish spending, the couple were in dire financial straits, overdrawing their bank account more than 1,100 times over a seven-year period.Amid the charges and public allegations, Hunter was re-elected in November 2018 with 51.7% of the vote in the 50th Congressional District, despite being indicted three months prior. SAN DIEGO (CNS) - A western harvest mouse found in Escondido tested positive for the potentially deadly hantavirus, San Diego County Vector Control officials announced Friday.The mouse was found during routine monitoring of the area. Since January, Vector Control has collected multiple mice that have tested positive for the virus in areas of north and east county, including Julian, Fallbrook, Bonsall, Boulevard, 4S Ranch, Warner Springs and Potrero.With each instance, county officials have reminded residents to avoid sweeping or vacuuming rodent droppings, which can push the virus into the air. Instead, residents are advised to use so-called "wet cleaning" methods like a diluted bleach spray, disinfectants or a sponge and a mop to clean up wild rodent matter like urine, feces and saliva.
