California regulators want to tax text messages to increase funds for programs that bring connectivity to underserved residents.A new surcharge proposed by the California Public Utilities Commission (CPUC) wouldn't be a per-text tax, but a monthly fee based a cellular bill that includes any fees for text-message services. Most carriers offer a flat fee option for texting, and already charge a similar fee for other services included in the bill — such as phone calls. The exact structure of the charge would vary from carrier to carrier.The commission will vote on the measure January 10, 2019, and is facing strong opposition from industry trade groups like the CTIA, which represents AT&T Mobility, Sprint, and T-Mobile. (AT&T is the parent company of CNN.)The 52-page proposal by CPUC Commissioner Carla J. Peterman lays out the details of the plan, and says the state's Public Purpose Program budget is going up while incoming fees to fill it are decreasing. Currently the surcharge rate is less than 7%.The proposed plan could be complicated by a new Federal Communication Commission ruling. On Wednesday, the FCC approved a new rule that classifies text messages as an "information service" like email. Proponent of the rule say it will give carriers the ability to crack down on spam messages, and critics say it could lead to carriers censoring messages.The CTIA argued in a legal filing submitted Wednesday that if texts are an information service, then the CPUC doesn't have authority over them and can't add on surcharges. It claims the proposal would go against federal law.The industry group also says the proposal would create inequity "between wireless carriers and other providers of messaging services," such as WhatsApp, iMessage and Skype."Subjecting wireless carriers' text messaging traffic to surcharges that cannot be applied to the lion's share of messaging traffic and messaging providers is illogical, anticompetitive, and harmful to consumers," the CTIA said in its filing.In light of the FCC ruling and other legal filings submitted to the CPUC, the group could change its draft proposal before the vote next month.According to the CPUC, the charges go to a number of different programs, including 911 services, subsidized phone service for low-income residents, and equipment for deaf and hard-of-hearing users. 2379

CHICAGO (AP) — While on trial for child pornography in 2008, R. Kelly still found time to talk to fans, give autographs and to meet an underage girl he later invited to his home, according to prosecutors who depicted the R&B star as manipulative and sometimes violent.Other accusers included a girl who met Kelly at her 16th birthday party and a hairdresser who expected to braid the singer's hair only to find that he wanted oral sex instead, court documents said.The accounts emerged Saturday as Kelly made his first court appearance since being accused of sexually abusing four people in a case that could produce another #MeToo reckoning for a celebrity.A judge gave Kelly a chance to go free while awaiting trial, setting bond at million. That means the 52-year-old Grammy winner must post 0,000 to be released or remain behind bars until he is tried on the allegations that date back as far as 1998 and span more than a decade.The prosecution released four detailed documents — one for each accuser — outlining the basis for the charges.The 16-year-old girl who attended Kelly's trial got his autograph after a court session. He later invited her to his home in the Chicago suburb of Olympia Fields, where they had sex multiple times, according to the documents, which said he also slapped, choked and spit on her.In 1998, another girl reported meeting Kelly at a restaurant where she was having a 16th birthday party. Kelly's manager gave her the singer's business card and suggested she call Kelly. The girl's mother heard the exchange, took the card and told the manager her daughter was 16.But her daughter later retrieved the card from her purse. She contacted Kelly, who gave her instructions and money that she assumed was for the taxi fare to his studio, where they had sex periodically for a year, the documents said.In early 2003, a Chicago hairdresser told prosecutors that she thought she was going to braid Kelly's hair, but he pulled down his pants and instead tried to force her to give him oral sex. The woman, who was 24, was able to pull away, but Kelly ejaculated on her and spit in her face, the documents said.Prosecutors also described a witness who had access to videotapes showing Kelly having sex with a 14-year-old girl. The witness turned a tape over to authorities and identified the girl, who repeatedly stated her age on the footage, according to the documents.Kelly's DNA was found in semen on one of the accuser's shirts, and semen found on a shirt worn by another was submitted for DNA testing, Cook County State's Attorney Kim Foxx said. It was not clear when the accusers turned the shirts over to authorities, whether it was shortly after the abuse or more recently.At the bond hearing, Kelly's attorney, Steve Greenberg, said his client is not a flight risk. He told the judge, "Contrary to the song, Mr. Kelly doesn't like to fly." One of Kelly's best-known hits is "I Believe I Can Fly."Greenberg said Kelly "really doesn't have any more money," suggesting that others had mismanaged his wealth. Still, he said he expected that Kelly would be able to come up with enough money for bail.The judge called the allegations "disturbing." The singer-songwriter looked down at the floor as the judge spoke.After the hearing, Greenberg told reporters that Kelly did not force anyone to have sex."He's a rock star. He was charged with 10 counts of aggravated sexual abuse.Kelly, who was acquitted of child pornography charges in 2008, has consistently denied any sexual misconduct. He broke into the R&B scene in 1993 with his first solo album, "12 Play," which produced such popular sex-themed songs as "Bump N' Grind" and "Your Body's Callin'."He rose from poverty on Chicago's South Side and has retained a sizable following. Kelly has written numerous hits for himself and other artists, including Celine Dion, Michael Jackson and Lady Gaga. His collaborators have included Jay-Z and Usher.The jury in 2008 acquitted Kelly of child pornography charges that centered on a graphic video that prosecutors said showed him having sex with a girl as young as 13. He and the young woman allegedly seen with him denied they were in the 27-minute video, even though the picture quality was good and witnesses testified it was them, and she did not take the stand. Kelly could have been sentenced to 15 years in prison.Charging Kelly now for actions that occurred in the same time frame as the allegations from the 2008 trial suggests the accusers are cooperating this time and willing to testify.Because the alleged victim 10 years ago denied that she was on the video and did not testify, the state's attorney's office had little recourse except to charge the lesser offense under Illinois law, child pornography, which required a lower standard of evidence.Each count of the new charges carries up to seven years in prison, and the sentences could be served consecutively, making it possible for him to receive up to 70 years. Probation is also an option.The walls began closing in on Kelly after the release of a BBC documentary about him last year and the multipart Lifetime documentary "Surviving R. Kelly," which aired last month. Not every app has the same restaurants on them, so you might have to use an app that has the restaurant of your liking.Door Dash was the simplest app to use because there weren’t that many choices or suggestions to help you choose what to eat.Eat 24, like many of the other apps offered food categories like American, Asian and Mexican to help you narrow down your choices.We found when placing your order on each app you had to add your credit card and address, but for Uber Eats you did not. If you have an Uber Ride Share account, it's automatically synced up to that app. It cut the ordering time in half if you were a new user.Although we used Postmates for ordering food, we learned you can use the app for ordering anything. Some use Postmates to order clothes to be picked up or getting an item from the drug store delivered to their house.No matter which app you use there’s a place to save money by adding a promo code. But, you’ll need to watch out for hidden service fees outside of the usual delivery and tax fee.A great feature all the apps have are alerts or push notifications letting you know where your food is and when it will be delivered.Almost every app delivered the food we ordered 10 minutes earlier than their estimated arrival time. CARLSBAD, Calif. (KGTV) - After a woman died in a jet ski crash in the Agua Hedionda Lagoon in Carlsbad on Sunday, Stephen and Aimee Cochrane were confronted with a painful memory.“I just cannot believe that this would have happened. It’s just wrong,” said Aimee.Her indignation was amplified by the fact that she and her husband were involved in a crash in the same lagoon in July of 2016.They had decided to rent a jet ski on their anniversary, something they had never done before.“We wanted to do something different,” recalled Stephen.But when they got to California Watersports at the Agua Hedionda Lagoon, they had second thoughts.“It was wild. It was mayhem out there,” said Stephen, describing the busy activity on the water.Despite their hesitations, they decided to go for it. But before they had even completed one lap around the buoys, they said they were t-boned by another rider.“We both flew off the jet ski,” remembers Aimee.Stephen said he momentarily blacked out. Aimee remembers swimming over to him and seeing him face down in the water.He was eventually pulled onto a boat and taken into an ambulance. He said he ended up with three broken ribs and a fractured sternum.Aimee suffered some cuts and bruises on her legs, but no broken bones.Stephen said he had to take three weeks off of work and pay ,000 in out of pocket medical expenses. He says he still has pain in his chest from the injury.After the crash, they said they had no contact with the owners of the rental company. They said they were unaware if the company had made any changes to prevent future crashes.10News spoke to an employee at California Waterspouts who said they would not be providing any statements. CHEYENNE, Wyoming -- On a windswept road, seemingly in the middle of nowhere, members of 90th Missile Wing from Francis E. Warren Air Force Base are stationed at one of the critical locales to our nation’s defense system. The only marker is a nondescript, square Air Force building tucked away in the farmlands of Wyoming.  It is the entryway to a place few of us get to see, and the people who control our most power weapons. This secret locale in Wyoming is home to some of the nation’s nuclear missiles, which are hidden deep underground.First Lt. Ramon Ayoade, the combat crew commander with the 321 Missile Squadron, is constantly awaiting word from the US military's chain of command. He was sitting in front of what can hardly be described as state-of-the-art-looking computers. From a 1960s era console, he and another airman control 10 of our country's 400 nuclear missiles. "We are constantly improving our systems. They are old, but they are 100 percent efficient," he said. The older technology is in some ways by design. It can’t be hacked because it’s not connected to Wi-Fi or the internet.These launch facilities are spread across Wyoming, Colorado and Nebraska.  Other crews are responsible for missile clusters near Minot, North Dakota and a third near Great Falls, Montana. The missiles are here to deter other countries from attacking the United States or its allies.Second Lt. Seth Hirschauer, the deputy combat crew commander with the 321 Missile Squadron, said there is a chain of command that gives launch orders. "It comes from the President and goes through a few different avenues before it gets to us,” he said.Before nuclear war, airmen must unlock two green lock boxes. Inside the boxes are top secret codes used to make sure a launch command is legitimate and a key needed as part of the process to arm and then send the missile into the air..According to Lt. Hirschauer. two people, each using both hands, are required to launch a missile at the "enable panel." As a safeguard, another crew must do the exact same thing in an identical capsule a distance away.In a simulation, they reenact turning the keys simultaneously to demonstrate how a launch would occur.Within seconds of an actual missile launch, the missile silo door in a nearby field opens and the missile is launched. This team fired an intercontinental ballistic missile last year to prove the process works. It landed in the ocean without a nuclear warhead onboard.In case of a nuclear war, these airmen have enough food to survive for months.The launch capsule where they're sequestered, is actually suspended in a way that if an adversary were to drop a bomb or something above ground, it would violently shake this area but the whole capsule can move and still stay intact.There are massive blast doors, about a foot thick, to help keep the men inside safe.Topside, missile security forces are responsible for making sure no one can physically access the missiles.Master Sgt. Eric Sterman, the flight chief with the 90th Missile Security Forces Squadron, said, "It's very important (to train) because there is a nuclear weapon out here. We have to insure our people can get out here and neutralize any threat that might come out here and try to take our weapon."Though a takeover hasn't ever occurred, the men methodically train as many as eight times a month, knowing full well other countries would love to get their hands on the United States' weapons.  "It's something we should keep in mind sir.  There is that threat and that responsibility," Master Sgt. Sterman said.Whether topside or below, all say their mission isn't one publicized frequently but they believe it's an essential part of keeping all of us safe. 3828
