The parent company of New York Sports Club and several other fitness club chains has filed for bankruptcy protection as the COVID-19 pandemic continues to wreak havoc with its operations. In a statement released Monday, Town Sports International — which also owns Boston Sports Clubs, Lucille Roberts, and several other fitness brands — said it agreed to voluntarily file for Chapter 11 Bankruptcy protection. The company added that the filing was made to simply restructure debt and that it does not plan to go out of business. In a message to employees, the company said it does not expect any changes to day-to-day operations or compensation and benefits.CNN reports that the company laid off "much" of its 7,000-person workforce earlier this year to preserve cash.Bloomberg reported Friday that Town Sports International was on the verge of filing for bankruptcy after talks of an million capital injection from Kennedy Lewis Investment Management fell through.Fitness clubs and gyms have taken a huge hit amid the pandemic, as the CDC continues to recommend against congregating indoors when possible. Sales of home fitness equipment have soared, and Americans have taken up other healthy outdoor habits like biking while restrictions keep some gyms closed. 1272

The New York Times reported late Saturday night that Senator John McCain will lie in state at the Arizona Capitol building and then the U.S. Capitol before being buried at Annapolis, Md.McCain died on Saturday in Arizona after a 13-month battle with brain cancer. The Times cited Republican sources as McCain's family finalizes plans to honor the senator from Arizona. McCain will also reportedly have a full dress funeral at the Washington National Cathedral. Two of McCain's former political rivals, Presidents George W. Bush and Barack Obama, will deliver eulogies, the Times reported, citing Republican sources. President Donald Trump is reportedly not invited to McCain's funeral, but Vice President Mike Pence will receive an invitation. McCain will be the 30th dignitary to have lain in state in the U.S. Capitol since 1852, and the first since Senator Daniel Inouye lain in state in 2012. Eleven of the previous 29 dignitaries who have lain in state were presidents. The tradition of lying in state would generally include an opportunity for the public to pay their respects.  1145

The man accused of killing 22 people and wounding two dozen more at a Walmart in Texas is expected to be reindicted Thursday as he faces another murder charge in the mass shooting that targeted Mexicans, prosecutors said.Patrick Crusius of Allen, Texas, is currently being held without bond on one count of capital murder of multiple people under Texas state law. The 21-year-old has also been charged with several federal hate crimes related to the shooting, according to a 90-count indictment unsealed in February.District Attorney Jaime Esparza said the latest murder charge will account for 36-year-old Guillermo “Memo” Garcia, who died nine months after the Aug. 3 massacre in the Texas border of El Paso that’s considered one of the deadliest attacks on Latinos in recent U.S. history. Esparza said Crusius will also face more counts in relation to the dozens of people injured in the shooting. The new charges will be added to the indictment prior to the grand jury’s term ending on June 30, Esparza said.“We’re reindicting the defendant to include the additional death and to include all of those injured in the Walmart shooting in order to give the next DA all of their options,” Esparza added. “We just want to cover all our bases.”The upcoming reindictment comes more than 10 months after the mass shooting in the majority Latino and Hispanic city federal prosecutors say was sparked by militant racism. They have said Crusius carried out the attack to scare Latinos into leaving the U.S., a plot they allege he outlined in a racist screed published online before the attack.More than 20 people survived the shooting and suffered from injuries. Some underwent surgery, and one remains in the hospital. Hundreds more have suffered psychological trauma either because they were present or because a loved one was wounded, according to local officials.Esparza, who’s set to retire after 28 years in office, said he hopes that the added charges will help provide continuity in the case and eventually lead to justice should the DA succeeding him decide to pursue the state case against Crusius.Voters will pick a new DA in a runoff election on July 14th. It’s one of several factors that will help answer some legal and financial questions, including the trial’s start date and location. The Department of Justice will prosecute on a parallel track with Texas officials. Crusius already faces the death penalty on a state capital murder charge to which he pleaded not guilty last year. 2499

The hottest gift this holiday season is a new gaming system under the tree.Microsoft's new XBox Series X and Sony's new PlayStation 5 are the hardest-to-find items this Christmas, quickly becoming the Furby or Hatchimal of 2020.To make it even more frustrating, some people who ordered one are ending up with nothing after a Kohl's website malfunction, Walmart Thanksgiving night fail, and Amazon package thefts.Kohl's, Walmart frustrationJerris Williams is one of the few lucky ones: he showed us his new PS5, which he found at Target the other morning at 6 a.m."We finally got one," he said, "and it was almost like a lottery."He thought he found one on Kohl's website a couple of days earlier, as did thousands of other shoppers."Kohl's went live, which means they were starting to sell the PlayStation 5," he said. "And that went on at 1:30 in the morning."Williams quickly got a confirmation from Kohl's that a PS5 was on the way, only to have his hopes dashed hours later."We were happy, excited, celebrating. And then the next morning, they canceled on us."Kohl's confirms to us that it was unable to fill all PS5 orders. The electronics blog Techspot suspects thousands of people were left empty-handed by the website glitch. The one consolation: Williams gets to keep 0 in bonus Kohl's cash for his trouble. Kohl's says it is still giving bonus cash to all the people who had their orders canceled."I'm doing the math in my head," he said. "All my friends have the same thing, so that's a lot of money that they are all giving away for nothing."Walmart website failWalmart attempted to do shoppers a favor Thanksgiving night, announcing they were putting up several thousand PS5s at 9 p.m.But most shoppers ended up like Stephanie Meibers, with an error message when they tried to grab one the minute the Walmart site went live."I tried to add to cart," she said. "Then you get the 'oh dear' message, a little dog with antlers, and then I get 'We are getting temporary internet issues.' Then the next thing it said it was out of stock, and 'We have moved it to your save for later folder.'"Tech sites blame what they call "Grinch bots," automated programs that grabbed the inventory immediately, before shoppers could get out their credit cards.Complaints of Amazon switcheroosBut Kohl's isn't the only retailer trying to soothe angry and frustrated customers right now. With Amazon, it's a whole different problem. Some Amazon customers (most in England so far) are posting photos of other things they claim showed up in their XBox or PS5 shipping box.Buyers claim they received everything from brown paper, to a foot massager, to a box of Purina cat food. 2675
