The prosecution says it obtained data from the phone, which it shared with the defense, and then the phone was returned to the man's family. Spacey's defense team wants to examine the phone itself, claiming that exculpatory evidence may have been deleted before it was given to police and prosecutors.Spacey, 59, faces criminal charges of indecent assault and battery in connection to the alleged July 2016 incident. The former "House of Cards" star has pleaded not guilty. He could face up to five years in prison if convicted.Judge Thomas Barrett ruled in June the defense was entitled to inspect the phone. However, the accuser and his family have said they don't have it and don't know where it is.Barrett extended the deadline for turning the phone over until Monday and said that if it's not found, the accuser, his attorney and his mother must appear in court to testify about its whereabouts.Surprise moveMeanwhile, in an abrupt about-face Friday, the alleged victim's lawyer announced that a civil lawsuit filed against Spacey a week earlier had been dropped.Spacey's accuser, who was an 18-year-old busboy at a Nantucket bar at the time of the alleged assault, filed the civil complaint on June 26. In it, the accuser said Spacey bought him "multiple alcoholic beverages" before he then forcibly touched and fondled his genitals -- the same allegations he made in the ongoing criminal case.CNN is not naming the accuser because he is an alleged victim of sexual assault.The accuser's attorney, Mitchell Garabedian, told CNN via email Friday that he and his client voluntarily dropped the lawsuit and that he would have no further comment.The civil lawsuit accused Spacey of explicit sexual behavior and infliction of mental distress. KANSAS CITY, Mo. — Doctors across the country are working to figure out a medical mystery that's left a Smithville, Missouri, teenager losing her senses, including her vision. Jordyn Walker is 15 years old and now permanently blind, part of a medical mystery she's been battling for more than a year and a half. "I just hope it never happens again," she said. "I don't really know what else I can lose." Walker's symptoms first appeared in July 2017. At first, the teen experienced stomach pains associated with her colitis, an inflammatory bowel disease. Then her face began to swell and her eyes, ears and nose began to bleed. Walker lost her sense of taste and smell. "It was terrifying knowing that there is nothing I could do for her and just watching her go through this," said her mom, Kendyll Walker. Tests results in 2017 from an out-of-state hospital came back normal so Walker's family believed it was a one-time thing. A year later, she went to the emergency room at The University of Kansas Hospital. Her severe symptoms had returned and were much worse. "How rapid her face started swelling and how rapid the pressure in her eyes went up were quite alarming," said Dr. Travis Langner, who is the division chief for the hospital's pediatric critical care unit. Walker stayed in the pediatric critical care unit and underwent emergency eye surgery. The pressure on her eyes was too severe and caused her to lose her sight permanently. "It's frustrating for the family, it's frustrating for us not to have pinpointed the answer and have a definite diagnosis," Langner said. "But we've gotten enough answers from the tests, enough negative answers, to know what it's not. So now it's finding the definitive answer of what it is." "We didn't even realize that he had been burned," McRee said. The kitchen was on fire. So our first priority was putting that out."Once the couple finally put the fire out near the stove top, they realized that Sugantheraj had been severely burned. "It's his arms, his face, his neck, his hands, his ear," McRee said. "I feel terrible for him and the pain that he's in. I just feel horrible, you know, he's in so much pain," she said. "I've watched him get his bandage changed. He's got raw skin. It's like ten to 15 percent of his body that's just burnt off."Sugantheraj was in the hospital undergoing surgery on Friday."They're having to do skin grafts, severe ones. One is going to be pigskin, one's going to be his own skin," Sugantheraj's girlfriend said. She is not sure of his recovery time. The cause of the fire? A can of Pam cooking spray kept too close to open flames. "He's a full-time med student. He's educated. He's very smart... He had no idea - I had no idea," McRee said. "We know to keep cooking oil away, especially not on the stove top, but we had placed it far enough to where we thought it was OK."The medical director in Eskenazi's emergency department, Dr. Tyler Stepsis, said aerosol bottles like Pam make oils even more flammable. She said that this is a common occurrence. "You not only have the thing your aerosolizing but you also have the propellant. And the propellant a lot of times is what can catch fire," Dr. Stepsis said. As a warning: "When you set it down, don't put it by your stove, put it very far away because I don't want this to happen to anybody else," McRee said. Doctors say, bottom line, know what you're cooking with and keep it a safe distance from flames.
