The judge said while explaining his decision that he believes that CNN and Acosta are likely to prevail in the case overall.Kelly made his ruling on the basis of CNN and Acosta's Fifth Amendment claims, saying the White House did not provide Acosta with the due process required to legally revoke his press pass.He left open the possibility, however, that the White House could seek to revoke it again if it provided that due process, emphasizing the "very limited" nature of his ruling and saying he was not making a judgment on the First Amendment claims that CNN and Acosta have made.Kelly was appointed to the bench by Trump last year, and confirmed with bipartisan support in the Senate.CNN has also asked for "permanent relief," meaning a declaration from the judge that Trump's revocation of Acosta's press pass was unconstitutional. This legal conclusion could protect other reporters from retaliation by the administration."The revocation of Acosta's credentials is only the beginning," CNN's lawsuit alleged, pointing out that Trump has threatened to strip others' press passes too.That is one of the reasons why most of the country's major news organizations have backed CNN's lawsuit, turning this into an important test of press freedom.But the judge will rule on all of that later. Further hearings are likely to take place in the next few weeks, according to CNN's lawyers.The White House took the unprecedented step of suspending Acosta's access after he had a combative exchange with Trump at last week's post-midterms press conference. CNN privately sought a resolution for several days before filing suit on Tuesday.The defendants include Trump, press secretary Sarah Sanders, and chief of staff John Kelly.Kelly heard oral arguments from both sides on Wednesday afternoon.Kelly, a Trump appointee who has been on the federal bench just more than a year now, was very inquisitive at Wednesday's hearing, asking tough questions of both sides, drilling particularly deep into some of CNN's arguments.Then he said he would issue a ruling Thursday afternoon. He later postponed it until Friday morning, leaving both sides wondering about the reason for the delay.In public, the White House continued to argue that Acosta deserves to be blacklisted because he was too aggressive at the press conference.Speaking with Robert Costa at a Washington Post Live event on Thursday, White House communications official Mercedes Schlapp said press conferences have a "certain decorum," and suggested that Acosta violated that. "In that particular incident, we weren't going to tolerate the bad behavior of this one reporter," she said. Schlapp repeated the "bad behavior" claim several times.When Costa asked if the White House is considering yanking other press passes. Schlapp said "I'm not going to get into any internal deliberations that are happening."In court on Wednesday, Justice Department lawyer James Burnham argued that the Trump White House has the legal right to kick out any reporter at any time for any reason -- a position that is a dramatic break from decades of tradition.While responding to a hypothetical from Kelly, Burnham said that it would be perfectly legal for the White House to revoke a journalist's press pass if it didn't agree with their reporting. ENCINITAS (CNS) - The city of Encinitas announced its intent Tuesday to join a countywide joint-powers authority that would provide energy service to residents and compete with private companies like San Diego Gas & Electric.The Encinitas City Council voted Aug. 21 to join the JPA, which will be headed by the city of San Diego, because it aligns with the city's Climate Action Plan. In February, the San Diego City Council voted to begin the process of establishing a so-called community choice energy program with the intention of inviting other cities into the fold as the program expands.The county of San Diego and the cities of Chula Vista and La Mesa have also expressed a willingness to join the CCE program in recent weeks. Later this year, the San Diego City Council will officially vote to form the authority.RELATED: San Diego to begin building alternative to SDG&E"We're excited to work together with the City of San Diego in accomplishing this key component of our very similar Climate Action Plans," Encinitas Mayor Catherine Blakespear said. ESCONDIDO, Calif. (KGTV) - An Escondido CrossFit class got quite a nasty surprise when they went outside for their workout, Wednesday. They found human feces.The owner of Boombox CrossFit North, Brittani Ramirez, said she was in shock when she heard over the phone, "I didn't believe her; I was like no, we get dogs back there all the time, like I'm sure it was just a stray dog."When she looked back at their security footage, it showed a man walking up to the back door, wiggling the handle, then walking to the corner of the lot, pulling down his pants and defecating.The footage showed it was 3:30 p.m., just an hour before class started."One of my amazing members Lacey stepped in, she gloved up, got some trash bags, she got some bleach, and Katie, one of my coaches, the two of them handled the business," Ramirez said.A health concern for everyone involved. Ramirez said this isn't her first unpleasant experience with homeless, she said they've been stopping in over the three years Boombox has been open."They walk in and they see it's obviously very different in here but still a lot of them are mentally ill or on drugs so they don't quite understand," Ramirez said before she bought the building, it was a redevelopment center for homeless and convicts. The former facility was there for more than 30 years.Ramirez hopes the city can do something to help them. At the gym, she's planning to lock the gate each day to make sure there is no more unwanted surprises.The Deputy City Manager, William Wolfe, said the city's reunited 50-60 homeless people with their families who are now caring for them. He said he is meeting with local business owners Thursday night to talk about forming a homeless task force. He said the city already has a Quality of Life Team, made up of local leaders to address these issues and seek out solutions. If a business owner has an issue with homeless, Wolfe said they should call him.Ramirez opened Boombox after rediscovering her love for fitness. She played basketball, volleyball and softball in her youth and after having children she wanted to rekindle that fire. Her gym is named after their empowering music that is often flowing through the open doors.Ramirez said the gym is a labor of love, adding members helped her paint the gym and build equipment. 2313
