SAN DIEGO (CNS) - A former Torrey Pines High School student who posted threats targeting the school on his Instagram account was sentenced Friday to a year in custody, with at least six months to be served at a residential alcohol and mental health treatment facility.Kevin Matlak, 21, pleaded guilty last month to one count of making a criminal threat.Superior Court Judge Polly Shamoon placed Matlak on five years probation and ordered him to stay away from Torrey Pines High and have no contact with three people named in a criminal complaint.RELATED: Former Torrey Pines student faces judge in online threats caseDefense attorney Brian Watkins said Matlak didn't threaten anyone directly, but three former classmates -- whom the defendant didn't know -- read his posts on Instagram and felt threatened by them.The classmates of Matlak's who graduated in 2015 reported the threats to law enforcement on May 30, leading to his arrest."I hate all of you," Matlak wrote in one post, according to Deputy District Attorney Matthew Greco.RELATED: Former Torrey Pines High School student seeking psychiatric help after online threat"Get the (expletive) out of San Diego 2K18 before I find u," the defendant wrote in another post. Matlak also posted a photo of him holding an AR-15 rifle in one hand and giving the middle finger with the other hand, Greco said.The principal of Torrey Pines High School wrote a letter to the court, detailing how the threats impacted him and his assistant principals, knowing that the person making the threats had not been arrested and knowing that they could be in harm's way after they made the decision to keep the school open the next day. 1690

SACRAMENTO, Calif. (KGTV) -- California will have the highest gas tax in the nation after an upcoming increase beginning July 1, according to figures by the Tax Foundation. Beginning July 1, California’s gas tax will increase by nearly six cents. Currently, the tax is 55.2 cents per gallon. When the additional tax kicks in, that figure will jump to more than 60 cents in taxes per gallon. Currently, the highest gas tax in the nation is in Pennsylvania at 58.7 cents. SALT LAKE CITY — A Halloween protest party scheduled for Saturday night near Salt Lake City has been canceled, with organizers claiming harassment and intimidation led to its downfall."The Protest on Halloween" party was promoted via social media by a group calling itself Utah Tonight. The party featured four DJs and a guarantee that attendees would not have their faces shown in photos.As recent as last week, the group said the party's purpose was to promote "mental health and to raise a voice against those who are using fear and misleading information to gain power and control in our lives. Life must go on. COVID-19 is real, but it shouldn't be the end of normalcy!”However, as COVID-19 cases continued to soar in Utah over recent weeks, the image of thousands partying up close no doubt became a Halloween nightmare to officials.Monday afternoon, the Utah Tonight group posted to its Instagram page that the party has been called off. Saying "thousands" had purchased tickets to the event, the organizers acknowledged the rise in cases may have played a role in the decision while also attacking government officials and the media."The Utah Tonight team has fought tirelessly to provide individuals with an evening of normalcy and enjoyment during this year of uncertainty." the post read. SALEM, Ore. – Oregon voted to legalize psilocybin mushrooms for therapeutic use on Tuesday.A psilocybin is a hallucinogenic chemical obtained from certain types of fresh and dried mushrooms, according to the Drug Enforcement Administration (DEA).With 81% of votes reported Wednesday morning, 55.8% of the electorate had voted to approve Oregon Measure 109, The Associated Press reports.While some states have decriminalized the so-called “magic mushrooms” or "shrooms," this measure makes Oregon the first state to legalize them.Under the measure, licensed service providers are permitted to administer psilocybin-producing mushroom and fungi products to those 21 years or older. The DEA says it’s often ingested orally, brewed as a tea or added to foods.The measure authorizes the Oregon Health Authority (OHA) to create a program to help these licensed providers to administer the products.The measure was backed by war veterans with PTSD, those with terminal illnesses and others who suffer from anxiety or depression, who claim psilocybin helps.Some opponents say science does not yet indicate that psilocybin is a safe medical treatment. 1150
