SAN DIEGO (CNS) - It took emergency crews about 20 minutes Monday to free a tree trimmer who wound up trapped in a palm tree, upside down, about 30 feet above the ground in a San Carlos-area neighborhood.The work accident in the 8000 block of Dicenza Lane, south of Mission Gorge Road and west of Golfcrest Drive, was reported about 8:15 a.m., according to the San Diego Fire-Rescue Department.After firefighters got the victim, a man in his 40s, out of the tree, medics took him to Sharp Memorial Hospital for evaluation of complaints of dizziness and nausea, SDFRD spokeswoman Monica Munoz said. 605

He and the female passenger then got back into the van and drove away.A second passenger in the van has not been identified by police and no description of the man has been disclosed.An off-duty CHP officer who saw a flier about the collision spotted a suspicious looking van bearing CA exempt plates, typically used by state-owned vehicles, while riding his motorcycle in the Lake Isabella area over the weekend and notified the local office, CHP Officer Robert Rodriguez told the Union-Tribune.The officer assigned to that area -- roughly 35 miles northeast of Bakersfield -- went looking for the van early Tuesday morning and found it in a Vons parking lot, this time with Vermont license places, Rodriguez told the newspaper. With the assistance of Kern County sheriff's deputies, the officer located Flores and Bailey nearby and arrested them. 1962

When the toddler woke up and cried while being sexually assaulted, Diaz carried her out through the window and was walking her toward his home when the defendant's mother saw them and wrapped the child -- who was naked from the waist down -- in a blanket.Police were called around 9:45 a.m. and Diaz was arrested.``It's a parent's worst nightmare,'' Grasso said following Diaz's arraignment last year. ``The violation, the betrayal, (it's just) horrific. I think that not only does it impact the victim but it impacts the entire family, who now have to look over their shoulder, who now cannot feel safe in their own home. SAN DIEGO (CNS) - A San Diego federal judge largely upheld California's private prison ban in a ruling stemming from dual lawsuits filed against the state by the Trump administration and a private prison firm.U.S. District Judge Janis Sammartino issued a preliminary injunction Thursday upholding in most respects Assembly Bill 32, which took effect Jan. 1 and prohibits the operation of private detention facilities statewide.By 2028, the law would bar all inmates from being held at privately owned facilities. The law also prohibits agencies from entering into new contracts for privately owned detention facilities or renewing existing contracts at currently operating facilities.The federal government and private prison firm The GEO Group argued that the law is unconstitutional because it encroaches on the government's operations to house federal inmates by unlawfully allowing a state government to regulate federal operations.Additionally, the government has argued that private facility closures will force the relocation of thousands of inmates at high cost to taxpayers, with inmates also forced to be incarcerated at greater distances from their families, especially if they are relocated out of state.The GEO group alleges that it will lose around 0 million per year in revenue if forced to close down its California facilities and could lose more billion in capital investment and revenue over the next 15 years.Sammartino ruled that AB 32 is a regulation of private detention contractors rather than the federal government and its operations and disagreed with plaintiffs' arguments that AB 32 interfered with congressional objectives to house detainees in private facilities, except in respect to United States Marshals' detainees.Sammartino wrote, "Congress clearly authorized USMS to use private detention facilities in limited circumstances, such as where the number of USMS detainees in a given district exceeds the available capacity of federal, state and local facilities."As AB 32 would prevent the use of private facilities when no available space exists in other facilities, she preliminarily enjoined enforcement of the ban in regards to USMS detainees, but it remains in effect for the U.S. Bureau of Prisons and ICE.According to court papers, 1,100 USMS inmates in California are housed in private detention facilities, representing about 22% of USMS statewide.Among those inmates, many are housed at San Diego facilities that include the Metropolitan Correction Center, Western Region Detention Facility, and Otay Mesa Detention Center.The United States and the GEO Group can file amended complaints within the next three weeks, according to Sammartino's order. 2706

  

SAN DIEGO (CNS) - A man who ambushed a janitorial worker at a Little Italy coffee shop at knifepoint, tried to sexually assault her and stole her SUV, was sentenced today to 14 years in state prison.Christopher Merron, 28, was also ordered to register as a sex offender for life.The attack occurred around 4:30 a.m. last Oct. 14 as the victim was cleaning the coffee shop in the 1700 block of India Street. Merron pushed the woman into a back room, took her car keys and threatened her with a knife, according to police and prosecutors.Following a struggle, she was able to break free and run out of the building, said San Diego police Lt. Jason Weeden.The assailant fled in the woman's 1998 GMC Jimmy. Merron was arrested in Mission Valley the next day and the victim's SUV was recovered, Weeden said.Merron pleaded guilty in January to assault with intent to commit a sex offense, robbery and sexual battery charges and admitted a knife-use sentencing enhancement allegation. Other charges, including kidnapping with the intent to commit a sex offense, attempted oral copulation, false imprisonment with force and auto theft, were dismissed at sentencing. 1165
