PARKLAND, Fla. – The death penalty case against Nikolas Cruz in the 2018 massacre at a Florida high school remains in limbo.At a brief hearing Tuesday, no decisions were made on a trial date amid continuing obstacles because of the coronavirus pandemic. Cruz's defense lawyers say they have almost no access to him in jail, nor do defense experts they insist must see him to build a case."We're in a worldwide pandemic. It's just not safe to be doing that right now," said defense attorney Melisa McNeill in the hearing, held remotely. "All of that, unfortunately, is on hold."Broward County State Attorney Michael Satz said his office is ready for trial but added that they must await the filing of various anticipated defense motions. That is one of the issues interrupted by the coronavirus pandemic.Cruz, 21, is charged with killing 17 people and wounding 17 others during a Valentine's Day 2018 rampage with an AR-15 rifle at Marjory Stoneman Douglas High School in Parkland, Florida.Cruz's court-appointed public defenders have repeatedly said in court he would plead guilty in exchange for a life prison sentence. The state attorney's office has rejected that, contending that a jury should decide his fate.Just when a trial may begin is anyone's guess.As time has gone on, things have changed. Satz, the state attorney, is leaving his post after 44 years. There are new candidates to replace Satz, including Democrat Harold Pryor who, if elected in November, would be the first Black state attorney in Broward County history.Pryor has not commented directly on the Cruz case but, in general, has said he personally opposes the death penalty. Pryor has the support of the county mayor, Dale V.C. Holness.His opponent on the Republican side is Gregg Rossman, a veteran former homicide prosector who handled some of Broward County's biggest murder cases. He is now in private practice.Broward County is one of the most heavily Democratic places in the country.Neither have said exactly what they would do with Cruz, as it's an ongoing case and they are not in office. Tony Bommarito says an 88-year-old woman rear-ended a parked car shortly after 4 p.m. Tuesday in Placentia, pushing the SUV all the way into the store. The woman's SUV wound up partially inside.The woman was taken to the hospital with a trauma injury, but she's expected to survive.Bommarito says a 14-year-old boy in the SUV that was struck and three women inside the store — two shoppers and an employee — were treated for minor injuries. 620

PINELLAS COUNTY, Fla — CVS has pulled all powdered Enfamil baby formula off its shelves as its pharmacy department does an internal review. The move comes after a Florida mother shared her story about what she found inside a tub of formula with Scripps station WFTS in Tampa.Alison Denning says her package of Enfamil baby formula was tampered with before she opened the package."When I opened it up, this seal that wraps around was opened,” she said. RELATED: Mom says baby formula bought at nearby CVS was replaced with flourDenning says the package looked fine on the outside and even had the protective seal intact on the lid, which is why she didn’t think twice about buying it. But when she got it home, she knew what she found inside was not baby formula. She sent the product back to the manufacturer for lab testing. She says Enfamil has been extremely friendly and helpful.Enfamil said Denning's is an “isolated incident” and haven’t had any other reports of flour for this particular batch of formula. But this isn't the first time baby formula has tampered with — last year, a woman was arrested in Tucson, Arizona after she was found guilty of swapping baby formula with flour at two Walmart stores in the area. One baby was sickened after ingesting the tampered product but is doing OK now, according to the Associated Press.“There is no recall related to this or other Enfamil branded products,” Lynn Kenney said. She's the Head of Corporate Communications, North America for the makers of Enfamil, Reckitt Benckiser. Even still, CVS decided to pull the product."Enfamil powder is temporarily unavailable in our stores due to an internal review being conducted by CVS Pharmacy," CVS said in a statement. "Our store employees can assist customers with finding an alternative product in the meantime. We apologize for any inconvenience.”"I’m very relieved that they’re taking this seriously,” said Denning.Denning got a sample size of Enfamil powdered baby formula from her pediatrician Wednesday."It’s an aluminum pop top,” she said. "Once you break the seal, you’ll know right away if someones been in it.”Denning thinks it's much more tamper-proof than the tubs with bags inside. "Anyone who’s not 100% familiar with formula may have made a really bad mistake,” she said. Enfamil says there is no recall on any of its products but encourages anyone that purchases its products to check the appearance of the package — even differences that may be minor could be meaningful. PHOENIX — The Trump campaign and the Republican National Committee have filed a new lawsuit in Arizona, claiming Maricopa County poll workers "incorrectly rejected votes" cast by in-person voters on Election Day.The lawsuit alleges when the voting machine detected an "overvote" on a ballot, the poll workers told in-person voters to "press a green button to override the error." This reportedly caused the machine to dismiss the voter's choices in the overvoted races, according to the Trump campaign. An overvote is when someone selects more than one option or candidate in a race. "Upon information and belief, the adjudication and tabulation of these ballots will prove determinative of the outcome of the election for President of the United States in Arizona and/or other contested offices in Maricopa County," the lawsuit states.The campaign says they have received information from voters who say they witnessed the problem and that it happened on a large scale in the county.“Poll workers struggled to operate the new voting machines in Maricopa County, and improperly pressed and told voters to press a green button to override significant errors,” said Matt Morgan, Trump 2020 campaign general counsel, in a statement. “The result is that the voting machines disregarded votes cast by voters in person on Election Day in Maricopa County.”The lawsuit urges for "the manual inspection of purportedly overvoted ballots that were cast in-person, the same way that elections officials examined overvoted ballots that were mailed in or dropped off," according to a press release from the Trump campaign.Read the full lawsuit below, or click here: The lawsuit was announced Saturday evening, following projections from the Associated Press earlier in the day that Joe Biden had won the presidency after Pennsylvania and Nevada were called for the former vice president.The suit is one of multiple filed by Trump's campaign in states that were reporting close margins between Trump and Biden. PHOENIX (AP) — A federal court in Maryland has ruled that the Deferred Action for Childhood Arrivals program must be restored fully, meaning it must open up to new applicants for the first time in three years.The program helps immigrants who were brought to the U.S. as children to legally work and protects them from deportation. Last month, the U.S. Supreme Court ruled that President Donald Trump didn't properly end the program in 2017.Roughly 650,000 people are enrolled in DACA, but only those who were already in the program when it ended have been able to renew.The U.S. Citizenship and Immigration Services said it is reviewing the ruling.The attorney general of California, Xavier Becerra, led the multistate coalition in the lawsuit that sought to restore DACA.After the court’s ruling, Becerra said, "From the Supreme Court down, the courts have made it clear: DACA stands, and now its doors are open to new Dreamers to apply.
