SAN DIEGO (KGTV) - "It's not fair and it's not right," says Warren Peters of Spring Valley. He says he's been watching his son, Jahmes, spend several months fighting for his federal tax return. "People need this money. People have worked for this money. People have earned this money," says 24 year-old Jahmes.The young man tells Team 10 that he filed online in February and received his state refund, but not his federal refund. It's now been more than 7 months. A return summary shows he's owed almost ,200 from the IRS.Jahmes says he's between jobs and burning through his savings. His father tries to help but says he's retired and on a fixed income, so his means are limited."It doesn't feel too good depending on your dad at 24-years-old," Jahmes tells Team 10. Jahmes says he has repeatedly called, emailed and written to the IRS. He adds he was once asked to appear in-person to verify identity, which he says he completed. However, he says his efforts didn't yield clear answers from the IRS.On the IRS website, he showed us what he says is his filing status. "Your tax return is still being processed," is what it reads. "If the circumstances were different, [the IRS] would be knocking on [our] door looking for their money," says Warren Peters. "The IRS is just understaffed and overworked," says tax attorney Ronson Shamoun, CEO of Downtown San Diego's RJS Law Firm. He says long delays are not uncommon. "Yet, after it's been so long, there should be some indication as to what's going on or some sort of game plan as to what you can do."Shamoun says the best route to take is contacting the Taxpayer Advocate Service, which was created by Congress to facilitate aid for taxpayers dealing with related issues. The IRS website reports that most refunds are issued in less than 21 calendar days, but explains there are a number of reasons for delays, including possible errors, incomplete returns, and concerns about identity theft or fraud.  The IRS says it cannot respond to media inquiries about specific cases."He does have a right to be upset. He definitely does," says Shamoun. The Taxpayer Advocate Service can be reached https://taxpayeradvocate.irs.gov/   2371

SAN DIEGO (KGTV) - A City Heights native is returning to San Diego as part of the Broadway tour of Miss Saigon.Jackie Nguyen is a member of the ensemble, but says this show has always had a special place in her heart."It was the very first musical that I saw, ever," says Nguyen.Getting the chance to perform in her home town is a thrill for Nguyen, who says about 20 family members and friends will be at each show throughout the weekend."I've always wanted to play the Civic Theater because this is where I first saw my big Broadway musicals in high school," she says. "It's a full circle moment for me."The show also has significance for her family, as Nguyen's mother is from Vietnam and has a similar story to the main character, Kim."When you are introduced to Kim at the beginning of the show, she's 17 and she meets and American GI. My mom, in the midst of the war, when she was 17, she also met an American GI. And they got married and had children from that. And eventually went to America," says Nguyen.That connection makes performing in Miss Saigon even more meaningful every time Nguyen steps on stage."Every night, i know that I am trying to give my family and my mom some type of honor in some way," she says. SAN DIEGO (KGTV) - A big rig blew a tire and veered across all lanes of southbound Interstate 15 at Carmel Mountain Road Thursday afternoon, leading to a Sig Alert on the freeway. The flatbed truck lost its front left tire about 2:20 p.m., the California Highway Patrol reported. The driver lost control and hit two cars before crashing into the center divider. One of the cars hit an SUV, and was knocked over the freeway rail into the HOV lanes.The CHP reported debris on the freeway from the crash, including fuel leaking from the truck. One injured person was taken to Palomar Medical Center, City of San Diego officials reported. Another driver had minor injuries.Check 10News traffic conditions The far left lane of I-15 and the right lane of the HOV section reopened at 5:45 p.m., according to the CHP. SAN DIEGO (KGTV) -- A City of San Diego employee says she was sexually harassed by her boss on the job and now the man accused of the harassment is asking the city to pay for his legal defense.The woman says her supervisor groped her and grabbed her arm hard enough to tear open a recent surgical wound, causing it to bleed. The parks and Rec Department employee alleges that her supervisor, Frank Cardenas, sexually harassed her, even touching her inappropriately at work.Josh Gruenberg is representing the city staffer and says she has put up with enough. "He pinned her legs against her desk in her cubicle he wrapped her up in his arms and pulled her close multiple times,” said Gruenberg.The victim says she rejected every overture Cardenas made. At one point, the victim says Cardenas told her "if she wanted to get the support to grow within the city she should only care what Cardenas thinks or wants.""He really tried to get her to put his trust in him and that it would be good for her career,” Gruenberg said.The lawsuit also claims that Cardenas gripped the victim’s arm so hard that he reopened a surgical incision, causing her to bleed at work."And all of this took place in the workspace. This was not something that involved the two of them going away for a weekend. This all took place on the job,” Gruenberg said.Cardenas declined a request for an interview. Monday night, the City of San Diego voted unanimously not to pay for Cardenas’s legal fees with city money and said they have no further comment. 1535
