(KGTV) — A federal judge has denied Stone Brewing's request for a preliminary injunction in its lawsuit against MillerCoors over its Keystone Light product cans.Stone's motion to dismiss MillerCoors' counterclaims were also denied. The injunction would have prevented MillerCoors from using the rebranded cans during trial, according to IP and craft beer attorney Brendan Palfrey. More court documents can be read on Palfrey's Twitter page.Stone Brewing filed the suit against MillerCoors in February 2018, after the beer maker rebranded its Keystone Light products to feature "Stone" on a separate line in bold fashion.RELATED: San Diego's Stone Brewing sues MillerCoors over Keystone cans: 'We will not stand for this'While Stone lost out on the injunction, the judge did say Stone's trademark infringement case is “moderately strong." The judge added that the court agreed with Stone, "especially considering the marks incontestability, [Stone] is entitled to the strong protection afforded to suggestive marks."The case will likely now move to trial.Following the ruling, Stone's cofounder Greg Koch issued a statement, saying the court confirmed their case against MillerCoors.“This is a very big deal. The Court’s order confirms what we knew: that MillerCoors should be ashamed of what they have been doing. All along this has been a clear-cut infringement case, and now we can focus our resources on proving the significant damages done to the good name of Stone Brewing," Koch said.Stone CEO Dominic Engels added, "We are pleased that the Court recognized the validity of Stone’s infringement claims. MillerCoors has made hundreds of millions of dollars from rebranding Keystone in a way that infringes on our trademark. (KGTV) - A group of Massachusetts police officers and firefighters are being hailed as heroes after coming to the aid of a choking puppy this week.North Reading resident Megan Vitale stormed into a police station Sunday telling officers her 9-week-old Saint Bernard puppy, Bodhi, was choking on food. An acquaintance came running in with Bodhi shortly after, the puppy limp and unresponsive in his arms, surveillance footage from the station showed.A group of officers came running out to begin administering first aid to the puppy. A group of North Reading firefighters also arrived at the station to help with back blows and chest compressions. After 10 minutes, the food blockage was finally dislodged and Bodhi was revived."Ultimately, a life was saved thanks to rescuers falling back on their training and remaining calm. Even though we are not faced with this kind of incident every day, the officers reacted just as they would in any emergency situation," North Reading Police Chief Murphy said. “We are hopeful that the puppy will make a full recovery."Firefighters used a special oxygen tank designed for pets to help Bodhi get breathing again."Many of our firefighters have pets at home in their own families. We do not get to choose the emergency situation that comes our way, so it is important that first responders be prepared for anything," Fire Chief Stats said.Bodhi was able to leave with Vitale to receive follow-up care from a veterinarian, according to the police department. 1534

  

(CNN) -- German police suspect a landscape gardener is responsible for killing one man and injuring two other people from beyond the grave.Bernhard Graumann, 59, was found dead from unknown causes at his home in Mehlingen in western Germany on Friday.Earlier that day, a 64-year-old doctor was killed by an explosion that appeared to come from a booby trap laid outside his practice in Enkenbach-Alsenborn, local police said in a statement.The doctor, who has not yet been named, is thought to have triggered the explosive when he bent down to pick it up, police said.Two days later, a mother and daughter were injured when a log that appeared to have been tampered with exploded in a wood-burning stove in Otterberg, less than six miles away. The younger woman, who has not been named, remains in hospital -- her condition is not thought to be critical.Western Palatinate Police have linked both cases to Graumann, who is said to have had a "bad relationship" with the victims, having been involved in disputes with them in the past. The gardener's death is currently under investigation, pending the results of an autopsy.When officers searched Graumann's home they discovered gunpowder and "other items subject to the weapons law and the Explosives Act," police statements said.Police also took the unusual step of warning other members of the public who may previously have fallen out with Graumann -- whether in a personal or business capacity -- to be on their guard."The police cannot rule out that prior to his death, the deceased had made preparations that could endanger other people's life and limbs," a statement said. "In particular, people who have had a problematic private or business relationship with Graumann are urged to contact the police immediately."A phone line set up for concerned members of the public has received dozens of calls, according to the force. 1890

  

(KGTV) — Border officials say 19 people were rescued after the engine of the panga boat they were on caught fire near San Clemente Island this week.The shipwreck happened on Tuesday when a boat carrying 19 undocumented migrants became disabled just before 7 p.m. Four people abandoned the panga boat and swam to shore at Naval Auxiliary Landing Field on San Clemente Island.After the four people were questioned, they were identified as passengers on the panga boat and part of a human smuggling operation. The four people also indicated other passengers had paddled the damaged boat to the island's shore and got off.The next day, at about 6:30 a.m., a helicopter lifted to search for the remaining individuals, who were all found by about 5 p.m. The group consisted of 16 men and three women, all between the ages of 17 and 45, and all Mexican nationals illegally in the U.S. One man complained of abdominal pain and was taken to the Naval Air Station North Island, and then a local hospital for treatment. An additional four people were treated by border agents for minor injuries.Two men face human smuggling charges. The remaining individuals were turned over to Border patrol for processing. 1205
