SAN DIEGO (KGTV) -- Opponents of  San Diego's new short-term rental regulations are accusing the city council of violating the Brown Act when it passed the new rules earlier this month. A letter drafted by an attorney on behalf of Air B and B, Home Away and Share San Diego was sent to the council Monday. It alleges the council violated the law when it made significant changes to the original proposal up for approval and then voted without allowing for more public comment. What they passed would essentially ban people from renting out anything other than their primary residence or a guesthouse on their property. The opponents are asking the council to hold another hearing. The city council is scheduled to hear a second reading of the short-term rental regulations Wednesday, August 1.  852

SAN DIEGO (KGTV) — PETA is taking aim at SeaWorld once again, this time hoping to put a stop to the parks' dolphin shows.Officials held a press conference Wednesday to call out the park for what they called "dangerous," "circus-style" dolphins shows. The group argues trainers use dolphins "as surfboards" and have caused "open wounds and extensive scarring" on the animals."SeaWorld ceded to public pressure and said that it would phase out its circus-style orca shows, but dozens of other dolphins are still packed into shallow tanks, forcibly bred, and used as surfboards and launch pads in its shows," Heather Rally, a PETA Foundation veterinarian, said. "PETA is calling on SeaWorld to end these demeaning tricks and stop standing on dolphins' backs and faces."Rally, "Blackfish" director Gabriela Cowperthwaite, and behavioral biologist Dr. Toni Frohoff presented a report Wednesday in regards to their observations at the parks. The three argued that the shows, which are performed at all three of SeaWorld's parks, risk damage to dolphins' lower jaws. The group says this, in turn, can harm joints, strain muscles, and damage the animals' hearing.SeaWorld held its own press conference in response. In a statement, Dr. Hendrik Nollens, vice president of veterinary services at SeaWorld and Busch Gardens parks, called PETA's conference a publicity stunt, adding their paper's claims had no foundation:Their findings are presented in a white paper, which is the equivalent of an online blog, which is not peer-reviewed. They are also presented in a press conference instead of a scientific journal, in the presence of a moviemaker, which should be a red flag to all of us. Make no mistake, at SeaWorld, we are the animal advocates, and the difference is we actually have marine mammal and dolphin expertise; you cannot perform a veterinary exam from the stands.None of these behaviors are a veterinary or animal health concern. We have never diagnosed any injury associated with performing these behaviors, whether during presentations or interactions. If we did, we would have eliminated them by now. SAN DIEGO (KGTV) -- Police are searching for the suspect who reportedly robbed a Subway in San Diego’s Corridor neighborhood at gunpoint early Sunday morning. According to police, the robbery happened on the 3300 block of University Avenue around 3 a.m. Sunday. Police say the man walked into the shop, pointed a gun at an employee and demanded cash. After the employee handed the suspect an unknown amount of cash, the man fled the scene. The suspect is described as a Hispanic man, five feet, nine inches tall and “very thin.” He was wearing a black hoodie, black mask and black pants, police say. 608

SAN DIEGO (KGTV) -- Police have released pictures of a man accused of shooting and killing a 27-year-old man in the Midway District in late February.Police say Ernesto Castallenos Martinez, 41, shot and killed Alexander Mazin in a parking lot behind the 24 Hour Fitness on the 3600 block of Midway Drive.Following the shooting, police were led to the intersection of 30th Street and Upas Street where an hours-long standoff took place.RELATED: Police identify Midway District shooting victim, suspect of North Park standoff?After SWAT teams entered an apartment in the area, they didn’t find Martinez. SAN DIEGO (KGTV) - Only 92.5 percent of San Diego County’s kindergartners were up to date on all of their vaccinations during the 2018-2019 school year, below the recommended rate.It was a slight .7 decrease from the previous year’s 93.2 percent, according to a report released by the California Department of Public Health. California as a whole also slightly fell below the 95 percent vaccination rate recommended by health experts. “We know that there are individuals that don’t believe in vaccinations and people that homeschool their kids, that’s a population,” said Dr. Wilma Wooten with the San Diego County Health and Human Services Agency. Wooten says the drop shouldn’t cause panic, but should make families more aware of the importance of vaccinating their children. She said the county is doing its part by responding in three different ways: policies, practices and programs. That includes legislation like the state ban on personal belief exemptions and also CDC recommendations. Wooten says the most important thing is to make sure all parents are aware of the age appropriate vaccines that not only their children, but all family members should have. Wooten says education is key to avoid the risk of contracting and spreading serious illnesses, like the highly contagious measles outbreak across the United States. She said the county has been doing community outreach about the importance of being vaccinated, especially as more people travel overseas during the summer months.“If an individual with measles is put into a room with ten other individuals, 9 out of 10 individuals will contract the illness, it is that contagious,” said Wooten. “It’s very important that all individuals, children, adults, as well as our seniors get the age appropriate vaccinations.” 1791
