SAN DIEGO, Calif. (KGTV) - A large San Diego Church is continuing to hold in person, indoor services despite orders from San Diego County to hold services in outdoor settings only. Awaken Church has gotten three cease and desist orders at different locations and also had an outbreak at one of those locations, according to San Diego County.County Supervisor Nathan Fletcher said the church is not cooperating with the county in regards to the outbreak at their Balboa location, so the county had to publicly announce the community outbreak and ask anyone impacted to quarantine. Typically, the specifics of community outbreaks would not be publicized, but he said the lack of cooperation from the church led to the public notice.“The Awaken Church in general has continued to be very defiant and continue to put the members of their church at a great risk and continue to not cooperate as we seek to investigate positive cases, which led us to the unique situation of publicly reporting that they did have a public outbreak at the Awaken Church,” said Supervisor Fletcher.Anyone who went to the location at 7620 Balboa Ave. between Nov. 15 and Nov. 22 is asked to quarantine for two weeks.Related: County asks Kearny Mesa church attendees to quarantine after COVID-19 outbreakSupervisor Fletcher said the county is trying to find a balance between respecting freedom of religion and also keeping the community safe.“We do recognize the first amendment role and I recognize the important role faith plays in our lives and in our community, particularly in a time of difficulty, which is why we work so hard to try and make sure that it is available, it just has to be available in a safe way,” he said.Glenn Smith is a Professor of Constitutional Law at California Western School of Law and also teaches at UC San Diego, and said there’s a chance churches could fight restrictions in court, but it depends on the circumstances. He said if a church is impacted by blanket rules for an area, they would likely not win in court. A church would have to prove that they were treated differently.“If religions are being treated in a nondiscriminatory fashion, in other words if there’s a general law that establishes how many people can be in a room or what are the conditions, and it happens to have an incidentally impact on religion, that’s not a special problem as long as government has a rational reason for doing that, that’s alright. It’s only when government discriminates against religion that a special level of review called strict scrutiny is required and government has to have a really really good reason for discrimination,” said Smith.He added that the makeup of a court will also impact any future decisions on religious freedom, saying when Justice Ruth Bader Ginsburg was alive, cases regarding religious freedom during the pandemic were found to not be discriminatory, however with the newly appointed Justice Barrett, it’s more likely the Supreme Court would rule in favor of a church. 3009

SAN DIEGO, Calif. (KGTV) - The sound of illegal fireworks in the San Diego area is not uncommon around the Fourth of July, but there is an increase in activity this year. San Diego Police Department Sergeant Matthew Botkin said from May 21 to June 21, 2019, the SDPD received 37 calls regarding illegal firework reports. During that same time period in 2020, there were 236 calls.Related: Fireworks continue boom in New York as residents wonder why the noise“I was sleeping, it was like 12 midnight, 1 a.m. and I heard explosions kinda close to my window,” said Stina Pezze, a Mission Beach resident.Jamie Young, a Pacific Beach resident, also has heard them at night, saying she’s lived in the area for 16 years and is used to the typical occasional illegal fireworks around the summer holiday, but this year has been much worse and started earlier.“They started easily a couple weeks ago and it would just be random weeknights we’d get woken up by them at 2 in the morning,” said Young.Neighbors are chiming in online asking where they’re coming from and why there seem to be more. Sergeant Botkin said the simple answer is that they don’t know."I'm not quite sure why the increase, I don’t have a reason why that’s the case but there’s certainly an uptick in them and we hope they go down," he said, also pointing out the difficulty in issuing citations. “We’re always more attentive this time of year to calls like this but you can imagine it’s really kinda difficult to nail down where these are coming from unless it’s coming out of your backyard."He noted that neighbors play a key role in reporting people using fireworks because citing specific locations makes police response easier. He also mentioned how dangerous fireworks can be, with 180 people across the country going to the hospital every day for firework-related injuries around this time of year. SAN DIEGO (KGTV)- Unlike many of its neighboring communities, San Diego’s Midway District does not have any tall skyscrapers. But the local planning commission is hoping that changes very soon. For the last 11 years, the Midway Pacific Highway community planning group has had a plan to modernize Midway. With the city’s lease of the Valley View Casino Center coming up in 2020, the group is hoping to share some big ideas.“What better way to create more housing than in Midway,” Cathy Kenton, Chair of the Midway Pacific Highway Community planning group, said.The advisory group’s goal is to rezone much of the 1,300-acre district, to encourage new, mixed-use construction. A big part of that would be the 11,000 new dwellings, which could increase the residential population from 3,000 to 23,000 in the next 30 years. Except there is one problem — the city’s 30-foot height limit.In 1972, San Diegans voted on Prop D, which limits all buildings west of I-5 in the area (Coastal Height Limit Overlay Zone), to 30 feet.The commission believes this outdated law is stifling its potential growth, literally.“40 feet would be terrific, 70 feet would be awesome,” Kenton said. “Anything that would help us get a little more vertical would certainly open up the community, and not make it so dense.”The commission’s current redevelopment renderings do not include any high-rises.“So they’re all very flat and pretty boring looking, to be honest,” Kenton said. But they are still presenting these plans to the Smart Growth and land use hearing and to city council next week.Kenton says getting that approved is only the first hurdle. She believes the only way that Midway can reach its highest potential is if Prop D is overturned by the voters.That requires a community petition or a city council vote to put the measure on the ballot. “No one has a crystal ball for whats going to happen,” Kenton said. Kenton says the likelihood of getting the measure on the June or November ballots is slim, but they will keep trying.Those opposed to it say, constructing tall buildings would obstruct ocean views. If residents eventually vote to overturn Prop D, the committee says they will go back to the drawing board, to include mostly middle and some low-income high-rise apartments. 2319

  

SAN DIEGO (KGTV)- Monday morning Escondido Police provided extra police patrols at a local mosque that was targeted on Sunday.Police say the Dar-ul-Arqam Mosque on 6th Avenue was set on fire by an arsonist that has yet to be identified.Worshipers inside the mosque noticed the flames around 3 a.m. on Sunday and were able to put them out before the fire could spread.Lt. Chris Lick with the Escondido Police Department said once police and arson investigators arrived, they determined that the fire was set intentionally. They also found a note left by the suspect.“Graffiti left behind by the suspect made reference to the shooting incident in New Zealand,” said Lt. Lick.The San Diego Police Department has also stepped up patrols at mosques across the city in response the incident in Escondido.San Diego's Anti-Defamation League issued a statement in support of the mosque and worshippers.“This attack appears to be meant to send a signal to the Muslim community” said ADL Regional Director Tammy Gillies. “Sadly, this type of behavior is consistent with the growth in hate crimes, rise in attacks on Muslims, and the surge in anti-Muslim bigotry that we have seen in our country and around the world.”A crowdfunding campaign was launched to help raise money to provide repairs and proper security at the mosque in Escondido.The campaign has received support from people across the country. SAN DIEGO (KGTV) --The FDA has placed new restrictions on a controversial birth control device called Essure.The maker of the implant, Bayer, will only be allowed to sell to providers who agree to fully inform women about the risks and side effects.A San Diego woman who had the Essure implant is now suing the physician who performed the procedure.She says she wasn't given enough information and wants to warn others about her experience.Three months after Essure was implanted she began experiencing severe pain. She eventually had a full hysterectomy. 568
