PHOENIX — Arizona news station ABC15 has learned that an Arizona lawyer assisting the Trump campaign is looking at ballots filled out with Sharpies as one focus for what could become an attempt to flip Arizona to President Donald Trump.The attorney says many Trump supporters who used Sharpies are worried that their votes are being thrown out as the counting process continues around Arizona. There is no evidence at this point that Sharpie votes have been disqualified.The attorney, who has deep roots in the state’s election processing system, told ABC15’s Nicole Valdes that the Sharpie ballots are on the radar of those deciding what, if anything, they may do in court. The information was given on condition that the source would not be named. ABC15 has verified that the attorney has direct knowledge of the developing legal strategy for President Donald Trump in Arizona.The information comes as ABC News reported Wednesday that Governor Doug Ducey told the White House he “sees something” that could get Arizona and its 11 electoral votes in the win column for the President.At this point, there’s no sign of any movement toward actual litigation around the Sharpie ballots or any other vote casting or vote counting activity.Arizona Secretary of State Katie Hobbs is on the record defending the Sharpie ballots, though a ballpoint pen is the recommended method for filling out a ballot. ABC15 checked in with attorneys representing Democratic candidates, who say they have not heard of any potential litigation yet.Sharpie is the trademarked name of a permanent felt tip marker. Its use on Arizona ballots became a prominent conversation point on Twitter overnight.The Maricopa County Elections Department says even if marks made by Sharpies or any felt tip marker on a ballot bleed through the paper, it won't impact their tabulator's ability to read contests. Maricopa County's tabulators are designed only to read the ovals for each contest, according to county election officials. Even if ink bleeds through to the other side of the ballot, the ink won't mark another contest, since ballots are printed in an "off-set" pattern, meaning contests on the back side of the ballot don't align with those on the front.Republicans and the Trump campaign were shocked when Fox News declared Democrat Joe Biden the Arizona winner at about 9:30 p.m. on Election Day. Ducey Tweeted his displeasure as Fox News election analysts defended the decision.Arizona remains too close to call in most media projections, but AP called Biden as the winner early Wednesday.ABC15 data analyst Garrett Archer says as votes are counted, the President will likely pick up more votes than Biden and the Democrat’s lead will shrink.It’s unclear if the President can overtake Biden, who is riding the wave of record early voting that favors Democrats.Tabulation continues throughout the state, focusing on ballots that were dropped off on Election Day and those that arrived by mail and were not part of the early counting process that began October 20. 3045

Philonise Floyd, a brother of George Floyd, challenged Congress to "stop the pain" during an appearance at a House Judiciary hearing on policing practices.During his opening statement, Philonise Floyd recalled watching the bystander video of his brother's arrest — the video that shows a police officer kneeling on his neck for more than eight minutes. George Floyd later died in police custody."I can't tell you the kind of pain you feel when you watch something like that. When you watch your big brother, who you looked up to your whole entire life die, die begging for his mom?" Philonise Floyd said. "I'm tired. I'm tired of pain. Pain you feel when you watch something like that."Police originally took George Floyd into custody for allegedly using a countefeit bill to buy to but tobacco at a Minneapolis convenience store."He didn't deserve to die over ," Philonise Floyd said. "I'm asking you, is that what a black man's worth? Twenty dollars? This is 2020. Enough is enough."He added that he hoped his brother's death would not be in vain."Please listen to the call I'm making to you now. To the calls of our family and the calls ringing out the streets across the world," Philonise Floyd said. "People of all backgrounds, genders and races have come together to demand change. Honor them. Honor George and make the necessary changes that make law enforcement the solution and not the problem."Floyd is one of about a dozen witnesses to testify during the hearing Wednesday. He'll be joined by Floyd family attorney Benjamin Crump. Other civil rights and activist leaders are also expected to testify.Also expected to testify are Dan Bongino — a former Secret Service agent and ally of President Donald Trump — and other supporters of current police practices, according to ABC News.The hearing comes a day after George Floyd was buried in Houston as largely peaceful demonstrations continue in his name in dozens of major cities across the country. Floyd died in police custody on Memorial Day after bystander video showed a police officer, Derek Chauvin kneeling on his neck for more than eight minutes. Four officers face charges in connection with Floyd's death, including Chauvin, who faces a second-degree murder charge.The hearing also comes after Democrats introduced the Justice in Policing Act — a bill that proposes several changes to policing practices in the wake of Floyd's death. Among the changes proposed in the legislation is the limiting of legal protections for police, the creation of a national database of excessive-force incidents and the banning of police choke holds. 2618

  

Papa John's tanked Tuesday after a report that a plan to sell the company has fallen apart.The Wall Street Journal reported that the asset manager Trian Management Funds is no longer interested in bidding for the company. According to the Journal, others are still considering taking a stake in the company, but not a total purchase.Papa John's (PZZA) stock was down 10% at market close Tuesday.Papa John's declined to comment for this story. Trian did not immediately respond to a request for comment from CNN Business.Rumors have been swirling for weeks about potential buyers for the company. Each report has caused shares of the company to spike. The Journal reported Trian's interest last month.Without a buyer, the struggling pizza company will have to find a way to convince investors that it can solve its problems on its own, and beat out competitors Domino's and Pizza Hut. That's a tall order.The company has been working hard to distance itself from controversial founder John Schnatter, who resigned his role as chairman in July after news broke that he had used the N-word on a conference call.Papa John's said earlier this month that same-store sales in North America fell by 9.8% during the most recent quarter. Total revenue dropped 15.7% from a year earlier to about 4 million.Schnatter also stepped down as CEO at the end of last year after he caused a controversy by blaming the NFL for poor pizza sales. Schnatter said sales were hurt by the way the league handled players' kneeling during the National Anthem in protest of racial injustice.Since then, Papa John's hasn't been able to regain its momentum, and sales have continued to slip.Other pizza sellers have struggled this quarter. Pizza Hut's sales were flat, and though Domino's (DPZ) reported domestic and international same-store growth, the company missed analyst expectations.But Pizza Hut and Domino's are better equipped to win the pizza wars. Domino's has invested heavily in tech, and Pizza Hut is bolstering its partnerships. Pizza Hut replaced Papa John's as the NFL's official sponsor earlier this year. 2159
